Justification
I . RECOMMENDATION
AUTHORIZE the alteration of Purchase Order No . 40524 issued to
Universal Engineering Incorporated to increase the amount to
$ 78 , 090 . 30 for remediation of hazardous materials . AUTHORIZE
staff to initiate action to recover remediation costs .
II . FINANCIAL IMPACT
The purchase order amount , originally $7 , 500 . 00 , will be
increased by $70 ,590 . 30 to pay the estimated investigation and
remediation costs .
III . REASONS FOR RECOMMENDATION/BACKGROUND
On December 16 , 1986 the Board approved the purchase of the
former Fukishima Nursery property . On September 24 , 1987 a fire
lead to the discovery of unidentified chemical materials on the
property . Acting on the recommendations of the County Health
Services Department , the area was isolated and a hazardous waste
cleanup contractor was hired to determine the. type and
distribution of unidentified materials . Investigation revealed
the presence of hazardous levels of pesticide residue and
significant amounts of asbestos pipe insulation . These materials
must be removed and properly disposed of as soon as possible .

Our present hazardous waste cleanup contractor has begun
segregation and packaging of hazardous materials required due to
disturbance during investigation . We recommend extending our
contractor' s scope of service to include complete remediation and
disposal by increasing the payment limit of our purchase order .
Our contractor has agreed to perform the additional work on a
time and materials basis .
Our land purchase contract may provide for the recovery of our
cleanup costs from the former owner . With concurrence from
County Counsel we will initiate legal action to make such a
recovery .
CONSEQUENCES OF NEGATIVE ACTION
The Corps of Engineers cannot commence demolition and clearing
operations on the Fukishima property until the cleanup has been
completed .
