Request a review by the Community Development Committee of the land use entitlement and the general plan for Discovery Bay to determine what requirements or directions are set out in the land use entitlements for architectural and design standards. 2 . Refer to the Internal Operations Committee to review the matter of compliance with the architectural and design standards set by the Discovery Bay Design and Environmental Review Committee (DERC) . 3 . Request that the Building Inspection Department review the Community Development Committee' s report to the Internal Operations Committee on this subject and on recent specific complaints regarding non-compliance .with design standards and community codes. Three specific cases involve houses at 1200 Discovery Bay Boulevard, Lot 20 Tract 4077 and Lot 36 Tract 4207 . BACKGROUND INFORMATION: There have been several ongoing serious concerns on the part of the Design and Enviromental Review Committee of the Discovery Bay Property Owners Association (DBPOA) . These concerns involve following the guidelines set out in the Codes Covenants & Restrictions (CC&R' S) . There are serious concerns regarding enforcing design standards and safety codes. In a recent meeting with leaders of the DBPOA' s Design and Environmental Review Committee, I learned first hand and in detail the situation at 1200 Discovery Bay Boulevard relating to problems of compliance with the State of California Building Code requirements and DERC approved plans. In the case of Lot 20, Tract 4077, there are concerns regarding the approval of set-backs which allegedly do not comply with the adopted county standards. In the case of Lot 36, Tract 4207 the complaint is that the deck is too high. The Building Inspection Director also indicated that he would implement a policy with .his inspectors that as soon as they notice any non-compliance with DERC specifications they are to notify the DERC by contacting Roberta Fuss, -DERC secretary. We are all well aware that Discovery Bay is a very special community and its residents place a very high value on the Discovery Bay Master Plan. The community recently went through an extensive process in reviewing its CC&R' s. They voted democratically, lot by lot, to extend the CC&R' s permanently and to make membership on the Property Owner' s Association mandatory. The Executive Board of the Property. Owner' s Association, from here on out, will be elected by the Discovery Bay property owners. The DBPOA Executive Board will appoint the Design and Environmental Review Committee. I believe that this system is one of the most formalized in existence in any community in Contra Costa County. I commend it and believe we should be supportive .and that our county departments should do everything in their power to assist in seeing these high quality goals implemented. TT:gro
