HomeMy WebLinkAboutMINUTES - 02021988 - 1.25 b uRDINANCE NO. 88-17 (Redemption Value for Wine Cooler and Spirit Cooler Containers) The Contra Costa County Board of Supervisors ordains as follows (omitting the parenthetical footnotes from the official text of the enacted or amended provisions of the County Ordinance Code) : [Govt.C.§25120] SECTION I . SUMMARY. This ordinance adds Division 55, Alcohol Containers, to the County Ordinance Code to require a redemption value for all wine cooler and spirit cooler containers sold within the County. SECTION II . Division 55, Chapter 55-2 wine cooler and spirit cooler containers, Sections 55-2.002 Definitions; 55-2.004 Distribution Requirements; 55-2.006 Retail Requirements; 55-2.008 Distributor Redemption Requirements; 55-2. 010 Retail Redemption Requirements; 55- 2.012 Violation and Fine; 55-2.014 Severability; and 55-2.016 Condition of Continuity are added to the County Ordinance Code to read: Division 55 ALCOHOL CONTAINERS Chapter 55-2 Wine and Spirit Cooler Containers Section 55-2.002 Definitions. For the purpose of this ordinance, the following definitions shall apply: (a) "County" means the unincorporated area of the County of Contra Costa, State of California. (b) "Consumer" means every person who, for his or her use or consumption, purchases wine cooler or spirit cooler in a container from a dealer in the County. (c) "Container" means any sealed device, made of glass, metal, plastic, or other material or any combination of materials, which holds or contains wine cooler or spirit cooler. "Container" does not include cups or other similar open or loosely sealed receptacles. (d) "Dealer" means any person who sells wine cooler or spirit cooler in a container or containers to a consumer. (e) "Distributor" means any person who sells wine cooler or spirit cooler in a container or containers to a dealer. "Distributor" includes any person who imports or otherwise transports. wine cooler or spirit cooler in containers from outside the County for sale to a dealer in the County. (f) "Empty" as used herein to describe a container, means a container which is all of the following: (1) Has the original seal or closure broken or removed; (2 ) Does not contain foreign materials other than the residue of wine cooler or spirit cooler originally packaged in the container; ORDINANCE NO. 88-17 J I SECTION III EFFECTIVE DATE. This ordinance becomes effective January 1, 1989, and within 15 days after passage shall be published once with the names of supervisors voting for and against it in the Contra Costa Times a newspaper published in this County. §§25123 & 25124 PASSED on February 2 , 1988 by, the following vote: AYES: Supervisors Powers , Fanden , McPeak, Torlakson , Schroder.
