SUBJECT: Reorganization of School District Boundaries
It is by the Board Ordered that, pursuant to Education Code S 35765,
the boundaries of the Mt. Diablo Unified School District, Martinez Unified
School District, Acalanes Union School District, and Lafayette School
District are reestablished, effective July 1, 1989, in accordance with the
attached description and map of the affected territory (incorporated by
reference herein) , and the May 19, 1988 action of the Contra Costa County
Committee on School District Organization in adopting the Final Proposal
for transfer of said territory.

The special meeting of the County Ccmmittee on School District Organization was called
to order at 7:03 p.m. with the Pledge of Allegiance. County Committee Chairman Don
Dyer explained that this public hearing was actually one hearing to be held in three
different locations on three different nights. He .asked that those wishing to speak
to the- issue fill out speaker cards to speak to the issue only once.
APPROVAL OF MINUTES
It was moved by Mrs. Burch, seconded by Mrs. McAuley, to approve the minutes of
March 30, 1988. Clyde, absent; Spears, abstained; all other Committee members,. aye..
The motion carried.
Committee member Clyde arrived at the meeting at 7:10 p.m.
PUBLIC HEARING
Before opening the Public Hearing, John Hendrickson briefly reviewed the
background of the issue and stated that after closing the Public Hearing rn May 19,
the County Ccmmittee would consider action on whether or not -to adopt the Tentative
Proposal as its Final Plan. Maps and copies.of the tentative plan were made available
to those in attendance. He explained the reasons .why the four District Boundary Study
Committee was formed and how the study area was identified. The four district
governing boards have passed resolutions indicating that the districts concur with the
Tentative Plan.
Committee Chairman Dyer opened the Public Hearing at 7:10 p.m. to consider
adoption of a Tentative Plan as a Final Proposal for the transfer of territory between
the four school districts of Martinez Unified, Mt. Diablo Unified, Lafayette and
Acalanes Union High School Districts. He emphasized that this hearing was the first
part of one hearing; the second part of the hearing will be held on May 18, at
Martinez Unified School District Office; the third part of the hearing will be held on
May 19, at the County Office of Education located in the Mt. Diablo Unified School
District. Mr. Dyer asked attendees to speak once to the issue.
Gary Stevens, Pebble Beach Loop resident, speaking against the issue, stated that

he did not feel that the four District Boundary Study Committee had resolved the
concerns of the area residents regarding transportation and safety. The following
Withers Avenue residents spoke in favor of a petition they recently submitted to the
County Committee and asked that their area be included in the territory transfer and
that it be placed in the Lafayette and Acalanes Union High School Districts: Fred
Hoogland, Larry Fitzgerald, Walied Sarakbi. Reasons given for their request were that
the territory is in Lafayette' s sphere of influence, proximity to schools in the
Lafayette and Acalanes Union High School Districts.
Committee Chairman Dyer thanked the speakers and reminded them that the next
location for the Public Hearing would be the Martinez Unified School District Office
at 7:00 p.m. cn May 18. Mr. Dyer recessed the hearing at 7:32 p.m.

The Public Hearing to consider adoption of a Tentative Plan as a Final Proposal for
transfer of territory between the four school districts of Martinez Unified, Mt.
Diablo Unified, Lafayette and Acalanes Union High School Districts was reconvened at
7:00 p.m. Committee Chairman Dyer led -in the recitation of the Pledge of Allegiance.
John Hendrickson reviewed the background of the 'tentative Plan and reminded those
in attendance that this public hearing was a continuation fran May 12, at Acalanes
Union High School District Office, arra would be continued on May 19, at the County
Office of Education located in the Mt. Diablo Unified School District. on May 19, at
the close of the public hearing, the County Committee will decide whether to adopt the
Tentative Plan as the Final Plan. Mr.. Dyer asked those in,attendance to fill out
speaker cards and to speak to the issue once.
Larry Ribarich, chief petitioner, Walnut Hill Estates neighborhood, stated 'ghat,
although Pebble Beach Loop residents still felt that their sphere of influence was
with Lafayette, they would accept being placed in the Mt. Diablo Unified School
District rather than the Martinez Unified School District as called for in the
Tentative Plan. He cited safety of children and transportation problems as the main
reasons for this. Mr. Ribarich asked the Committee to reconsider the plan; if not, he
said that the residents would cane back to the Committee with another petition. Gary
Flowers, another Pebble Beach Loop resident, also asked the Committee to reconsider
their proposal. He pointed out that children in the area would be travelling further
to school if they had to attend Martinez schools.
Howard Barto, Martinez Unified School District Governing Board member, explained
that he was representing the district since fellow Governing Burd member James Laird
was hospitalized. Mr. Barto thanked the Committee for the work that had been done and

