8, 1987, STATUS OF THE PROPOSED COUNTYWIDE AREA OF
BENEFIT FOR ROAD IMPROVEMENTS.

Justification
I. RECOMMENDATION
1. Accept report from the Public Works Director on the status
of the proposed Countywide Area of Benefit for road
improvements.
2 . Fix February 23 , 1988, at 10: 30 a.m. for a public hearing on
the proposed formation of the Countywide Area of Benefit for
traffic mitigation fees; and direct the Public Works
Director to give notice of the hearing and to file a copy of
the Development Program Report for the Countywide Area of
Benefit with the Clerk of the Board in accordance with
Government Code Sections 65091, 65962 and 66484.
3 . Acknowledge receipt of the 1st Stage Environmental Impact
Report Countywide Area of Benefit for Road Improvements,
Contra Costa County File #SCP 86-71.
4 . Direct the Public Works Director, the County Administrator
and County Counsel to explore procedures by which
established Areas of Benefit may borrow funds from each
other to expedite projects.

II. FINANCIAL IMPACT
Establishment of the proposed Countywide Area of Benefit will
decrease the future financial demand on the County for
infrastructure needed to serve new urbanization.
III. REASONS FOR RECOMMENDATION/BACKGROUND
Last March, staff met with each member of the Board of
Supervisors to discuss the proposed Countywide Area of Benefit
for road improvements. Based on input from these meetings, staff
revised the proposed Countywide Area of Benefit from a uniform
fee throughout the County to a set of regional fees. The County
has been divided into seven regions, each with a fee schedule
based on the projected development and road improvement needs
within that region.
At the request of the members of the Board of Supervisors, staff
presented the Countywide Area of Benefit to the City-County
Engineering Advisory Committee and received favorable response.
Many cities within Contra Costa County impose traffic mitigation
fees on new development and others are working on developing such
programs. Staff will continue to work with the cities to
encourage uniformity of fees within each region and to facilitate
joint solutions to traffic problems that cross jurisdictional
boundaries. Alameda County is also working on an ordinance
similar to our proposed Countywide Area of Benefit.
The Board of Supervisors referred the proposed Countywide Area of
Benefit to their Transportation Committee and to the Infra-
structure Subcommittee of the General Planning Congress. Both
committees endorsed the concept of traffic mitigation fees to
fund future infrastructure.
The Countywide Area of Benefit was also presented to the Central
County Traffic Advisory Committee (TRANSPAC) , the Highway 4 Task
Force and Contra Costa Council. As a result of meetings with the
various groups, the project list has gone through many revisions.
Projects have been both added and deleted. and some of the project
descriptions and cost estimates were changed. The project list
may be changed further during the hearing process required to
adopt an area of benefit. After the adoption of the Countywide
Area of Benefit, traffic advisory committees may recommend
changes to the project list to the Board of Supervisors.
The Draft Environmental Impact Report for the Countywide area of
Benefit was heard before the Contra Costa County Planning
Commission on July 14, 1987. Comments were responded to and the
document was certified on October 13, 1987.
The Development Program Report for the Countywide Area of Benefit ,
is on file with the Public Works Director and the Clerk of the Board.
Lack of adequate funds in an area of benefit trust account may
delay the construction of a needed road improvement project. A
policy allowing areas of benefit to borrow funds from each other
could prevent such delay.
IV. CONSEQUENCES OF NEGATIVE ACTION
Failure to fix a hearing date will prevent adoption of the
Countywide Area of Benefit. Development will continue to occur
without a formal procedure for constructing needed road
improvements.

Foundation Marsh Creek property.
SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
Direct the Community Development Department to transmit to the
Planning Congress the Board of Supervisor' s decision to deny the
request of the S. H. Cowell Foundation for General Plan Amendment
and ensure that the Planning Congress considers this and other
large area landowner requests when jointly reviewing city, as well
as County General Plan designations.

BACKGROUND/REASONS FOR RECOMMENDATIONS
On January 12 , 1988, the Board denied the request of the S. H.
Cowell Foundation for General Plan Amendment study on approximately
4,907 acres in the Marsh Creek Area. In addition, the Board
directed staff to submit wording of a referral to the Planning
Congress for consideration by the Board.
On January 19, 1988, staff distributed to the Board a memorandum
dated January 15, 1988 containing draft wording of the referral.
The wording contained in the Recommendation Section is based upon
feedback received from Board members on January 19.
