SUBJECT: APPROVING CONSULTING SERVICES AGREEMENT FOR ARCHITECTURAL
SERVICES FOR REMODELING AT -45 CIVIC AVENUE, PITTSBURG

I. RECOWMNDED ACTION
A. APPROVE a . consulting services agreement with John Friedman,
Architect, 1529 Cypress Street, Suite 104,'. Walnut Creek,
for architectural services. ' for Remodeling . at 45 Civic,
Avenue•, Pittsburg, for.-Delta Municipal Court. . .
B. AUTHORIZE the Director of General. -Services to execute the
agreement- and to issue written authorizations' for extra
work, provided that the cumulative -total extra cost for .all
such authorizations shall not exceed $25,000.00. The
agreement, will be effective September 29, . 1987 and will. .
provide for full architectural ' services, with a payment
limit - for basic services of $70';475.00, which amount shall
not be exceeded without prior, written authorization by the
Director of- General Services.
II. FINANCIAL IMPACT. ;
Funds in the capital account established for : the project are
sufficient - to cover the.- amount -encumbered by . this agreement.
III. REASONS FOR RECONKENDATIONS/BACKGROUND.
A. On' 'January -30, 1987, . the County : Architectural Selection
Committee interviewed architects for various projects and
ranked Friedman/Osajima first for .the subject project.
B. Subsequently; Friedman/Osajima was retained ' to prepare a
master• plan for remodeling .45 . Civic Avenue for the Delta
Municipal Court. The master plan - was completed and
approved- by -,the County Administrator and. Delta Municipal
Court:
C. The, approved master plan recommends a phased remodeling
program which will, ultimately; replace th'e - existing
crowded, inadequate and obsolete conditions -with adequate,
efficient accommodations for current needs.

III. REASONS FOR RECOME NDATIONS/BACKGROUND. (Continued)
D: Approval of this agreement will provide full architectural
services necessary to accomplish the first phase of the
remodeling recommended in the master plan. This first
phase includes construction of a courtroom and expanded
office space for the clerk administrator functions.
Currently, the Traffic Commissioner is using a conference
room as a courtroom; the court administrator does not have
enough staff to support the existing case load and there
is no space -available to accommodate more staff. The first
phase construction will occur in space which will be
vacated within the next six months by the Social Service
Department. Consequently, this first phase of remodeling
will not cause significant disruptions in the court
operations.
E. The full architectural services covered in this agreement
include ' schematic design, design development, construction
documents, bidding and construction support services.
F. The County must proceed with this consulting services
agreement for architectural services because it does not
have sufficient staff to provide the required services.

SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. Take • -final action to adopt the boundaries of the Briones'
Hills Agricultural Preservation Areas including the minor
modification recommended by the . Contra Costa County General
Plan Congress (for the removal of the 16-acre Hallisey prop-
erty) as shown on Map 1.
2. Refer this Briones Hills Agricultural Preservation Area res-
olution (previously adopted) and the final boundaries to the
cities of Martinez, Pleasant Hill, Lafayette, Orinda,
Richmond, San Pablo, Pinole and Hercules for their adoption.
3. Authorize Supervisors Fanden and Powers to arrange a signing
ceremony with the affected cities which would publicize this
agreement. Authorize the Chairperson of the Board to sign a
joint version of this resolution that would also be signed
by the affected cities.
4. Upon adoption by the participating cities, refer this matter
to LAFCO for its acknowledgement and to affected service
providing agencies.
FINANCIAL IMPACT
The major staff cost to develop this proposal and to coordinate
with the cities has already been expended;- remaining costs will
be for coordination with the cities on their adoption of the res-
olution...and publicization of the agreement.

BACKGROUND/JUSTIFICATION BACKGROUND/JUSTIFICATION
At the conclusion of the August 4, 1987, public hearing on this
subject, the Board approved the Briones Hills Agricultural Pres-
ervation Area in concept. As part of that action, the Board .
referred two separate parcels of land to the Contra Costa County
General Plan Congress for a recommendation -on whether they should
be deleted from the boundaries of the Briones Hills Agricultural
Preservation area: They were the 167acre Hallisey-and 240-acre
Spenser Trust requests. .
The Jobs-Housing Subcommittee considered these requests on August
20, 1987, and the full Congress considered the matter on October
1, 1987. At both the subcommittee and the Congress meetings, the
public was allowed time to present their views on these refer-
rals.
The actions of the Planning Congress concurred with the findings
of the Jobs-Housing Subcommittee in Position Paper No. 6 (Attach-
ment A) . The specific rationales for the actions taken by the
Congress are identified in that report. It can be stated in
summary fashion that the Congress felt that the Hallisey property
should be deleted from the Briones Hills Agricultural Preserva-
tion Area because it might be a logical area to consider for
future growth. The motion to recommend this change was approved
with only one negative vote. The Spenser Trust request was
recommended to remain within the preservation area since its
removal could jeopardize the philosophy of the preservation area
and the joint city-county cooperative basis of the project. The
recommendation to have the Spenser Trust property within the
preservation area was approved with only four negative votes.
With the receipt of this referral back from the Planning
Congress, it is now appropriate for the Board to consider final
adoption of the boundaries and .to refer the program out to the
cities for their action.
Should the cities concur with this approach, a signing ceremony
might be arranged. The Chairperson of the Board should be
authorized to sign a joint version of this resolution with the
affected cities. If the program proceeds to that point, Supervi-
.. . . sors -Fanden and Powers., in concert with the Community Development
Department staff, should be authorized to,::. arrange a signing
ceremony.

