SUBJECT; REPORT FROM COUNTY ADMINISTRATOR ON CONSOLIDATING THE
MARSHAL'S OFFICE INTO THE SHERIFF'S DEPARTMENT
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
Accept this report from the County Administrator on consolidating the Ma�h�l's Office
into the Sheriff's Department, as recommended by the Superior and Municipal. Court Judges
the Sheriff-Coroner, and the Marshal's Office, and take the following actions:
1. Approve consolidation plan, effective July 1, 1988, as recommended by the Superior
and Municipal Court Judges, the Sheriff-Coroner, .and the Marshal's Office.
2. Request Assemblyman William Baker to amend AB 3014 to include the Sheriff-Marshal
consolidation language as proposed by the above-cited parties.
3. Direct the County Administrator, Director of Personnel, Sheriff-Coroner and Marshal
to take necessary interim steps to ensure a smooth transition to the new
organizational arrangement on July 1, 1988 and to submit required personnel actions
to the Board of Supervisors for approval.
4. Effective July 1, 1988, transfer 48 authorized positions in the Marshal's Office to
the Sheriff's Department Budget Unit 0255, cancel the following authorized positions:
9 deputy sheriffs (Class 6XWA), 5 clerks - experienced level (Class JWXB), 1
lieutenant (Class 6XHA), and add Assistant Sheriff-Court Services, and Captain-Court
Services.
FINANCIAL IMPACT:
Consolidation of the Marshal's Office into the Sheriff's Department, as recommended above,
will result in a cancellation of a number of positions and in an estimated annual savings
of $350,942.
REASONS FOR RECOMMENDATIONS/BACKGROUND:
In a letter dated November 2, 1987, Richard Rainey, Sheriff=Coroner, and Mark Simons,
Judge, . Mt. Diablo Municipal Court indicated that a plan for a Sheriff/Marshal merger of
bailiff, civil process and court holding functions would be forwarded to the Board of
Supervisors. That plan and the implementing legislation has been developed and approved
by the Sheriff-Coroner and the Superior and Municipal Court judges.

The County Administrator's Office conducted a feasibility study of consolidating
court-"related services in Contra Costa County (July 24, 1986). The Sheriff-Coroner and
Municipal Court judges developed alternate proposals and presented them to the Board on
October 3, 1986. Supervisor Tom Powers met with a Task Force on Marshal/Sheriff
Consolidation, consisting of representatives from the Superior Court and Municipal Court,
regarding these proposals, discussed organizational concepts and options, and began the
negotiating process.
The Sheriff-Coroner and Presiding Judge of the Municipal Court Judges Association
developed the specifics of the final plan and legislation currently before you.
(February 8, 1988).
The plan calls for the transfer of 48 positions in the Marshal's Department to the
Sheriff's Department. There will be created a court services division within the Contra
Costa County Sheriff's Department to serve the Superior and Municipal Courts. There is a
proposed reduction in personnel positions arising from the merger for an estimated savings
of $350,942.
The County Administrator's Office study had indicated a merger could save an estimated
$825,436. The differences in the proposed plan and the County Administrator's Office
study are:
1. Keeping the Branch Offices open (to maintain local access to these court
services).
2. Maintaining four sergeant positions (one in each municipal court district for
supervision and court security).
3. Keeping an additional clerical position and eliminating the lower, rather than
higher level, clerical positions.
4. Upgrading the Marshal to Assistant Sheriff.
5. Upgrading the lieutenant to captain.
6. Keeping a captain in the Services Division.
The proposed plan includes provision for a Court Services Oversight Committee consisting
of three Municipal Court judges and two Superior Court judges in even-numbered years and
three Superior Court judges and two Municipal Court judges in odd-numbered years. The
Oversight Committee approves transfers, staffing levels, recommended budget, and security
plans through the Assistant Sheriff, Court Services Division.
With approval of this plan and implementing legislation, the Marshal's Office will be
eliminated effective July 1, 1988 and its functions transferred to the Sheriff's
Department, resulting in the elimination of 15 positions (9 deputy sheriffs, 1 lieutenant
and 5 clerks - experienced level). The projected annual savings will result in a
reduction of the Marshal's Office fiscal year 1988-89 budget allocation and the transfer
of the reduced amount to the Sheriff's Department.
A further review of the staffing levels and operation of court services should be
conducted after there is some experience with the consolidated operation.