stated that he felt residents of areas newly assigned to the Martinez district will be
well served. Mr. Barto also said that solutions to the transportation issue will be
addressed and that the district has a liberal interdistrict transfer policy. He
welcomed all those caning into the Martinez Unified School District.
Cheryl Stevens, Pebble Beach Loop resident, spoke against the proposal, stating
that inclusion of the area in the Mt. Diablo Unified School District is more
acceptable to residents, that busing to Martinez Unified School District schools is
not financially feasible. In response to a question raised by Mrs. Stevens, John
Hendrickson stated that an accurate map of the Mt. Diablo and Martinez Unified School
District territory boundaries would be found at the County Assessor's Office.
Gary Stevens presented" a mailing he had -'received fran a local real estate agent
in which a copy of an article by- Terri Weintraub,. -Contra Costa Times reporter, was-
included. The article concerned the territory transfers under discussion and Mr.
Stevens stated that he thought that using this article was unethical on. the part of
the realtor.
James Bach, a Gloria Terrace area resident, spoke in favor of the proposed plan.
Committee member Wilma Burch asked for clarification on "grandfathering." In
response, Mr. Hendrickson stated that, although a statement of_ intent to support
"grandfathering" for -school age children is included in the Committee report, it does
not specify by school or program and it would not be a legally binding commitment on
future district governing boards.
Committee Chairman Dyer recessed the public hearing at 7:42 p.m.

The continuation of the public hearing of May 12 and May 18, to consider adoption
of a Tentative Plan as a Final Proposal for transfer of territory between the four
school districts of Martinez Unified, Mt. Diablo Unified, Lafayette and Acalanes Union
High School Districts, was called to order at 7:00 p.m. Committee Chairman Dyer led
in the recitation of the Pledge of Allegiance.
Mr. Dyer asked those wishing to speak to the issue to fill out speaker cards.
Since this is a continuing hearing, he said that everyone is entitled to speak once to

the issue. If new evidence is to be presented and if the Board feels that it is new
evidence, that evidence may be presented.
Mr. Hendrickson explained the purpose of the meeting. He said that the County
Committee had adopted a Tentative Plan to reorganize school district boundaries
affecting four school districts. The Tentative Plan, in accordance with state law,
was submitted to all four school districts prior to holding the public hearing, and
each of the four school districts had adopted resolutions concurring with the
Tentative Plan. Mr. Hendrickson stated that the County Committee is required to hold
public hearings in each district--affected by. the Tentative Plan. At the close of this
evening's public hearing, the County Committee is scheduled to take an action to
either approve or disapprove the Tentative Plan. Maps. of the affected areas and
copies of the Tentative Plan were made available to'-those in attendance.
Jack McAtee, speaking on behalf of GlorYa Terrace residents, stated that he was
in favor of the Tentative Plan and thanked the,study committee. He said that he felt
the Plan resolved most of the boundary problems in the area.
Dr. Derek Ramsley, Withers Avenue resident (area east of Taylor Boulevard that
was not -included in the study area) , asked-that the Gommittee consider putting this
area in the Acalanes school district, citing proximity to the schools in that
district.
John Kreiter, Brookwood Homeowners Association representative, stated that the
job the study committee had been given was a difficult one and that the
recammmendations made by the committee were very logical, taking into consideration the
natural boundaries, the continuity of school districts. He wholeheartedly recommended
acceptance of the Tentative Plan as the Final Plan.
Dina Halawa, co-chief petitioner of Brookwood area, asked the Committee to revise
the Tentative Plan to- include this Gloria Terrace/Withers area.
Liz Belcher, Farmhill Estates resident, said that she did not feel her area was
considered fairly in the study process. She cited longer distances from the Martinez
school district schools and-lack of area identification to Martinez as .her reasons for
being against the Tentative Plan.
Richard Wilmot, Withers Avenue resident, spoke against the plan, stating that
Acalanes school district schools were closer to his residence.
Jeff Leighton, Reliez Valley Road resident, thanked the dommmittee for tackling
this very difficult issue in a ccmprehensive manner. He said he believed the study
group considered the most important criterion in relating to the boundary problems and
did take neighborhood issues and concerns into account. Mr. Leighton said that it was
the most sensible plan ever to have been put forth. _
Dan Moy, another Reliez Valley Road resident, said that he had attended many of
the sessions on this issue and was in favor of the Tentative Plan.
Ralph Lopez, Mt. Diablo Unified School District representative, spoke to the
Gloria/Withers area petition. He said that, as a member of the study ccmmittee, he
believed that a considerable amount of time was spent by the committee to cane up with
logical boundaries. He suggested that the area east of Taylor Boulevard be a separate
issue and not be integrated in the plan that is before the County Committee.
Andrew Ariey, Reliez Valley Road resident, said that he had participated in a
similar action of territory transfer in the early 1960s. He commended and supported

