AYES: Supervisors Powers, Fanden, Schroder, and McPeak

SUBJECT: Hearing on Appeal of R. Charles Husted, Jr. on the
Decision of the Board of Appeals on the Application of
Charles R. Bradbury for MS 85-85 in the Walnut Creek Area.
The Board of Supervisors on September 15, 1987 continued to
October 6, 1987 at 3:00 p.m. the hearing on the appeal of R. Charles
Husted, Jr. from the Board of Appeals approval with revised conditions
on the application filed by. Charles R. Bradbury (applicant) requesting
approval to divide a one acre parcel into two lots with variances on
lot sizes and setbacks (MS 85-85) in the Walnut Creek area; and
Mary Fleming, Community Development Department, presented the
project and described the site location, the Planning Commission
recommendation, and presented a brief history of the appeal.
The public hearing was opened, and the following people appeared
to speak:
Charles R. Bradbury, 32 Winfield Lane, Walnut Creek, applicant;
Mark Bradbury, 404 Warren Street, Martinez, representing the-
applicant, presented photos and requested clarification on conditions
of approval relative to the structure being placed below the 120'
elevation and drainage into the roadside ditch. He commented he had
not seen the revised conditions and presented petitions and- letters of
support for the project;
Chuck Husted, 110 Kirkel, Walnut Creek, appellant, commented on
the basis for the appeal being the requirement of variances and the
grant of special privilege, and inconsistencies in the staff recommen-
dations;
Dan Wesley, 1701 Countrywood Court, Walnut Creek, spoke against
the appeal;
Paul Rizzo, 10 Winfield. Lane, Walnut Creek, spoke on variances,
drainage problems on Winfield Lane and requested the Board to deny the
project;
David A. Smith, 2232A Camino Ramon, San Ramon, architect, spoke
in favor of the project;
Richard Bowles, 2121 N. California Boulevard #875, Walnut Creek,
submitted a card, but declined to speak;
Jim Higgins, Engineer;
Mark Bradbury spoke in rebuttal.
The public hearing was closed.

Supervisor Schroder commented that he did not see a granting of
special privilege but wished concerns on drainage, storm drains and
the 120 ' elevation addressed and recommended deferring decision for
one week with matter to be placed on the determination calendar.
Therefore, IT IS BY THE BOARD ORDERD that decision on the appeal
of R. Charles Husted, Jr. from the Board of Appeals approval with
revised conditions on the application filed by Charles R. Bradbury,
requesting approval to divide a one' acre parcel into two lots with
variances on lot sizes and setbacks (MS 85-85) , is DEFERRED to October
13, 1987 on the determination calendar.
