HomeMy WebLinkAboutMINUTES - 10131987 - T.10 .t T.10 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on October 13, 1987 by the following vote: AYES: NOES: two motions - see votes below ABSENT: ABSTAIN: SUBJECT: Hearing on the proposed Kirker Pass Waste Management Landfill, Sid Corrie, Jr. , dba Land Waste Management (applicant) and Tom Gentry California Company, et al (owners) . The Board on September 22, 1987 continued to this date its decision on the following: 111. Proposed General Plan Amendment for the Kirker Pass Waste Management Landfill site as recommended by the County Planning Commission, said site consisting of approximately 480 acres generally described as the southwest, southeast and northeast quarters of Section 36, T2N, R1W, MDBM, adjoining Kirker Pass Road between the cities of Concord and Pittsburg; approximately 90 acres to be used for the landfill, about 230 acres for road, visual buffering and other appurtenances, and the residual to remain open space. 112. Proposed cancellation of Agricultural Preserve Contract No. 3-75 which would facilitate rezoning and allow the landfill Land Use Permit to be considered for approval. 113. Rezoning Application 2683-RZ for the Kirker Pass Waste Management Landfill site from A-4 to A-3 to enable the sanitary landfill to be established by a special Land Use Permit. 114. Application for Land Use Permit No. 2079-86. 115. Proposed amendment to the County Solid Waste Management Plan. "In connection with the above, the Board will consider concurring with the County Planning Commission' s certification of the project's Environmental Impact Report as being adequate. " Chairman McPeak noted that both she and Supervisor Fanden had earlier this day submitted and referred to staff for review and recommendation at this time a list of certain conditions which they wished to be considered as conditions of approval for all land use permits for sanitary landfill sites in the County, which included such items as resource recovery, County oversight of development and operations, County control of disposal rates, establishment of management fees, County roles in public and private coordination, wastestream assignment, public education, abandoned vehicle storage, litter control, host community mitigation, and household hazardous waste disposal and the establishment of a Recycling Director for the County. Supervisor Fanden declared that she wanted it understood that there would be a voluntary commitment from anyone involved with the issue that there be a mechanism in place to fund a recycling director. Board members discussed the process by which they might consider the above conditions in conjunction with the applications before them at this time. It was determined that it would be necessary to reopen the hearings' on the land use permit application portion only and- defer decision on the other items until after that reopened hearing. The Board determined it desired to have a written report from staff discussing the various proposed conditions prior to reopening the public hearings. Supervisor Torlakson moved to deny all the entitlement items before the Board related to this matter. Supervisor McPeak seconded the motion and it was defeated by the following vote: Ayes: Supervisors Torlakson and McPeak Noes: Supervisors Powers, Fanden and Schroder As recommended by Supervisor Powers, IT IS BY THE BOARD ORDERED THAT Decision on the hearing which had been continued to this date is DEFERRED to October 27, 1987 at 4:00 p.m. (Supervisor -Torlakson voted no. ) ITIS FURTHER ORDERED THAT October 27, 1987 at 4:00 p.m. is FIXED for re-opening the public hearing on the Land Use Permit application (LUP 2079-86) for the Kirker Pass Waste Management Landfill Project for the limited purpose of taking testimony and considering policies and conditions of approval which include resource recovery, County oversight of development and operations, County control of disposal rates, establishment of management fees, County roles in public and private coordination, wastestream assignment, public education, abandoned vehicle storage, litter control,. host community mitigation, and household hazardous waste disposal; and the Clerk is DIRECTED to give notice of this re-opened hearing in the usual manner. (.Supervisor Torlakson voted no. ) IT IS FURTHER ORDERED THAT Staff review the lists of conditions submitted by Supervisors McPeak and Fanden, and prepare a written report on same for the Board's consideration on October 27, 1987.