BRIONES HILLS STUDY
Background
The Briones Hills Study was referred to the General Plan Congress for a
presentation by the Board of Supervisors for its September 23, 1987 meeting.
On August 4, 1985 the Board of Supervisors adopted the Briones Hills Agri-
cultural Preservation Area. They adopted the proposed concept and generally
approved the boundaries. . However, they withheld final action on two
properties which had requested to be excluded from the' ' agricultural preser-
vation area and referred those two properties to the General Plan Congress
for a recommendation prior to Board finalization of the boundary. Since-this
is basically a land use plan issue, it was referred by staff to the jobs/
housing sub-committee for recommendation to the full Congress. Represen-
tatives of the property. owners were invited. to make presentations -to the
committees when they considered this item on August. 20,. 1987.
As a reminder the Briones Hills Agricultural Preservation Area concept was
developed by a committee of representatives of eight cities and the County.
Its purpose is to develop a "political compact" on protecting the existing
nature of this 62 square mile area between west and central county. That
process began before the General Plan Congress was operational .
The two requests for exclusion and the sub-committee recommendations on each
are discussed individually below:
The Hallisay Request .
The Hallisay family has requested about 16 acres of their 260 acre land
holding be taken out of the -Briones Hills Agricultural Preservation Area.
The parcel is located directly across from the Franklin Canyon Golf Course
which has been approved for development by the City of Hercules. It is
bounded by State Route 4 and the Santa Fe railroad tracts and is largely
level land. The reason the land was placed within the proposal was that
there is currently a Williamson Act contract on the property. The Hallisay
family felt the railroad track made a better boundary than the original
proposal . The sub-committee approved the following findings.
Recommendation:
The Jobs/Housing Sub-committee recommends to ' the General Plan Congress
that the Hallisay request for exclusion from the Briones Hills Agri-
cultural Preservation .Area be approved based on the following findings:
. (1) The property is- located along major highway and directly across
from the current:Franklin Canyon Golf Course that has been approved
for development by the City of Hercules and would therefore be
consistent with future uses in the area.
(2) The property is sandwiched .bef een State Route 4 and the Santa Fe
ra.ilroad' and is bordered on the eastern side by light industrial
area creating -a small peninsula of land not significantly connected
to the remainder of- the agricultural preserve.
The Spencer Trust Property
A second request for- deletion from the Briones Hills Agricultural Preser-
vation Area is for- the 270 acre Spencer Trust- property adjacent to Crockett.
The site has -very- rugged portions- and currently has -very limited access. The
staff recommendation to the Board of Supervisors .was not to amend the
boundaries to delete this property.
Merle Gilliland gave a.presentation on the Spencer' Trust property based on a
set of maps. He said this was an open space rather than an agricultural
issue. He felt if. this parcel was included it would eliminate the potential
for future growth.. He felt the Crockett area maybe needing more growth and
that for all other communities they had an area to grow around them, but in
Crockett -the proposal was immediately adjacent - to existing development.
'There is an EBMUD tank right next to the site and they were discussing the
issue-with the sewer district. He stated they had'an option on the property.
He felt over 50% of the site was not buildable.
The subcommittee spent a considerable amount of time discussing this request
and on an 8 to 4 vote took the following action.
Recommendation
The Jobs/Housing Sub-committee recommends to the -General Plan Congress that
the Spencer Trust property request for exclusion from the Briones Hills
Agricultural Preservation Area be denied based on the following findings:.
(1) That the amount of area involved is a significant' portion of the
preservation area and that its approval could jeopardize the entire
philosophy of preservation and the joint city-county cooperative
basis of that approval .
(2) The property involved is unimproved property which is not crossed
or adjacent to major transportation routes or sanitation networks
thereby imposing substantial burdens on the infrastructure.
