HomeMy WebLinkAboutMINUTES - 11081988 - S.5 S � TN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA I In the Matter of .Supporting the ) Preservation and Rehabilitation ) Resolution No. 88/710 of the Port Costa School ) WHEREAS, the Port Costa School is the only public building in Port Costa; and WHEREAS, the Port Costa School is the only public building within the Carquinez Shoreline Regional Park project area; and WHEREAS, the Port Costa Conservation Society has, been concerned with the preservation of the Port Costa School; and WHEREAS, in an effort to preserve the Port Costa School the Port Costa! Conservation Society worked to have the school placed on the National Register of Historic Places; and WHEREAS, the Port Costa Conservation Society has agreed to purchase the Port Costa School pursuant to Section 39381 of the State Education Code which mandates that the school shall be used and maintained for public benefit as an historicaljresource and that the site shall otherwise be available for public access and use; and WHEREAS, the Port Costa Conservation Society is applying for rehabilitation funds for the Port Costa School from the History and Archeology Grant Program of the California Wildlife, Coastal and Park Land Conservation Act of 1988; NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of the County of Contra Costa, California supports the Port Costa Conservation Society in its efforts to preserve and rehabilitate the Port Costa School. Passed and adopted on November 8, 1988, by unanimous vote of the Board members present. Licensing at Sun Valley i SPECIFIC REQUEST(S) Ok RECOMMENDATION(S) & BACIasROUND AND JUSTIFICATION RECOMMENDATION: Board of Supervisors support the request for a waiver from the State Child Care Licensing Department for a Recreational Child Care program in Sun Valley Shopping Mall. Such a waiver should provide at least 35 sq. ft. per child of indoor space (as is now required by state law) but should not include the 75 sq. ft. of required outdoor space since this child care program is intended to serve parents who have children ages 3-10 and are shopping in Sun Valley. i BACKGROUND Attached is a letter describing the issue and problem. The state is insisting on 55 square feet totally, which is not economically feasible. The applicant has pursued negotiations (which have now broken down) in good faith in an attempt to open up this child care program during the holidayshopping period. The Board of Supervisors may want to consider emergency action given the meeting schedule during November. I� . What I intend to do is to open a drop in customer child care service at Sun,! Valley Mall. Briefly, let me list the program ingredients and services. We plan to rent 1, 100 square feet which allows us to care for 30 children at a time. We arrived at this number by using the State guidelines of 35 sq. ft. per child needed for indoor space. (We plan to follow all State guidelines in the creation of this indoor physical facility. ) The curriculumlof this program will serve children 3 through 10 years. We will provide daily crafts projects as well as' having the room divided into age appropriate interest areas. These areas will have building toys, cars, dolls, art and crafts, etc. There will be Nintendo and indoor Nerf basketball for older children. Each one of these areas will be supervised by a staff member. The staffing ratio will be 1 to 12. All staff will have at least 6 hours of early childhood education classes. Safety for children is a very important ingredient in any child care program. IIn light of this we have developed a thorough checks and balances service system. We feel these services not only protect the children but also give us the right not to follow regularilicensing guidelines. The services are as listed below: We provide each mother/father a beeper when she drops off her child. This allows us to contact her at all times. We also tell her when she leaves her child that she must stay in the mall. I , 2 - We take a photo of each child and the guardian so that the child will only be released to that person in the picture. Our physical design is such that an adult can see the entire room at all times. The point being that there is no place a child can be privately alone with an adult. We will have a 2-1/2 hour time limit per child. Our application form is extensive, with emergency numbers, insurance and doctor .numbers, and medical releases. Insurance coverage is a big issue in child care. I have found an independent insurance company, McDermott and Costa in San Leandro, that is willing to insure this program. Mr. John Johnson is Stay and Play's agent. From am insurance business point of view, he thinks this program is highly safe. As the owner of this Stay and Play project, I am highly qualified. (You already have my resume. ) Particular to the State's concerns, I have been licensed as a pre-school owner from 1972 to 1979 in San Francisco. I started, owned and operated and held my own State licence for the Wind In The Willows Early Learning Center. It is still in existence. In 1979 I turned the ownership of the school over to the parents in the community and moved to Orinda. Since 1982 I have been consulting in child care to both industry and schools. I have set up the entire latch day care programs for all the Orinda schools and have co-directed Sleepy Hollow's since its inception. There can be no doubt that I am qualified in both pre-school and elementary child care. My run around from State licensing has been unclear and unfair. Over an 18 month period of time the people I have spoken to have changed their minds unfairly. I need your help. The arguments between us are about these issues: Since I am recreational in nature, and the guardian is on the premises, I do not need to be licensed. At one point Licensing said that I had to be licensed but what they would do would be to add the combined indoor and outdoor square footage per child of 35 and 75 square feet, halve it, and require me to have 55 sq. ft. per child inside. This would make me licensable. This, too, is unreasonable because it would allow only 20 children and to break even I need 15. There is no profit to the business. What we are trying to do is create a new kind of child care. All of us shop, and with this service everyone has fun. The kids have a better time. Mom gets to relax. Shop owners do not have to pull 3 year 'olds out of store displays. We want to do something very simple and straight forward that's good for everybody. 3 There is no licensing category for what we want to do. It is unfair to shackle us with licensing regulations that are irrelevant to our program. In addition, the mall has leased us space in an area that will be demolished in 15 months. We are going into this space as an experiment. During these 15 months, we could work with the State to help create guidelines that will be relevant to these kinds of programs. These programs should be in malls, hotels and airports. They already exist in Canada and all over Europe. I hope to hear from you soon. Any help you can give me will be greatly appreciated.
