JUSTIFICATION
I. Recommended Action:
RESCIND Board Order dated July 14 , 1987 approving Right of
Way Contract and accepting Grant Deed from Alfred Bruzzone,
et al, in lieu thereof:
APPROVE revised Right of Way Contract and ACCEPT revised
Grant Deed from Alfred Bruzzone, et al.
AUTHORIZE Chief Engineer to execute said Right of Way
Contract on behalf of the District.
APPROVE payment of $36, 602 . 00 for said property rights and
AUTHORIZE the Auditor-Controller to issue a check in said
amount payable to Founders Title Company, Escrow No. 87231 ,
to be forwarded to the Real Property Division for del '

DIRECT the Real Property Division to have the above
referenced Grant Deed recorded in the office of the County
Recorder.
DIRECT the County Auditor/Controller to rescind their Check
No. G56068 dated July 17, 1987 in the amount of $22 ,742 . 00
which is to be returned by the Real Property Division upon
execution of this Board action.
II. Financial Impact:
Payment of $36, 602 . 00 from Contra Costa County Flood Control
and Water Conservation District Wildcat Creek project funds
which are 62% reimbursable from State Department of Water
Resources.
III. Reasons for Recommendations:
These property rights are required for the Wildcat Creek
flood control project in accordance with approved plans and
specifications.
IV. Background:
Additional property to be acquired due to project design
changes to accommodate park trail requirements.
V. Consequences of Negative Action:
The project will not have sufficient land rights to allow
construction in accordance with the approved plans and
specifications.
