Contra Costa DATE: January 6, 1988coirty SUBJECT: Legislation - SB 1725 (Bergeson) SPECIFIC REQUEST(S) OR RECOMMENDATION S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION Adopt a position in support of SB 1725 by Senator Marian Bergeson which repeals the no .and low property tax city provisions of SB 709 (Chapter 1211, Statutes of 1987) and in their place appropriates $25 million to be allocated to the no and low property tax cities. BACKGROUND As the Board is aware, SB 709 was amended on the last night of the 1987 Legislative Session to include provisions which require the county, over a ten-year period, to insure that each city in the county is receiving the equivalent of 100 of the property taxes generated within that city. Those cities which do not currently receive 10% of the property tax are referred to as no or low property tax: cities. These amendments, which were attached to the Trial Court Funding bill, do not take into account the fact that not all cities provide the same level of services and that looking only at the level of property tax . received by the city itself does not tell the whole story. In addition the manner in which the amendments were introduced precluded any careful analysis of their effect on counties and provided no opportunity for public hearings. The Board has made repeal or substantial amendment to these provisions the highest priority on its 1988 Legislative Program. Senator Marian Bergeson has introduced SB 1725 because of her concern with the manner in which these amendments were attached to SB 709 at the last minute. SB 1725 is co-authored by Senators Ruben Ayala and Quentin Kopp and Assemblyman Jack O' Connell. SB 1725 repeals the no and low property tax city provisions of SB 709 to the extent that they require a transfer of property tax revenue from the county to the no and low property tax cities and instead appropriates $25 million for the 1988-89 fiscal year for the no and low property tax cities.
