THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on October 20 , 1987 by the following vote:

SUBJECT: Mt. Diablo Board of Directors Appointment
The Board received a letter dated October 13 , 1987 from
Jason Appel, M.D. , President, Board of Directors, Mt. Diablo
Hospital District, 2540 East Street, Concord 94520-1960, notifying
the Board that the Board of Directors of Mt. Diablo Hospital
District have not selected a replacement to fill the vacancy on the
Mt. Diablo Hospital District Board and that as a 'result, the
provisions of Government Code Sections 1780(b) and (c) become
operative.
The Board received the attached report dated October 15 ,
. 1987 from Victor J. Westman, County Counsel, advising that because
the Board of Directors of Mt. Diablo Hospital District did not
select a replacement to fill the vacancy or call an election in a
timely manner, the Board of Supervisors may, prior to November 12,
1987 , take action to either fill the vacancy or direct the District
to call an election. Mr. Westman noted that if the Board of
Supervisors does not take either action prior to November 12 , 1987,
State law mandates the District' s Board of Directors to call an
election to fill the vacancy.
Supervisor Robert Schroder stated that in order for the
Board of Supervisors to make an appointment to the Hospital Board
he felt it was important for the Board to have copies of all the
background material available on each of the candidates for the
position.
Supervisor Sunne McPeak advised that she had received a
letter from Harry F. Bowers, Member of the Mt. Diablo Hospital
District Board of Directors, transmitting background information on
the six candidates for the position that the Hospital Board had
determined to be finalists. She submitted the attached letter and
material for the record.
Jason Appel, M.D. , Mt. Diablo Hospital Medical Center,
2540 East Street, Concord 94520, urged the Board to select someone
to fill the vacancy. He stated that in his opinion to delay the
process by going to an election would stifle the Hospital' s
activities for months. Dr. Appel recommended that the replacement
be chosen from the candidates who have applied for the position
rather than expanding the search.
John Baie, Vice Present, Mt. Diablo Board of Directors,
1839 Silverwood Drive, Concord, expressed the opinion that all the
candidates were well qualified, and urged the Board of Supervisors
to appoint one of them.
Harry F. Bowers, Member of the Mt. Diablo Hospital Board
of Directors, 3330 Clayton Road, Concord, recommended that the
Board of Supervisors choose the replacement from among the three
candidates who received the most votes of the Hospital Directors.

Bill McManigal, 1657 American Beauty Drive, Concord,
expressed the belief that since the Hospital Board was unable to
agree on a replacement it would not be possible for any of the
candidates to work well with the current Board. He recommended
that the Board of Supervisors call an election so that the voters
could have a voice in the selection of the replacement.
Harry York, Concord Chamber of Commerce, 2151A Salvio
Street, Concord, urged the Board of Supervisors to make the
appointment from among those three candidates who had received the
most votes .of the Hospital Board.
The Board received and entered into the record letters
relative to the matter from the following persons:
Edward L. Nichols, 1306 Grove Way, Concord;
Michael J. Irigaray, 1839 Silverwood Drive, Concord;
John V. Capraro, 1242 New Hampshire Drive, Concord;
Evangeline J. Galli, 3642 Crenna Avenue, Concord; and
Laurence R. Soloman (no address given) .
Board members being in agreement, IT IS ORDERED that
decision on the appointment of a Director to the Mt. Diablo
Hospital District is 'DEFERRED to October 27, 1987 (Determination
Calendar) .

Re: Director vacancy, Mt. Diablo Hospital District
The Board of Supervisors has been advised that the Board of
Directors of the Mt. Diablo Hospital District has not in a timely
manner selected a replacement or called an election to fill the
current vacancy on that Board. The District' s staff has advised
that the Board of Directors ' vacancy was effective August 13, 1987
and that the 60th day on which the Board of Directors could have
taken action expired on October 12, 1987 . (Government Code
§ 1780 (b) . )
At this time, the Board of Supervisors may ( in the 30 day
period commencing on October 13 and ending on November 11, 1987 -
a Wednesday) take action to either fill the vacancy or order the
District to call an election for that purpose. If the Board of
Supervisors does not take either action prior to November 12 ,
1987, state law mandates the District' s Board of Directors to call
an election to fill the vacancy. (Govt .C. § 1780 (c) . )
A person can be appointed a 'hospital district director only
if that person is "a registered voter residing in the District" .
(H. & S. C. § 32100 . ) In the event the Board of Supervisors
determines to schedule interviews of candidates for appointment,
please be advised that such interviews must be conducted in open
session. (Govt. C. §§ 54950 et seq. )
Any person appointed to fill a vacancy would only serve until
the next District general election (November 1988 ) and thereafter
until the person elected at such election to fill the vacancy has
been qualified. (Govt.C. § 1780 (d) . ) If an election were called
by the Board of Supervisors or after November 11, 1987 by the
Board of Directors of the District, the person elected to fill the
vacancy would hold office for the unexpired balance of the 'term of
the office which ends in November of 1990 . The earliest date upon
which an ordered election can be held in the District is April 12 ,
1988 (Elec.C.§ 2500 )

decision on a new director , have now deferred that obligation
to you, the Board of Supervisors . Director of Mount
Diablo Hospital District , would strong] y recommend that you

