SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION•
1 . That the Board of Supervisors designate the Contra Costa
Transportation Partnership Commission as the County
Transportation Authority pursuant to the provisions of SB 142.
This designation is subject to the concurrence of a majority of
the cities representing a majority of the population.
2. The Chair is authorized to send a letter to the cities asking
for their concurrence in this matter.
3 . Department heads are directed to provide assistance to this
effort as -requested by the Transportation Planning Division of
the Community Development Department. It is anticipated that
staff support will be required from the County Administrator' s
Office, County Counsel and the Department of Public Works,
although other departments ' assistance may also be required.
4. The Board of Supervisors ' County Transportation Committee
(Transcom) will act to reconcile what the staff priorities of
the County are, in the event that there are conflicting
priorities. The Transcom will make its recommendations on such
conflicts to the Board as necessary to resolve these priority
conflicts.
5. The Board should request the County Transportation Authority to
consider reimbursing the County for staff time in developing the
Expenditure Plan, assuming that a tax measure is placed on the
ballot and is successful.

FINANCIAL IMPACT:
There is no financial impact associated with the designation of SB
142 as the legislative mechanism through which a sales tax measure
would be developed.
The County Transportation Planning Division staffs the Transportation
Partnership Commission. The designation of the Partnership
Commission as the County Transportation Authority would require the
continued allocation of significant amounts of staff time to support
the effort. It should be noted that the cities are in the process of
allocating and/or paying for the overhead costs associated with the
first three months of Commission operation ( $13 ,291) .
It is anticipated that funds will be allocated by the cities and the
County to cover the overhead costs associated with the operation of
the Commission from January, 1988 through June, 1988 ( $26, 582) . In
addition, the Contra Costa Council has contributed funds to cover
temporary clerical services for the first three months of the
Commission ( $6, 375) and is currently considering a Partnership
request to contribute funds to provide the same services through
June, 1988 .
REASONS FOR RECOMMENDATIONS/BACKGROUND:
The Contra Costa Transportation Partnership Commission was proposed
by the cities and approved for establishment by the Conference of
Mayors and the Board of Supervisors in the first half of 1987.
The purpose of the Partnership is to provide a forum on countywide
transportation issues and to develop a countywide transportation
improvement and financing program.
The Partnership has been meeting since September, 1987. The Regional
Planning Committees established under the Partnership are close to
completing their subregional plans for submission to the Partnership.
When all of the plans have been submitted, the Partnership with the
assistance of its Advisory and Technical Committees will blend the
regional plans into a Countywide Transportation Plan.
The Partnership has given serious consideration to possible methods
of financing the County Transportation Plan. While no decision has
been made yet on a specific target date for a ballot measure, the
Partnership has determined that use of the provisions of SB 142 as a
base for developing a ballot measure is appropriate. SB 142 became
law on January 1, 1988 and provides for the development of a ballot
measure for presentation to the voters. The.., provisions of the bill
are less cumbersome than those established under SB 878. It is
intended by the Partnership that additional elements and requirements
would be added to the baseline SB 142 provisions.
SB 142 provides for the establishment of a County Transportation
Authority in advance of the ballot measure. The Board of Supervisors
and a majority of the cities representing a majority of the
population must concur in the designation of a new entity as the
County Transportation Authority. The Partnership' s action taken on
January 20, 1988 on SB 142 is attached for the Board' s information.
At the same meeting, the Transportation Partnership Commission voted
to request that the Board of Supervisors designate the Partnership
Commission as the County Transportation Authority subject to the
concurrence of a majority of the cities representing a majority of
the population. Also attached is a copy of this action by the
Partnership. ( It should be noted that urgency legislation, SB 179,
is currently being sought which will clean up discrepancies in SB
142 . The main affect will be that the designation of the
Transportation Partnership Commission as the Authority would make
them a legally constituted body rather than an interim one) .
If the Board acts favorably on this request, the Partnership would
then inform the Conference of Mayors and seek early action by the
cities in order to meet the requirements for action by a majority of
the cities representing a majority of the population. If designated
as the Authority, the Partnership would report on a regular basis, to
the Board and the Conference of Mayors on its progress toward the
development of an Expenditure Plan.
The development of the Expenditure Plan is a high priority to many in
the County and every effort needs to be made to ensure the timely
development of the plan for placement on the ballot. It is
anticipated that a team of County staff people will be required to
support this effort.
CONSEQUENCES OF NEGATIVE ACTION:
Lack of Board approval will hamper the development of an Expenditure
Plan and the placement of a measure on the ballot, should the
Transportation Partnership Commission recommend such an action.

ITEM: SB 142
PURPOSE
The purpose of this item is to discuss and consider the use of
the provisions of SB 142 as a baseline for the development of a
countywide transportation and financial program.
EVALUATION
Over the past several months, the TPC has reviewed the provisions
of SB 142 which passed into law on January 1, 1988.
The Commission has also reviewed the provisions of SB 878 which
was used to develop the Measure C expenditure plan presented to
the voters in November 1986.
In the course of this review, the TPC has consulted with its
Advisory Committee, Regional Planning Committees and Technical
Coordinating Committee as well as City and County representatives
• to the Metropolitan Transportation Commission (MTC) . As a result
of this review, it is apparent that SB 142 can serve as a basis
for creating a program to meet the special needs of Contra Costa
County and its cities. Based on discussions with the Advisory
Committee and recommendations from staff, it is the intent of the
TPC to use the provisions of SB 142 and to also add elements
and/or requirements which are specifically tailored to Contra
Costa's needs.
RECOMMENDATION
It is recommended that the TPC take the following actions:
Designate SB 142 as the legislation under which a Countywide
Transportation Improvement and Financing Program will be
developed. Such designation shall not preclude adding elements
and/or requirements to the plan reflecting the needs of Contra
Costa County and its cities.

PURPOSE
The purpose of this item is to consider a request to the Board of Supervisors to
designate the Transportation Partnership Commission as the interim County
Transportation Authority pursuant to the provisions of SB 142. Action on this
item presumes designation of SB 142 as the legislative mechanism to be used to
develop a countywide transportation and financial program.
EVALUATION
SB 142 allows the Board of Supervisors to designate an interim Transportation
Authority and to determine its membership, with the concurrence of a majority of
the cities representing a majority of the population.
The TPC may request that the Board of Supervisors designate it as the interim
Transportation Authority for the purpose of developing a county transportation
expenditure plan. This plan may not be adopted by the TPC prior to approval by
the Board of Supervisors and a majority of the cities representing a majority of
the population. Upon such approval and adoption of the plan by the TPC, the
Board of Supervisors may place the plan before the voters.
• In order to set the development of a transportation improvement and financing
program in motion, it is recommended that the TPC request the Board of
Supervisors and the cities to approve the designation of the Partnership
Commission as the interim County Transportation Authority. The establishment of
the Authority on a permanent basis under SB 142 is subject to voter approval .
To ensure that all parties in this process are kept fully informed of the
progress of the TPC, regular reports shall be made to the Conference of Mayors
and the Board of Supervisors. The Commission may, at its option, designate its
staff to make these reports and provide such information to any interested party
or agency.
RECOMMENDATION
It is recommended that the TPC take the following action:
Request that the Board of Supervisors designate the TPC as the interim County
Transportation Authority subject to the concurrence of a majority of the cities
representing a majority of the population. Presuming a favorable action by the
Board of Supervisors, report to the Conference of Mayors on this request and seek
early action by the cities on concurrence to the request for designation. If
designated as the Authority, the TPC shall report to the Board and the Conference
of Mayors on its progress toward the development of an expenditure plan.