the study group for their work and recommendations.
L. Wayne Poliuz, Davison Hones representative, discussed a planned development of
a 70 acre parcel of the Oakmont Cemetery and stated that it would be more logical that
this area be included in the Mt. Diablo Unified School District rather than the
Martinez Unified School District. He cited sphere of influence with Pleasant Hill and
proximity to the Mt. Diablo district schools.
In response to questions raised during the public hearing held in the Martinez
school district, Cheryl Stevens; Walnut Hills County Club Estates neighborhood - -
resident, addressed the "grandfather clause." She stated that, ideally, the present
residents in the Mt. Diablo School District would have future enrollment rights to the
district (that would include couples with no. children at the present time). She
quoted the Study Committee recommendations- on a "grandfather clause," which only
includes families with school age children. She• felt that the term "present
residents"would cover residents' concerns. Mrs. Stevens also said that there is one
family in the area whose children, including foster children, are already attending
Martinez school district schools. It is this family's wish to have their children,
including future children, attend Martinez schools under the "grandfather clause."
There being no further speaker cards or comments, Committee Dyer closed the
public hearing-at 7:33 p.m.' He thanked-all the 'speakers for their,comments.
John Hendrickson briefly explained the effect the upcoming vote of the County
Committee would 'have. If the Tentative Plan is approved as the Final Plan, the vote
tonight would be the final public action taken to effect the four territory transfers
proposed in the Tentative Plan. The next steps by staff would be to inform the Board
of Supervisors and, through them,—the County Assessor's and Elections Offices.. A
notice will also be filed with the State Board of Equalization with a payment of an
appropriate fee so that the state maps are reorganized and aligned with the action
taken. No other public actions would be necessary. Mr. Hendrickson further explained
that, in the event that the County Committee does not approve the Tentative Plan, the
Tentative Plan would then be denied and it would be the end of this study process.
Any modifications that the County Committee may' wish to make to the Tentative-Plan .
would have to be done in the form of adopting anew tentative plan, getting
concurrence from the school districts concerned and starting the process over again.
In response to a question raised by Mr. Grubel, Mr. Hendrickson said that any change
in the Tentative Plan would necessitate starting the process all again. As to
the "grandfather clause," Mr. Hendrickson said that the Tentative Plan includes a
statement of intent that all parties would recognize, but that does not necessarily
bind future governing -board members to follow the intent. He suggested it would be
unlikely that this provision would be violated. Mr. Hendrickson also suggested that
clarification of the statement to include future children of present residents would
be permissible.
Florence McAuley asked Ralph Lopez, Mt. Diablo Unified School District
representative, and Howard Barto, Martinez Unified School district, to comment on
their understanding of the "grandfather clause." Mr. Lopez said that he would have no
objection to changing the wording in the Tentative Plan to "present residents,"
instead of "families with school age children.". W. Barto said that he could not
recall whether this was discussed among Martinez Unified School District
representatives.
Committee Chairman Dyer asked Committee members to openly deliberate the issue so
that each member was clear on all aspects of the issue.
Mrs. McAuley stated that she had listened intently to all the residents of the

