HomeMy WebLinkAboutMINUTES - 11081988 - T.8 THE BOARD 7F SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA T. 8 Adopted this Order on November 8, 1988 by the following vote: AYES: Supervisors Fanden, McPeak, Torlakson and Schroder NOES: Non ABSENT: Sup rvisor Powers ABSTAIN: None SUBJECT: Hearing On Appeal Of Public Works Department On Development Plan 3080-87 In The Discovery Bay Area. This being the time heretofore noticed by the Clerk of the Board of Supervisors for hearing on the appeal by the Contra Costa County Public Works Department from the decision of the East County Regional Planning Commission on the request by the Hofmann Company ( applicants and owners) Cdr Final Development Plan #3080-87 for a proposed shopping center consisting of twelve acres located on the northwest corner of Discovery Bay Boulevard/Sane{ Point Road and the southwest corner of Discovery Bay Boulevard and Riverlake Road in the Discovery Bay Community east of Byron; and Jean Mesick, Community Development Department, presented the staff report on the appeal by the Public Works Department on the widening of Dtscovery Bay Boulevard, the Planning Commission' s decision not o include the requested additional four feet for a bicycle path in their final conditions, and she presented the Community Development Department recommendation that the Board uphold the East County Regional Planning Commission' s decision and approve the condition of approval for the forty foot right of way requirement. The public hearing was opened and the following persons appeared to speak: Michael Watford, Director, Public Works Department, commented on the additional four feet that they were requesting, the reasons for the request and the liability relative to approving a substandard road width. He co ented on a solution to the problem by removing the bicycle lanes and teed the bicycles onto the sidewalks to get them past this development. Rit Zuni a, 2035 Sandpoint Road, Byron, Vice-President of the Sand Bay Isle Homeowners, spoke on issues including screening and noise :Levels, requesting that the project be screened from their property by landscaping and screening. David Lenon; 1380 Galaxy Way, Concord, representing the Hofmann Company, commented on the proposed shopping center from a historical perspective, the reduction in square footage of the center, and the willingness of the Hofmann Company to install a separated bicycle path along the project frontage to fit in with the proposed development. He requested that the Board concur with the Planning Commission' s decision to approve this development with the road width as it currently stands. Supervisor Fanden requested clarification on the location of the bicycle path. Mr. Lennon responded that the location could be worked out with the Public Works Department, commenting on his opinion that the best proposal would be to locate the path along the project frontage of the shopping center, and the traffic study proposal that it go along the east side of Discovery Bay Boulevard. He commented on the Hofmann Company' s willingness to construct the path in whatever the appropriate l cation decided upon. ti Supervisor Torlakson requested County Counsel to clarify whether the issues oflandscaping and screening brought forth by the Sand Bay Isle Homeowne s were before the Board at this time or just the issue of the road width. Victor W�stman, County Counsel, responded to Supervisor Torlakson' s concern, commenting that historically the Board has construed the County Ordinance Code to mean that more that the specific item appealed by the appellant can be addressed. Mr. Lenn n addressed the landscape plan and the wrought iron fence proposed for the westerly boundary of the shopping center site. He offered to meet with the Sand Bay Isle Homeowners relative to the landscaping issue. Supervisor Torlakson indicated he wanted to visit the site. Michaelalford commented that a separate bicycle path if designated wo ld solve the problem if placed on the same side as the shopping center. Supervisor Fanden indicated that she was in support of the Planning Commission' s recommendation to deny the appeal by the Public Works Departm :nt. Supervis r Torlakson moved to close the public hearing and defer decision on the matter to the November 29, 1988 determination calendar and requested County Counsel to review the liability relative to the bicycle path and the applicant to give consideration to the location of the propos d bicycle path. IT IS BY THE BOARD ORDERED that the hearing on the above appeal is CLOSED; and decision on the matter is DEFERRED to the November 29, 1988 calendar; and the Public Works Department is REQUESTED to respond to the concerns raised today regarding screening and landscaping; and County Counsel is REQUESTED to respond to the issue of liability and the bicycle path.
