TO: BOARD OF SUPERVISORS FROM: Water Committee ClJl ltra, Costa DATE: February 1, 1988 )U* SUBJECT: Amendment to Legal Services Agreement with Cressey Nakagawa and Funding for Committee for Water Policy Consensus SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION i. Approve as governing board of the Contra Costa County Water Agency, Amendment No. 1 to the Agreement for Legal Services with Cressy H. Nakagawa, and authorize the Chair to execute the agreement ( increase in contract of $40 , 000 ) . 2. State the Board' s intent to appropriate up to $19,000 in fiscal year 1988-89 from the Water Agency budget to the Committee for Water Policy Consensus. FINANCIAL IMPACT The $40 ,000 contract amendment for Cressey Nakagawa is within the budget for Professional/Specialized Services in the Contra Costa County Water Agency budget. The Water Agency is funded by prop- erty taxes dedicated to the Water Agency which cannot be spent for other purposes. Water Agency budget for fiscal year 1988-89 is being prepared by the County Community Development Department. The $19 , 000 alloca- tion to the Committee for Water Policy Consensus will be included in the Water Agency' s budget request. REASONS FOR RECOMMENDATION/BACKGROUND The. Board of Supervisors, as governing board of the Contra Costa County Water Agency, has designated Cressey Nakagawa as Special Water. Counsel to the Agency. An existing agreement effective July 1 , 1987 , through June :30 , 1988 , exists with a payment limit of $50,000 . The payment limit needs to be increased by $40,000 to $90 , 000 in order to continue Mr. Nakagawa' s efforts represent- ing the Agency at the State Water Resources Control Board Bay- Delta hearing. At the time of execution of the original agreement, it was unknown what level of participation at the Bay-Delta hearings would be necessary through the.. f1scai.. year. The initial estimate of $50,000 was low. Mr. Nakagawa will require an additional $40,000 to complete County representation through the end of the fiscal year. For fiscal year 1987-88 , $17 ,000 was allocated. The County Community Devel- opment Department is currently preparing the Water Agency budget for fiscal year 1988-89. The Water Committee requests a commit- ment from the Board to fund the Committee for Water Policy Consensus for $19 , 000 for fiscal year 1988-89 . The Committee felt that it is appropriate to reserve funding for the Committee for Water Policy Consensus at the same time additional funds are being sought for legal services. The public policy and public education benefits from the Committee for Water Policy Consensus will enhance the work of the Special Water Counsel on legal matters. DBO: jn 13 / :cressey.brd
