Rastegar, Kensington, for an investigation of a construction project that adds square footage to a commercial building at 291 Arlington Street, Kensington. On December 13,, 1988 , the Board received the report of County Counsel (copy attached) advising that staff requests additional time to review the proposed project to. determine compliance with procedures and due process applications, including the concerns expressed by Mr. Rastegar. He advised that staff would report their findings to the Board in early January 1989. The following persons commented with respect to stability of . the ground at the construction site and potential consequences to adjoining property; potential increase in traffic and parking problems in the area; and the length of time for a stop work order to remain in effect: . Arthur Cramer, 260 Amherst Avenue, Kensington; Sidney Rastegar, 272 Amherst Avenue, Kensington; Dr. Ben Stark, 113 Ardmore Road, Kensington; Philip Zimmerman, 149 Ardmore Road, Kensington; and V. Delar, address not given. All persons desiring to speak having been heard, IT IS BY THE BOARD ORDERED that the report of County Counsel is ACCEPTED and decision DEFERRED to January 17, 1989. Silver, Deputy County Counsel Re: proposed construction at 291 Arlington, Kensington On December, 6, 1988, at the direction of the Board of Supervisors, Bill Martindale of Building Inspection met with residents who own property in the immediate area of the proposed construction of "a three-story office building at 291 Arlington, Kensington. Karl Wandry of Community Development was also present. Deputy County Counsel Diana Silver sat in on the meeting. The issueswere fully discussed. A consensus was reached that Bill Martindale and Karl Wandry would investigate whether the project has been approved, whether a permit has been granted, and whether procedural due process requirements have been satisfied in the permit/approval process . In addition, the investigation will focus on the structural stability of a retaining wall and its effect on a neighboring house's foundation, the number of off-street parking spaces required for the proposed structure, whether a two-story rather than a three story structure would be appropriate (including setback requirements ) , and the extent of permissible access through an easement on a neighboring property. to the subject property. It was agreed at the meeting that Mr. Martindale and Mr. Wandry would report their findings on these matters in a report to the Board early in January, 1989 .