entire area and that several &6n-c—eriid--Yi6-d7b&en—raised that she would-like to address.
Concerning*transportation/safety issues, Mrs. McAuley said that there is busing for
Mt. Diablo unified School District students, grades K-6, living 1 1/4 miles from a
school and there is busing (pay as you go) for 7-12 living 7 miles from school. She
said that school district personnel have indicated that citizens can petition for a
bus if they don't meet the mileage criteria, but they must have 40 paying riders.
There is special education busing, but there is no regular busing to this area. I/xs.
McAuley said that..she reviewed safety information with which the study group had been
supplied; she said there were 381 accidents on the way to Mt. Diablo school district,
versus 112 accidents to Martinez school district. Another issue that has been raised
frequently was that of having a Lafayette address. Many people indicated that
realtors had advised them that they were--in a-certain school district.. Although
upsetting to the buyer, Mrs. McAuley said. that the responsibility to determine the
correct school district is up to the individual resident. Mrs. McAuley. closed her
comments by saying that she appreciated.w..- Leighton's remarks.
Ned Clyde said that he thought a great deal of, work had been done by the
Committee in studying this area. However, he thought it unfortunate that the
Committee did not include any members of the electorate. He felt that at least one or
two.residents from each area being considered should have been part of the Committee
so that the viewpoint of the electorate could have-been made known. MT. Clyde stated
that he felt there was an "I've- got mine" syndrome expressed by some of the speakers
in favor of the Tentative Plan. Mr. Clyde said he felt that Mt. Diablo school
district was giving up a lot of territory, but that an agreement was reached by the
school districts and the two members of the County Committee. There was no agreement
reached with the electorate. He said that the charge given to the County Committee by
the State Board of Education to resolve the concern's. of'the electorate in the matter
of these district boundaries has not been-accomplished. He suggested that more study
be put into the plan with the consideration of making the southern boundary of the
Martinez unified School District the southern boundary of the city of Martinez, and
that the northern boundary of the Acalanes Union High school District be at Grayson
Road.
Wilma Burch reminded Mr. Clyde that he was present.-when the study committee was
formed and that no mention was made of having the electorate as members of the
cammittee. She also said that the State Board turned the matter over to the County
Committee since members would know the area better than State Board members. Mrs.
Burch stated that she felt the study committee tried to do what was best for all the
children. She said it is not very often that four school districts can come together
and reach a decision.
Edward Grubel stated that he agreed almost 100% with the statements made by
Committee member Clyde. His other observations were that children get the best
education when parents are involved and pleased with where their children go to
school. He said that he believes children should goto school where their parents
want them to. Mr. Grubel also stated that people should choose how and where they are
represented, and who represents them. He said he has stated on several other
occasions that the bureaucracy of boundary changes issues relative to the County
Committee is one large boondoggle of bureaucracy, which he doesn't like. It takes
away the opportunity of people voicing how they wish to be governed. Mr. Grubel said
he disagreed with Mrs. Burch on the issue of having citizens on the study committee.
He said that not stating it then could never be considered as being an error at that
time. If, in hindsight, the electorate should have been included, then we should have
made some arrangements to include citizen participation. He referred to the "old
boys" network of school district administrators, the County Committee representatives,
and Board members from the affected districts who have arbitarily dished out how
students should get an education. Mr. Grubel said he thinks there were provincial

