• THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on October 13, 1987_by the following vote:
AYES: Supervisors Powers, Fanden, and Schroder
NOES: Supervisors Torlakson and McPeak
ABSENT: None
ABSTAIN: None
SUBJECT: Appeal of the City of Martinez from Approval with
Conditions of the Application for the Hidden Pond Project
Consisting of Final Development Plan 3008-87 and Tentative
Subdivision Map 6769, in the Martinez area.
On October 6, 1987, the Board deferred to this date the decision
on the appeal by the City of Martinez (appellant) from the County
Planning Commission approval with conditions of 'the applications by
Sycamore Construction Company (applicant) and Walter & Huer (owners)
for the Hidden Pond' Project consisting of Final Development Plan
3008-87 and Tentative Subdivision Map 6769 in the Martinez area.
Karl Wandry, Community Development Department, presented staff
responses to issues and concerns raised on 'October 6, 1987, referring
to the recommendations contained in the October 13, 1987 material
before the Board. Mr. Wandry commented on meetings with concerned
parties and the results that have been accomplished. He commented on
the staff recommendation of approval of the project, the final
development plan and the subdivision for Hidden Pond, modifying the
conditions to incorporate all the agreements reached and the
recommendations by staff.
Supervisor Torlakson requested clarification on visual
mitigations and whether they were acceptable to the residents of
Pleasant Hill 'on -the Reliz Valley Road area.
Mr. Wandry responded that the project could not be hidden short
of denying the project and leaving the hill pristine.
The Board discussed the concerns relative to Reliz Valley Road.
Supervisor Fanden .gave a brief history of the various.
developments in the Reliz. Valley Road area and commented on her
concerns with Donnegal Way and Francis Drive. She requested further
clarification from Michael Walford, Director of Public Works, on the
traffic concerns.
Mr. Walford responded to Supervisor Fanden' s concerns on the
intersections of Reliz Valley Road and Hidden Pond Road and Reliz
Valley Road and Donnegal Way, commenting that the applicant should be
required to provide left turn channelization at both intersections.
Karl Wandry, Community Development, agreed to support that change
in conditions and recommended an assessment district as the way to
finance these changes rather than this project. He explained that
perhaps it could be the responsibility of the project but funded
through an assessment district being proposed for Hidden Pond Road and
that absent the assessment district the applicant would be responsible
for the improvements.
Victor Westman, County Counsel, recommended the Board allow the
developer' s attorney to speak on the proposed road condtions.
Supervisor Fanden requested clarification of the understanding of
the road conditions from the applicant' s attorney.
The applicant' s attorney responded to Mrs. Fanden' request and
commented on the applicant' s understanding of the conditions.
Supervisor Fanden moved to approve the subdivision as outlined by
staff with modified conditions.
Karl Wandry inquired if the motion was to approve the project,
the final development plan on the subdivision, subject to the original
conditions recommended by the Planning Commission (as modified by the
agreements before the Board) and the conditions related to that, with
some lessening to be worked out by Public Works and Community
Development in terms of the impact for road widening and the
intersection reconstruction, and the rest of the memo from Public
Works would stand as conditions also. He commented that Community
Development Department would combine all those matters into a written
document for the Board' s consideration at the next meeting.
Supervisor McPeak clarified the motion to be to declare intent to
approve the project subject to the conditions as Mr. Wandry had
reviewed them to be submitted in writing for the Board's consideration
on October 20, 1987.
Supervisor Torlakson commented that he could not support the
motion, expressing concerns with the grading and visual impacts. He
commented that he would like a hillside ordinance developed in the
future to provide guidance in situations like this.
The Board discussed the matter.
Supervisor Schroder commented he could not support the motion
because he felt the recommendations were punitive and he was not
satisfied with them.
The vote on the motion was as follows:
AYES: Supervisors Powers and Fanden
NOES: Supervisors Schroder, Torlakson and McPeak
ABSENT: None
ABSTAIN: None
The motion failed.
Supervisor Powers moved to declare intent to carry out the
actions as recommended by the staff and that the specific conditions
as were verbally modified be brought back for Board consideration and
approval.
Supervisor McPeak requested clarification if the motion to
declare intent included the certification of the Environmental Impact
Report, denial of the appeal and approval of the subdivision before
the Board.
Supervisor Powers agreed with the clarification.
Therefore, IT IS BY THE BOARD ORDERED that the Board of
Supervisors hereby DECLARES ITS INTENT to deny the appeal of the City
of Martinez and approve the applications by Sycamore Construction
Company and Walter & Huer for the Hidden Pond Project, Final
Development Plan 3008-87 and Tentative Subdivision Map 6769 with
amended conditions; and the Community Development Department is
DIRECTED to prepare the appropriate documents for the Board' s
consideration on the October 20, 1987 determination calendar.
