Code Sec. 25526. 6 SUBJECT: Conveyance of Easement to Pacific Gas and Electric Co. Flood Control District Lines E-E1 Project No. W.O. 8367 Brentwood Area The Board of Supervisors, as the Governing Body of Contra -Costa County Flood Control and Water Conservation District RESOLVES THAT: The District acquired the real property on Lines E-E1 in the Brentwood area for flood control purposes. Pacific Gas and Electric Company has requested an easement for a gas pipe line. This Board FINDS that the conveyance of such easement is in the public interest and will not substantially conflict or interfere with the District's use of the property. This Board hereby APPROVES, and AUTHORIZES the conveyance of an easement to Pacific Gas and Electric Company, over the property described in Exhibit "A" attached hereto, pursuant to Government Code Section 25526.6 and the Board Chair is hereby AUTHORIZED to execute an easement on behalf of the District in consideration for the payment received in full in the amount of $7,200.00 ($5,000.00 deposit previously received, balance of $2,200.00 upon this conveyance) . The Real Property Division is DIRECTED to cause said easement to be delivered to the grantee. The Board hereby FINDS that the project will not have a significant effect on the environment, and DETERMINES that the project is exempt from the requirements of the California Environmental Quality Act as a Class 12 Categorical Exemption under County Guidelines and Section 15312 of the State CEQA Guidelines, and DIRECTS the Public Works Director to file a Notice of Exemption with the County Clerk. A strip of land of the uniform width of 20 feet extending from the northerly boundary line of the 54 foot strip of land described in Exhibit "A" attached to and made a part of the deed from Olinto Narducci dated February 24, 1977 and recorded in Book 8266 of Official Records at page 107, Contra Costa . County Records, southerly to the southerly boundary line of said 54 foot strip of land and lying 10 feet on each side of the following described line: Commencing at the found 4 inch Contra Costa County monument stamped "N-1", accepted as being point "N-1", referred to in the description of said 54 foot strip of land which marks the westerly terminus of the course in the northerly boundary line of said 54 foot strip of land which course according to the description contained in said deed dated February 24, 1977 has a bearing of south 890 23' 08" east (north 890 58.0' east for this description) and a length of 445.46 feet and running thence along said northerly boundary line (a) north 89° 58.0' east 36.2 feet to the TRUE POINT OF BEGINNING of said line; thence leaving said northerly boundary line and running (1) south 00 01.1' east 54.0 feet, more or less, to a point in the southerly boundary line of said 54 foot strip of land. The foregoing description is based on a survey made by Grantee in September 1983. The bearings used are based on solar observations made by Grantee. 2. A strip of land of the uniform width of 10 feet lying contiguous to and southerly of the northerly boundary line of the strip of land varying in width described in Exhibit "A" attached to and made a part of the deed from Olinto Narducci dated February 24, 1977 and recorded in Book 8266 of Official Records at page 107, Contra Costa County Records, said strip of land varying in width is described with the strip of land 54 feet wide described in said deed dated February 24, 1977, as a part thereof, and extending from the westerly boundary line of the hereinbefore described strip 1 westerly approximately 1,045 feet to the easterly boundary line of the strip of land third described in the deed from 0. C. Prewett and wife to Lone Tree Irrigation District dated June 20, 1923 and recorded in Book 448 of Deeds at page 84, Contra Costa County Records. 3. A strip of land of the uniform width of 10 feet lying contiguous to and southerly of the northerly boundary line of the strips of land 40 feet wide conveyed to Contra Costa County Flood Control and Water Conservation District by (a) the deed from Edward A. H. Prewett and Edward Arthur Prewett dated December 19, 1975 and recorded in Book 7725 of Official Records at page 503, Contra Costa County Records, (b) the deed from Emanuel P. Razeto dated March 8, 1979 and recorded in Book 9340 of Official Records at page 127, Contra Costa County Records, (c) the deed from Rancho Palo Associates , a Limited Partnership, dated January 19, 1978 and recorded in Book 8748 of Official Records at page 82, Contra Costa County Records and (d) the deed from Walter Leo Rippee, and wife dated August 2, 1976 and recorded in Book 8085 of Official Records at page 435, Contra Costa County Records, extending from the westerly boundary line of the strip of land third described in the deed from 0. C. Prewett and wife to Lone Tree Irrigation District dated June 20, 1923 and recorded in Book 448 of Deeds at page 84, Contra Costa County Records, westerly 2,535.0 feet. 4. A strip of land of. the uniform width 20 feet extending from the northeasterly boundary line of the strip of land fifth described in Exhibit "A" attached to and made a part of the deed from Ileece Riede and Mildred Ford dated July 8, 1976 and recorded in Book 8026 of Official Records at page 578, Contra Costa County Records, southerly to the northeasterly boundary line of the strip of land described in the deed from Leland S. Gann and wife to the East Contra Costa . Irrigation Company dated November 28, 1922 and recorded in Book 427 of deeds at page 218, Contra Costa County Records, and lying 10 feet on each side of the following described line: Commencing at the found . 4 inch Contra Costa County monument stamped "H-1" , accepted as being point "H-1" , referred to in the description of the strip of land conveyed by said deed dated July 8, 1976, which marks the southeasterly terminus of the course in the northeasterly boundary line of the strip of land fifth described in said Exhibit "A" which course according to the description contained in said deed dated July 8, 1976 has a bearing of south 33° 47' 00" east (south 34° 25.9' east for this description) and a length of 993.49 feet and running thence along said northeasterly boundary line (a) north 340 25.9' west 20.9 feet to the TRUE POINT OF BEGINNING of said line; thence leaving said northeasterly boundary line and running (1) south 54° 25.6' west approximately 15 feet to a point in the northeasterly boundary line of the strip of land described in said deed dated November 28, 1922.