We as aboard met and narrowed the twelve appiicano six
finalists. Of those six finalists, three received more votes
than the others. Two of the candidates each recei�ed *
unanimous vcte from the four existing directors to become a
finalist . Those candidates were Raymond "Hick^ Adler and
Lynn Tweedt . Paul Whalen received three votes. The
remaining three finalists each received t�n .otes. The�
er Schofield , Robert Leightnn and Graci-
f Ellis.
I would recommend that you look at the three top ca`.dida �es
since they received the mcst votes. Paul Whalen is an
outstanjing �usiness person, partial nwner of a local firm
and very capable of addressing the issues of our board of
directors. Lynn T�eedt is also a lncal business person, �wos
her own narketing and consulting firm, has dealt wi �h the
health care fieldd. would also be capabie of addressing
the issues of our hospital . Nick Adler has a masters degree
in nursing , and could also prsvide a different point of view
to the board .

It is unfortunate that we, as a board , were not able to come
� to a decision. Dr . Jason Appel and myself showed that we
were willing to compromise by accepting any of the top three
candidates, along with Mr . Schofield as a fourth candidate.
The other two board members were unwavering in their
position, and would only accept one of the other candidates.
I would urge you to make a decision as soon as possible. It
is necessary for our board to move forward in the decision
making process of running a very large hospital . For your
convenience, I am including the individual resumes of each of
the six finalists.

EXPERIENCE As a self-employed design consultant for
27 years, I have specialized in residential and
small office design and renovation.

HEALTH CARE
ISSUES Decreasing utilization , as expressed in occupancy
rates and growing overhead , is a major issue in
the health care field.
Inadequate Medicare and Medicaid compensation to
hospital and physicians, are a financial burden
that must be addressed.
Health care costs must remain affordable to
the community.
Patient care is the primary purpose of an acute-
care hospital , and the Board 's understanding of
the community's needs and a working relationship
with the Medical Staff are essential .
The hospital is one of the city's largest
employers deserving competence in its,
governance, and responsibility in expenditure of
funds.
STATEMENT
I have demonstrated my interest by attending
many meetings of the Mt. Diablo -Hospital Board ,
by running for the Board , and receiving over

I do understand the financial status of the Mt .
Diablo Hospital . I have reviewed the current and
past financial reports carefully., and I have
raised several significant issues both with the
Board of Directors and the Hospital Administra-
tor.

I am presently Marketing Director, Selway Productions. Selway
Productions is based in Lafayette, Ca., and we specialize in the production
of video programs used by our clients for in-house training and
communications. We also produce material used by our clients in their
sales and marketing efforts. Among our clients are: C & H Sugar, Safeway
Stores, Inc., Saint Mary's College, University of San Francisco, Systron
Donner Corp., Hewlett Packard, Bank of Walnut Creek, Cities of Alameda,

Further, I have extensive experience in the insurance industry as a claims
specialist at the litigation level. My experience includes personal injury

attorneys seeking advise on the administration of personal injury cases.

Community Involvement
As News Director, KKIS/KDFM, our public service and community
Involvement went much beyond that which was required by regulation.
Weekly panel discussions among community leaders were a regular part of
our programming. Our news department established an intern program so
that students with broadcast related majors might obtain practical
experience in their local market prior to graduation.
In May, 1987, 1 was appointed by the Concord City Council to the City
Board of Appeals for a four year term. Appellants are typically seeking
modification or reversal of Public Works decisions related to building code
variations.
Knowledge 4f Healthcare Issues
Obviously the length of this application is not adequate to contain a full
discussion of the health care issues facing the district. However such a
discussion would certainly include my personal experience with the health
care industry in connection with the proper diagnosis and treatment of my
son's learning disabilities. It was our pediatrician who observed my son's
apparent lack of concentration during the physical exam coincident with
his first birthday. That began a seemingly endless round of appointments
and exams of all types that two years later culminated in my local
community hospital playing the largest role in ascertaining the problem
accurately.
Beyond that, such a discussion would also include the aging of America.
With the median age increasing, tremendous strain upon the health care
delivery system may be anticipated and if quality care is to be delivered
the issue must be address now.
With the ever-increasing sophistication of medical equipment, and the
equally sophisticated price tags, questions about the hospital's ability to
compete will be considered with increasing frequency. It's become
apparent that "nitch" marketing has been effective in areas connected to
female care centers, urgent care, substance abuse programs, eating
disorders, pain clinics and heart-lung centers.
Further, a growing number of people are medically under and non-insured.
Hospitals certainly have a responsibility to address this issue and develop
a policy that can be clearly presented to the community through access to
the media.
