SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AM JUSTIFICATION
RECOMMENDATIONS:
1 . Approve the attached report from East Diablo Fire Protection
District Chief Paul Hein regarding the use of the water tank
at the Byron School by the fire district in case of a fire.
2. Direct the County Administrator and Purchasing Agent, prior
to transferring any major piece of fire district equipment
or declaring such, equipment surplus, to insure that the
appropriate Fire Commission has reviewed and approved the
transfer of the equipment or the declaration that the
equipment is , surplus and that this approval is evidenced by
the fact that the Commission' s minutes approving the
transfer or disposal of the equipment are attached to the
surplus equipment transfer documents.
3 . Remove as a referral to our Committee the July 19, 1988.
referral on this subject.
BACKGROUND:
Our Committee made a status report to the Board of Supervisors on
this subject November 1, 1988, at which time the Board directed
that several additional actions be taken by staff. The attached
reports were filed with our Committee on December 12, 1988. We
believe that Chief Hein' s report and the report from the County
Administrator' s Office successfully resolve the issues which were
raised regarding the Byron Fire Protection District and that this
item can now be removed as a referral to our Committee with the
approval of the above recommendations.

RECOMMENDATIONS:
1. Approve the attached report from Chief Paul Hein, East Diablo
Fire Protection District prepared in conjunction with Chief Nick
Papadakos, Byron Fire Protection District, regarding a water tank
on the Byron School grounds.
2. Approve the report of the County Administrator regarding
procedures for the disposal of surplus fire district equipment.
BACKGROUND/REASONS FOR RECOMMENDATIONS:
On November 1, 1988, the Board of Supervisors approved several
recommendations from your Committee regarding the Byron Fire
Protection District. Among those several issues were the two matters
discussed in the above recommendations.
The issue involving a water tank for fire fighting purposes at the
Byron School discussed in the report from Chief Hein is the result of
discussions about the need for a water supply on the school site. In
a previous report from Chief Hein, it was proposed that a 5, 000 gallon
tank be installed on the school grounds for fire fighting purposes.
The school currently has a 1, 400 gallon tank connected to its
pressurized well system that is available for fire fighting purposes.
Chief Hein and Chief Papadakos met with Ms. Hemilhock, Superintendent,
Byron School, to discuss the feasibility of installing a larger water
tank on the school grounds. The chiefs and Ms. Hemilhock agreed that
there was not a suitable location for the placement of an additional
water tank that would be accessible to fire vehicles. All the
locations that would provide access to fire trucks are currently used
for other purposes such as the playground and parking areas.
The current 1,400 gallon tank is accessible to fire vehicles and can
be used to augment the water supply of the various fire district
vehicles that would respond to a fire at the school.

The second recommendation dealing with the policy regarding the
disposal of surplus fire equipment stems from complaints about the
transfer of a 1966 water tanker from the Byron Fire Protection
District to the East Diablo Fire Protection District. Complainants
alleged that the transfer of the water truck was made without the
approval and knowledge of the Byron Fire Commission. Accordingly,
your Committee requested a report on this issue, including
recommendations to insure that fire commissions are aware of such
transfers.
The current procedure for the disposition of surplus fire district
equipment requires that the district disposing of such equipment
contact the other fire districts of the County to determine if the
surplus item can be used by some other district. Items not needed by
any other district are then disposed of through the Purchasing
Division of the General Services Department. The Purchasing Division
complies a list of all surplus equipment which is submitted to the
Board of Supervisors for authorization to dispose of the surplus
items.
The current surplus equipment disposal procedure does not require the
approval of the fire commissions. However, in most cases, equipment
has become surplus because of being replaced by new equipment. The
acquisition of new equipment through the budget process involves the
review and approval of the commissions. Accordingly, in approving the
acquisition of new equipment, the commissions indirectly approve the
disposal of the old equipment being replaced.
Since the transfer of the tanker from Byron to East Diablo was not the
result of the acquisition of a new vehicle, the Commission may not
have been involved in the transfer process.
Equipment transfers require the submittal of transfer authorization
request forms to the County Administrator for approval. In order to
assure that the fire commissions are involved in the disposition of
equipment, it is recommended that surplus equipment transfer documents
be accompanied by a copy of the fire commission' s minutes authorizing
the disposal of surplus equipment and that the County Administrator
verify that the fire commissioners are aware of the disposal of the
equipment.

On November 22, 1988, Chief Papadakos and myself met with
Mrs. Himelhoch, the Principal of the Byron School, to
discuss the possibility of placing a large water tank on
the campus of Byron School. The purpose of this tank
would be to have an on site water supply for fire
fighting.
After surveying the campus and looking at several options,
we felt that there is not a suitable location at the
school to place a tank. The tank would have to be located
in such a manner, that the fire fighting equipment could
make access to the tank. This would require placing the
tank in the front of the school and would take up play
ground space and/or the drive way space which is used by
the school busses for loading and unloading of students.
Neither of„the options were acceptable to Ms. Himelhoch.
A third option, would be to use the schools fourteen
hundred gallon pressure tank, which is located next to the
driveway, on the west side. of the campus. The location of
the existing tank is such, that an engine company could
park within twenty feet to take on water or supply lines
could be laid to the front of the school for fire
operations.This third option was quite acceptable to Ms.
Himelhoch.
My investigation into this matter has found that, by
changing the existing 1 1/2” valve to a 2 1/2" valve with
a fire district fitting on it at a cost of approximately
one hundred dollars the existing shortage of water supply
for fire fighting would be solved. I also recommend that
the automatic aid agreement between East Diablo Fire and
Byron fire should continue.
Ms. Himelhoch has indicated that she will be presenting
this proposal to the school board at their December
meeting.
