SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND
JUSTIFICATION
I. Recommended Action:
APPROVE Right of Way Contract and ACCEPT Temporary Construc-
tion Easement dated December 1, 1988 from Walnut Creek
Properties.
AUTHORIZE Chief Engineer to execute said Right of Way
Contract on behalf of the District.
APPROVE payment of $7, 350. 00 for said property rights and
AUTHORIZE the Auditor-Controller to issue a check in said
amount payable to Walnut Creek Properties to be forwarded to
the Real Property Division for delivery.
DIRECT the Real Property Division to have the above
referenced of Temporary Construction Easement recorded in the
office of the County Recorder.

II. Financial Impact:
Payment of $7,350.00 from Flood Control Zone 3B funds which
are 100% reimbursable from California Department of Water
Resources.
III. Background and Reasons for Recommendations:
These property rights are required for the San Ramon Creek
Bypass project in accordance with approved plans and specif-
ications.
IV. Consequences of Negative Action:
The project will not have sufficient land rights to allow
construction in accordance with the approved plans and
specifications.
