WHEREAS pursuant to Penal Code section 1465 as amended by Senate
Bill 612, Chapter 945 (Statutes of 1988) a county, upon adoption of a resolution
by its Board of Supervisors, may impose for the Emergency Medical Services Fund
an assessment of two dollars ($2) for every ten dollars ($10) or fraction
thereof, upon every, fine, penalty or forfeiture imposed and collected by the
courts for criminal . offenses.
WHEREAS Resolution 88/371 established the Emergency Medical Services
Fund of the County of Contra Costa and imposed pursuant to Penal Code section
1465, as originally enacted an assessment of one dollar ($1) on fines, penalties
and forfeitures imposed and collected by the courts of Contra Costa County for
criminal offenses.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. Pursuant to Penal Code section 1465, as amended by SB 612; on
January 1, 1989, and thereafter, there shall be levied, and the courts shall
collect., in addition to the assessments or surcharges prescribed by Penal Code
section 1464, an assessment in the amount of two dollars ($2) for every ten
dollars ($10) or fraction thereof upon every fine, penalty, or forfeiture
imposed and collected by the courts of Contra Costa County for criminal offen-
ses, including all offenses involving a violation of a section of the Vehicle
Code or any local ordinance adopted pursuant to the Vehicle Code, except offen-
ses relating to parking or registration, or offenses by pedestrians or
bicyclists, or where an order is made to pay a sum to the general fund of the
county pursuant to clause ( iii ) of paragraph (3) of subdivision (a) of Section
258 of the Welfare and Institutions Code.
2. All such assessments shall be transferred to the County
Auditor-Controller for deposit to the Emergency Medical Services Fund of the
County of Contra Costa. Payments from the Emergency Medical Services Fund shall
comply with the disbursement requirements of California Health and Safety Code
sections 1797.98a, et seq. and shall further satisfy all disbursement conditions
which may hereafterbe imposed by the Board of Supervisors.
