HomeMy WebLinkAboutMINUTES - 01121988 - 1.24 l` 2� IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY STATE OF CALIFORNIA SUBJECT: Need for Amendments to ) SB 709 (Chapter 1211, ) RESOLUTION NO. 88/23 Statutes of 1987) ) WHEREAS SB 709 was amended on the last night of the 1987 Legislative Session to include provisions requiring that counties which contain "no and low property tax cities" -transfer to those cities a portion of the county' s share of the roperty tax"hand WHEREAS the no and low property tax city provisions discriminate unfairly against counties which have such cities within their borders compared to counties which do not; and WHEREAS many no and low property tax cities do not provide the full range of municipal services provided by other cities which are not no and low property tax cities; and WHEREAS the transfers of property tax revenue to no and low property tax cities required by SB 709 will eventually exceed the revenue received from the Trial Court Funding Act to which these amendments were attached; and WHEREAS the only way under current law the county can avoid the transfer of property tax revenue to the no and low property tax cities is to refuse to opt-in to the Trial Court Funding Act; and WHEREAS the County has made as its highest priority for legislative action in 1988 the repeal or substantial amendment of the no and low property tax city provisions of SB 709; NOW, THEREFOR, BE IT BY THE BOARD OF SUPERVISORS OF THE COUNTY OF CONTRA COSTA RESOLVED that it indicate to the County Supervisors Association of California its grave concern regarding the no and low property tax city provisions of SB 709 and the need to have those provisions repealed or substantially amended to relieve the county of the financial burden caused by these amendments; and BE IT FURTHER RESOLVED that the Board of Supervisors indicates that in the absence of such a repeal or substantial amendment to the no and low property tax provisions of SB 709 the Board of Supervisors has grave reservations about the prudence and fiscal wisdom of opting in to the Trial Court Funding Act; and BE IT FURTHER RESOLVED that the Board of Supervisors directs the County Administrator to transmit a copy of this Resolution to the County Supervisors Association of California; the firm of Jackson/Barish and Associates; the Honorable Marian Bergeson, Chair, Senate Local Government Committee; the Honorable Willie Brown, Jr. , Speaker of the Assembly; the Honorable David Roberti, President Pro Tempore of the Senate and the members of this County' s legislative delegation.
