3 . Adopt the County Planning Commission' s findings �as set forth in
its resolution #64-1988 as the basis for your Board' s decision.
4. Introduce the ordinance giving effect to the rezoning; waive
reading and set date for adoption of same.

On recommendation of Supervisor Fanden, IT IS BY THE BOARD ORDERED that
recommendations 1, 2, 3 and 4 are APPROVED; and as in recommendation 4,
Ordinance No. 89-3 is INTRODUCED, reading waived, and January 10, 1989
is set for adoption of same.

RESOLUTION OF THE PLANNING COMMISSION OF THE COUNTY OF CONTRA
COSTA, STATE OF CALIFORNIA, INCORPORATING FINDINGS AND RECOMMENDAT-
IONS ON THE REQUESTED CHANGE IN ZONING BY JAMES F. & GLORIA TAYLOR
(APPLICANTS & OWNERS) , ( 2811-RZ) , IN THE ORDINANCE CODE SECTION
PERTAINING TO THE PRECISE ZONING FOR THE EL SOBRANTE AREA OF SAID
COUNTY.
WHEREAS, a request by JAMES F. & GLORIA TAYLOR (Applicants &
Owners) , ( 2811-RZ) , to rezone 2.51 acres from Single Family
Residential District (R-7 ) to Neighborhood Business District (N-B) ,
was received by the Community Development Department on August 10,
1988; and
WHEREAS, a Negative Declaration of Environmental Significance
was posted for this project on October 10, 1988; and
WHEREAS, after notice thereof having been lawfully given, a
public hearing was scheduled for this application before the County
Planning Commission on Tuesday, October 25, 1988, whereat all
persons interested therein might appear and be heard; and
WHEREAS, the County Planning Commission having fully reviewed,
considered and evaluated all the testimony and evidence submitted
in this matter; and
NOW., THEREFORE, BE IT RESOLVED that the County Planning Comm-
ission recommends to the Board of Supervisors of the County of
Contra Costa, State of California, that the request of JAMES F. &
GLORIA TAYLOR (Applicant & Owners) , . ( 2811-RZ) , to rezone 2. 51 acres
from Single Family Residential District (R-7) to Neighborhood
Business District (N-B) , be APPROVED as is indicated on the
findings map entitled: PAGE J-7 OF THE COUNTY' S 1978 ZONING MAP,
which is attached hereto and made a part hereof; and
BE IT FURTHER RESOLVED that the reason for this recommenda-
tion is as follows:
1. The requested rezoning designation conforms with the
general plan for this area.
BE IT FURTHER RESOLVED that the Chair and Secretary of this
Planning Commission will sign and attest the certified copy of this
resolution and deliver the same to the Board of Supervisors all in
accordance with the. Government Code of the State of California.
The instructions by the Planning Commission to prepare this
resolution was given by motion of the Planning Commission on Tues-
day, October 25 , 1988 , by the following vote:
AYES: Commissioners - Feliz, Nimr, Accornero, Aiello,
Lane, Whitney.

CONTRA COSTA COUNTY PLANNING COMMISSION
TUESDAY, OCTOBER 25, 1988 - 7:30 P.M.
I. INTRODUCTION
JAMES F. AND GLORIA TAYLOR (Applicants and Owners) , County File #2811-RZ:
The applicants request approval to rezone land from Single Family
Residential (R-7) to Neighborhood Business District (N-B) . Subject
property is described as follows: A 2.51 acre property fronting for
approximately 318 feet on the northwesterly side of Valley View Road across
from Jo-Lin Court, in the El Sobrante area. Site is the location for the
Jo-Lin stables. (ZA: J7)(CT 3468)(Parcel #433-220-005)
II. RECOMMENDATION
Adopt a resolution recommending that the Board of Supervisors approve
2811-RZ.
III. GENERAL INFORMATION
A. General Plan: The site is designated Neighborhood Shopping on the
1980 E1 Sobrante General Plan. The creek area is shown as open space.
B. CEQA Status: A Negative Declaration of Environmental. Significance has
been posted.
C. Site Description: The site is presently used for horse stables. San
Pablo Creek is located along the northerly and westerly side of the
property.
D. Surrounding Area: A house is located immediately south of the site.
Beyond the residence is a small commercial center. Across Valley View
Road and around Jo-Lin Court is an area of single family residences.
To the north of Jo-Lin Court there is an animal feed store. That area
is zoned General Agriculture. The land north of the site is owned by
the East Bay Municipal Utility District and used as a water treatment
plant. Condominiums are located to the west of the site on D'Avilla
Road.
E. E1 Sobrante Valley Planning and Zoning Committee: The committee has
recommended approval of the rezoning request since it conforms to the
1980 E1 .Sobrante General Plan.
F. City of Richmond: The City of Richmond had no comments.
IV. STAFF ANALYSIS
The rezoning request conforms to the General Plan for the area.
Any significant change in the use of the site will require the approval of
a Development Plan or Land Use Permit at a pulblic hearing.

Development would have to have proper setbacks from S{an Pablo Creek.
Property to the south of the site is zoned Retail Business.
V. CONCLUSION
Based upon the fact that this rezoning request conforms to the general plan
for the area, staff recommends that the Planning Commission adopt a
resolution recommending that the Board of Supervisors approve 2811-RZ to
rezone the site from Single Family Residential (R-7) to Neighborhood
Business (NB) .
