Activity 12-36 Senior Services Center, to the City of Antioch

RECOMMENDATIONS
Authorize the Chair to approve the transfer of CDBG activity 12-36
Senior Services Center to the City of Antioch as described below
and on the attached City of Antioch Resolution.

BACKGROUND/REASONS FOR RECOMMENDATIONS
On June 25, 1986, the East County Day Care Center, Inc. acquired a
4, 500 square foot building located on 1811 "C" Street, Antioch to
serve as a senior day care center for handicapped, frail, and
disadvantaged seniors. The project was approved by HUD and the
County under the terms and conditions of the CDBG program Project
Agreement dated April 1, 1986. The acquisition price of $211, 503
was augmented by $194,100 of CDBG funds. The East County Day Care
Center, Inc. is no longer in a position to manage the building and
coordinate the day care program and would like to transfer its
interests and obligations to the City of Antioch. The city will
take title to the. building and assure the operation and
continuation of the senior day care program. The city will assume
all the obligations .of East County Day Care Center, Inc.

RESOLUTION NO. 88/329
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANTIOCH
AGREEING TO ACQUIRE TITLE OF REAL PROPERTY SUBJECT
TO NEGATIVE EASEMENT OF DEVELOPMENT RIGHTS
EAST COUNTY SENIOR DAY CARE CENTER CORPORATION
1811 "C" STREET
WHEREAS, East County Day Care Center Corporation, a
California nonprofit corporation, is the owner of real
property commonly described as 1811 "C" street, Antioch,
California; and
WHEREAS, East County Day Care Center Corporation
uses the property to operate a senior day care center for
handicapped, frail and disadvantaged seniors; and
WHEREAS, the real property is subject to a negative
easement, in gross of development rights in favor of the
County of Contra Costa, State of California; and
WHEREAS, the City of Antioch, a municipal
corporation, is desirous of acquiring title to the property
subject to the negative easement in gross of development
rights of record; and
WHEREAS, the City of Antioch has authorized the
Antioch Human Resources Center Corporation, a California
nonprofit corporation, to provide a wide variety of human
services, including the operation and management of the
building serving as a senior day care center.
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of Antioch will maintain the "current proposed
use" of the facility as a senior day care center for
handicapped, frail and disadvantaged seniors.
BE IT FURTHER RESOLVED that in the event of any
change in nature of the "current proposed use" or sale or
disposition of said real property the City of Antioch will
first obtain the approval and consent of the County of Contra
Costa.
BE IT FURTHER RESOLVED that the City of Antioch will
take title to the property subject to the negative easement in
gross of development rights of record.
I HEREBY CERTIFY that the foregoing resolution was
passed and adopted by the City Council of the City of Antioch
at a regular meeting thereof, held on the 13th day of
December, 1988, by the following vote:
AYES: Council Members Price, Freitas, Stone, Rocha and
Mayor Keller.
NOES: None.

Transfer of Property to City of Antioch
Property Address: 1811 "C" Street, Antioch, CA
Greetings:
Since June 1986, East County Day Care Center
Corporation (ECDCCC) has owned and operated a senior day care
center for handicapped, frail and disadvantaged seniors,
located at 1811 "C" Street, in the City of Antioch. ECDCCC
has found it difficult to manage and maintain the facility
while operating the day care center.
ECDCCC submitted a proposal to the City of Antioch
providing for transfer of title of the property to the City of
Antioch in consideration for $1. 00. As part of the proposal ,
the City would create a human resource center and designate
Antioch Human Resources Center Corporation (AHRCC) , a
California non-profit corporation, to operate the facility.
ECDCCC will continue to occupy the property and operate the
senior day care center.
Pursuant to the attached Resolution, the City of
Antioch has agreed to take title to the property subject to
the negative easement of development rights of record in favor
of the County of Contra Costa. The City further resolved to
maintain the "current proposed use" of the facility as a
senior day care center for handicapped, frail and
disadvantaged seniors, and to obtain approval and consent of
the County on any change in the use or disposition of said
property.
