SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND
JUSTIFICATION
I. Recommended Action:
APPROVE Right of Way Contract and ACCEPT Temporary Construc-
tion Easement dated November 30, 1988, from Carl R.
Mattioda.
AUTHORIZE Chief Engineer to execute said Right of Way
Contract on behalf of the District.
APPROVE payment of $5,227. 17 for said property rights and
AUTHORIZE the Auditor-Controller to issue a check in said
amount payable to Carl R. Mattioda to be forwarded to the
Real Property Division for delivery.

II. Financial Impact:
Payment of $5,227.17 total from Flood Control District Zone
3B funds which are 100% reimbursable from California Depart-
ment of Water Resources.
III. Background and Reasons for Recommendations:
These property rights are required for the San Ramon Creek
Bypass project in accordance with approved plans and specif-
ications.
IV. Consequences of Negative Action:
The project will not have sufficient land rights to allow
construction in - accordance with the approved plans and
specifications.
