SUBJECT: Hearing On Appeal Of Louis E. Lockrem From The San Ramon
Valley Regional Planning Commission Decision On LUP 2144-86
In The Bollinger Canyon/San Ramon Area.
This being the time set for hearing on the appeal of Louis E.
Lockrem from the San Ramon Valley Regional Planning Commission, acting
as the Board of Appeals, decision approving with conditions the
request of Mike and Lori Farr (applicants and owners) for a commercial
metal fabrication business as a home occupation (LUP 2144-86) , in the
Bollinger Canyon/San Ramon area; and
Karl Wandry, Community Development Department, presented a
history of the Land Use Permit application (LUP 2144-86) , the history
of Mr. Lockrem' s appeal and commented that the Planning Commission
recommended approval of the project with conditions and also commented
on the staff' s original recommendation for denial of the project due
to the applicant' s inability to meet the requirements of the
ordinance.
The public hearing was opened and the following people appeared
to, speak:
Charles M. Farr, 18311 Bollinger Canyon Road, San Ramon,
applicant/owner;
Michael H. Zischke, Miller, Starr & Regalia, 101 Ygnacio Valley
Road, Suite 401, Walnut Creek, attorney, representing Mike and Lori
Farr;
Lori Farr, 18311 Bollinger Canyon Road, San Ramon,
applicant/owner;
Louis E. Lockrem, Rt. 1 Box 110, Oakley, appellant;
The following people spoke against the appeal:
Ray Zaharis, 18869 Bollinger Canyon, San Ramon;
Roger Mast, 18885 Bollinger Canyon Road, San Ramon;
Michael J. Warholic, 18333 Bollinger Canyon Road, San Ramon;
John D. Meakin, 2222 Camino Ramon, San Ramon;
John Penna, 18275 Bolliner Canyon Road, San Ramon;
Adele Warholic, 18333 Bollinger Canyon Road, San Ramon;
Bruce Knight, 18475 Bollinger Canyon Road, San Ramon.
The applicant did not speak in rebuttal.
The public hearing was closed.
The Board discussed the matter with Supervisor Schroder
commenting that the issue today was whether the issuance of a home
occupation use permit was proper and legal for this parcel of land.
Supervisor Schroder also commented that there was a divergence between
the staff recommendation and the Planning Commission recommendation
and he would like time to confer with County Counsel about the
legality of the issue.
Supervisor Torlakson concurred with Supervisor Schroder' s
comments and commented on his own concerns including the setting of a
precedent.
Supervisor Fanden admonished the parties involved to try to
resolve their differences.
Therefore, on recommendation of Supervisor Schroder, IT IS BY THE
BOARD ORDERED that decision on the appeal of Louis E. Lockrem from the
San Ramon Valley Regional Planning Commission approving the Land Use
Permit application of Mike and Lori Farr (LUP 2144-86) for a
commercial metal fabrication business as a home occupation is DEFERRED
to the November 3, 1987 determination calendar.
