RECOMMENDATION
Support AB 2705 (Katz) if amended to focus on regulation of approved routes
for transportation of inhalation hazards and labeling of vehicles (as
currently done with explosive materials) .

REASONS FOR RECOMMENDATION/BACKGROUND
On November, 10 , 1987 the Board of Supervisors requested the Hazardous
Materials Commission to review and report back to the Board on
recommendations on Pre-print AB 5 (Katz) , since introduced as AB 2705 . The
purpose of the Bill was to increase public safety surrounding
transportation of inhalation hazards.
After hearing from various interest groups, the Commission concluded that
the purpose of the Bill would be best achieved if it required labeling of
vehicles rather than notification to Fire Districts. Notification or
notation of inhalation hazards on a manifest would not immediately convey
the inhalation hazard in case of emergency or spill. Container labeling
would do so. Also, Section 32104 (Al ) exempts notification to small Fire
Districts. Yet, it is these Fire Districts who have the fewest resources
to respond to emergencies. Industry also indicated concerns on the need
for provision for emergency shipments. Recently, one major industry
required an emergency shipment without which they would have to shut down
their plant. In addition, Section 34104 (A) is not clear whether or not
rail transport is included under the regulations.
