SUBJECT: Fire District Fee Schedules
The Board on September 22, 1987 fixed this date for
public hearing on amended fee schedule for day care and private
school inspection fees.
Terry McGraw, County Administrator' s Office, stated
that at the direction of the Board the Fire Districts had revised
the fee schedule for day care centers and schools to more closely
equate costs with actual inspection time. He advised that the
fee schedule presented today reflects that revision.
The Chair opened the public meeting and no one appeared
to speak. The meeting was closed.
IT IS BY THE BOARD ORDERED that the amended fee
schedules for day care and private school inspections for the
Contra Costa County, Riverview, Oakley, East Diablo, Byron and
Bethel Island Fire Protection Districts are APPROVED.

The Board of Supervisors of Contra Costa County, as and constituting the

THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on October 20, 1987 by the following vote:

SUBJECT: USS-POSCO Plant Modernization, reports from Community
Development, status of appeals and public comments on
additional information.
The Board on September 8, 1987 continued to this time the
following matters:
1. Consideration of public comments on additional
information on issues concerning USS-POSCO on hazardous waste to
hazardous materials management;
2. Consideration of report of the Community Development
Director on the USS-POSCO modernization project and the status of
appeals (dated March 20, 1987) of the Building and Construction Trades
Council of Contra Costa County;
3 . Hearing on appeal (dated April 15, 1987) of the Building
and Construction Trades Council of Contra Costa County of the decision
of the Building Inspector to issue building permits for the USS-POSCO
modernization project (continued from September 8, 1987) .
Harvey Bragdon, Director of Community Development, stated
that quite of bit of material has been submitted since the last time
this matter was before the Board and that he therefore could not
report today whether it contains new information, and suggested that
the hearings be concluded today and that he use the oral record plus
the written material submitted to develop the final report and
recommendation and that the matter be continued to the Board' s
November 3 , 1987 determination calendar for decision.
Supervisor Torlakson expressed his disappointment that a
decision could not be made at this time and requested staff to focus
on any new information during the testimony presented today.
Tom Adams, attorney representing the Building and
Construction Trades Council, discussed new case law that has come down
since the opening of this matter, talked about whether the material in
question is to be characterized as waste and how it is to be counted.
He used a slide presentation to illustrate the processing procedure in
question, and reviewed various material submitted in this matter.
Dr. Peter Russell elaborated on the definition of the
materials in question and on the processing procedures, whether the
material in question is to be characterized as waste, and how it is to
be counted.
Mr. Adams urged the Board to take action to keep the plant
going, but to make sure that it is regulated for the protection of
human health and the environment.
. Zane Gresham, of Morrison & Foerster, attorneys for
USS-POSCO Industries, objected to considering any material that was
submitted yesterday for consideration prior to todays' s hearing, which

he contended was long after the August 31 deadline proposed by the
Board and agreed to by Counsel. He suggested that the County' s
determination has been resolved, and referred to a letter from the
State Health Department saying the material is not a waste to be
regulated, and concluded that there is no new information that would
give the County the opportunity to reconsider.
Ken Alex, a member of the staff of John K. Van de Kamp,
Attorney General of the State of California, read a letter from the
Attorney General advising that until the Environmental Protection
Agency makes a determination, the Attorney General cannot offer
guidance, and expressing concern regarding the absence of a zoning
ordinance requiring a land use permit for projects in the County' s
industrial or H-1 zone.
James Wilson, 2191 Piedmont Way, Pittsburg, union leader,
complimented the expertise of the County' s staff, the need to protect
the environment for the public, and urged that a decision be made as
soon as possible.
David Nesmith, 6014 College Avenue, Oakland 94618,
Conservation Director of the Sierra Club, commented that the plant has
been placed under no particular regulation by the County, work is
progressing at the plant, and there appears to be an impasse; and
suggested that USS-POSCO' s entering into a performance contract with
the environmental defense fund would be a positive step. He urged the
Board to defer a vote on whether to reconsider its decision on the
appeal until the performance contract is arrived at and USS-POSCO has
said they are willing to look at this issue and willing to negotiate
this contract. He suggested the current ordinance has failed its
first test and urged the Board to ask the Hazardous Materials
Commission to work with Community Development to develop a land use
ordinance which is clearer, stronger, more enforceable and which will
not place the County in a situation where they have no control over
such a large project as. is now underway at USS-POSCO.
The Chair announced that Joe Lusby, 232 MacArthur Avenue,
Pittsburg, had indicated he did not wish to speak, but wanted his
remarks placed in the record.
There being no objection, the Chair declared the hearing
closed.
Supervisor Torlakson inquired of the the Director of
Community Development if any of the information presented was new
information.
Harvey Bragdon, Director of Community Development, advised
that he had not . had the opportunity to consult with Dan Bergman of
Environmental Health, but after talking to the County' s consultant and
County Counsel, it was the consensus that time would be needed to
review all material and present it to the Board in a final report on
November 3 , 1987 .
Supervisor Torlakson advised that he was prepared to act
today in that he had not heard any new information. He then commented
on the various information and suggestions presented to the Board.
Supervisor Powers recommended that staff be given the time
to review all the information on this matter, that it respond to the
suggestion for a performance contract, and that the ordinance be
referred to the Hazardous Materials Commission.
IT IS BY THE BOARD ORDERED that the recommendation of
Supervisor Powers is APPROVED, and decision is DEFERRED to November 3 ,
1987, and staff is requested to prepare a final report and
recommendation.

IT IS FURTHER ORDERED that Ordinance No. 86-100,
( land use permits for development projects involving hazardous waste
or material) is REFERRED to the Hazardous Materials Commission for
review and recommendation.