attitudes, protectionism of territory, and a great deal of social econanic
distribution going on that has nothing to do with how a child gets an education. Mr.
Grubel said he did not agree with the Tentative Plan, has never agreed with it, nor
will he ever agree with it. He said he agrees with schools of choice; parents should
have the opportunity to send their children to the schools they choose.
Sherry Johnson displayed the large amount of material that was received and
reviewed on this issue. She said that letters from area residents were taken into
consideration and, therefore, the electors were included in the decision making. Each
school district was asked to-provide data, and copies of the petitions were included
as were the concerns of all Committee members. Mrs. Johnson said she felt the State
Board-of Education's mandate -has-been fulfilled and that transportatien,__safety,_
neighborhood unity and impact .on school districts were taken .into .consideration. She
also said that she had contacted the County Connection bus service and learned that
there are no buses currently frau this area to any .school: districts. Mrs. .Johnson ,
stated that she felt a neighborhood should be served by one school district, enabling
children to be involved in school sports, school activities and school programs. _
Dan Dyer said that all the letters from area residents had been read and
considered. The Tentative Plan was developed over several months and the ground rules
were set when Mrs. McAuley was chairing the County Committee meeting last year. At
-that- 'time, all County Committee members were asked for their, help in establishing
ground rules. Mr. Dyer referred to Mr. Clyde' s attendance record at County Committee
meetings. Mr. Dyer said he feels all Committee members -are primarily interested in
what is best for the children of the area. He reminded Committee members that. the
County Committee is charged under law to establish school district organization to
best meet the educational needs of the entire county for the present and the future.
Mr. Dyer stated that this overriding responsibility to view the entire county and to
be prospective is the basis for his vote to support the Tentative Plan. He said that
this plan would be reviewed in the future and that possible changes could cane about.
It was moved by Mrs. McAuley, seconded by Mrs. Burch, to adopt the Tentative Plan
as the Final Proposal for transfer of territory between the four school districts of
Martinez Unified, Mt. Diablo Unified, Lafayette and Acalanes Unicn High School
Districts, with the inclusion of the grandfather clause arra a definition of this
clause.
ROLL CALL: Clyde, no; McAuley, aye; Burch, aye; Johnson, aye; Grubel, no; Dyer,
aye. Committee member Spears, absent. The motion carried 4-2.
Mrs. McAuley called W. Grubel's attention to a- special report to the Governor by
the California Economic Development Inc. which included an article on schools of
choice. A brief discussion on this subject followed.
Mr. Dyer apologized to Mr. Clyde for misstating the number of meetings he had
missed. Mr. Clyde stated that he would- have to check the record before he could
respond to the charge.
Chairman Dyer stated for the record that the approved Final Plan will go into
effect July 1, 1989.
CaMMITTEE AND STAFF REPORTS
Mrs. McAuley recommended that the County Committee consider setting up a meeting
to review the boundary line between Mt. Diablo and Martinez Unified School Districts.
This line is north of the area that was studied. After a brief discussion, it was
decided that this would be an action item on the next agenda.

WHEREAS, pursuant to Education Code Section 35700 (c) , a
majority of the members of the Governing Board of theDublin Joint
Unified School District , of Alameda and Contra Costa Counties ,
authorized and filed a petition for the reorganization of said District
by the transfer to the San Ramon Valley Unified School District of all
territory of the Dublin Joint Unified School District which lies within
the boundaries of Contra Costa County; and
WHEREAS, pursuant to Education Code Section 35700 (c) , the
Governing Board of the San Ramon Valley Unified School District
unanimously authorized" -and filed a petition for-the reorganization of
said District by the approval of the transfer to. said District of all
territory of the Dublin Joint Unified S6ho6l District which lies "within
the boundaries of Contra Costa County; and
WHEREAS, the Contra. Costa County Committee on School
District Organization and the Alameda County Committee on School
_ District Organization have_. held joint .public meet.ings, .duly noticed, in
accordance with Education Code Sections 35705 , 35705 . 5, and 3552.3 , on
August 17 , 1988 at ' the" San Ramon Valley' Unified School -District Office
and the Dublin Joint Unified School. District Office; - and
WHEREAS, descriptions of the petitions were made available
to .the public for ten days prior to said meetings, pursuant to
Education Code Section 35705 . 5 (b) :
THEREFORE. BE IT RESOLVED that, having afforded the public an
opportunity to comment on the petitions, the Contra Costa County
Committee on. School District Organization finds as follows:
A. The petitions are to transfer inhabited territory of
less than 5 percent of the assessed valuation of the
Dublin Joint Unified School District, from which it is
being transferred; and
B. All of the affected Governing Boards have agreed to the
transfer; and
C. The transfer will not affect the racial or. ethnic
integration of the two Districts; and
D. The reorganization is compatible with the master plans
submitted by said County Committees on School District
Organization and approved by the State Board of
Education; and
E . The petitions are not required to be transmitted to the
State Board of Education, nor do they require an
election to approve the petition; and be it further

RESOLVED, that the Contra Costa County School District
Organization Committee, approves the petitions of the; Dublin Joint
Unified school District and the San Ramon Valley Unified School
District to transfer all territory of the Dublin Joint Unified School
District which lies within the boundaries of Contra Costa County,
described in Exhibit A, incorporated by reference and attached hereto,
to the San Ramon Valley Unified School District; and hereby orders that
the petitions be granted; and be it further
RESOLVED that the Secretary of the Contra Costa County Board
of Education sitting as the County School District Organization
Committee is directed to notify the Contra Costa County Superintendent
of Schools and the Alameda County Superintendent of Schools, and the
Board -of 'Supervisors of Alameda and:"Co"ntra Costa Counties -of the
approval and granting of the petitions.
Passed and adopted by the Contra Costa County School
District Organization Committee at. a special meeting - public hearing
held on August 17, 1988 , and voted as follows:
