RECOMMENDATIONS
Deny appeal, upholding the Planning Commission and Zoning
Administrator denial of this request for a 0 foot setback for a
detached garage
BACKGROUND/REASONS FOR RECOMMENDATIONS
This request for a variance was submitted on January 5, 1988.
On
February 8, 198 we received two letters of opposition t
o the
request from nearby proPerty owners. The Zoning Administrator
after hearing tstimony de4ied the request on April 18, 1988. The
Planning Commission after 'hearing testimony denied the appeal on
June 28, 1988. The denial was appealed by the applicant on June
30,1988.

Mary Fleming, Community Development Department, described the request
for a varianc from the setback requirement for a detached garage.
She described the site location and the denial by the Zoning
Administrator and the County Planning Commission. She commented that
the applicant has modified his request to a ten foot setback rather
than his original request for a 0 foot setback and that this is the
first time they ten foot setback has been heard by a hearing body. Ms.
Fleming indicated that staff had not changed its recommendation
against grant ng the request.
The public he ring was opened and the following people appeared to
speak:
Lloyd P. Chasey, 15 Steding Court, Walnut Creek, spoke in support
of Mr. Cockrum's request before the Board today for the ten foot
setback, and commented on the neighbors expressing their interest or
lack of concern by signing over their easement rights so that there
is the ten foot setback;
Kurt Cockrum, 4 Steding Court, Walnut Creek, owner, commented on
. his reasons for wishing to build a three stall garage;
Joe R. Woodruff, 1620 N. Main Street, Walnut Creek, J.R.W.
Designs, architect for the proposal, commented on the three proposed
locations for�the garage as presented by the Community Development
Department and requested approval for the ten foot setback.
Supervisor Schroder commented on a memo from Alex Babbin
objecting to a 0 foot setback but with no comment on the ten foot
setback.
The public hearing was closed.

Supervisor Schroder moved approval of the request to establish a ten
foot setback for a new detached garage.
Therefore, IT IS BY THE BOARD ORDERED that the appeal by J.R.W.
Designs from the decision of the Contra Costa County Planning
Commission sitting as the Board of Appeals on the request by J.R.W.
Designs (applicant) and Kurtis and Laurie Cockrum (owners) is GRANTED;
and Application County File #1002-88 is APPROVED as modified for a ten
foot setback for a new detached car garage.

CONDITIONS OF APPROVAL FOR VARIANCE PERMIT #1002-88
1. Development shall be as shown on modified plans submitted to the County
Board of Supervisors.
2. The new gay-age and the existing exterior finish of the residence shall be
of similar syle and design.
3. The County Building Inspection Department requirement for a land survey
together with their building code regulations must be satisfied.
