NOES: None. ABSENT: None. ABSTAIN: None SUBJECT: Determination of Property Tax ) Exchange for Lone Tree Corridor ) 87-1 Boundary Reorganization ) RESOLUTION NO. 87/ 620 (LAFC 87-43) ) WHEREAS, Section 99 of the Revenue and Taxation Code provides that a City and a County involved in a jurisdictional change shall agree by resolution to exchange property tax revenues among themselves and any other affected agencies; and WHEREAS, the Lone Tree Corridor 87-1 Boundary Reorganization (LAFC 87-43) involves annexation of territory to the City of Antioch and to Contra Costa Sanitation District No. 7-A (CCSD No. 7-A) for which property tax exchange is determined by the previously approved master property tax exchange agreements; and WHEREAS, the reorganization may be amended to include concurrent annexation of a- portion of the affected territory of the reorganization to Riverview Fire Protection District (RFPD) and detachment of said portion of the affected territory from East Diablo Fire Protection District (EDFPD) which would involve a transfer of property- tax; and WHEREAS, the reorganization may be further amended to include concurrent annexation of a portion of the affected territory of the reorganization to Contra Costa Water District (CCWD) which would result in the district providing services in an area where such services have not previously been provided and where Section 99. 1 of the Revenue and Taxation Code provides for the annexing agency to negotiate for a portion of the growth property tax in the affected territory; , however, CCWD has agreed that it will request no property tax transfer as a result of this reorganization; NOW, THEREFORE, BE IT RESOLVED THAT THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY HEREBY DETERMINES that property tax will be transferred to the City of Antioch in accordance with the existing City/County master agreement and that no property tax will be transferred to CCSD No. 7-A as a result of this reorganization. If the reorganization is amended as discussed above, 100 percent of the property tax accruing to EDFPD from the portion of the amended territory that affects fire district jurisdiction shall be transferred to RFPD and no property tax will be transferred to CCWD. The property tax transfer agreements specified in this resolution shall apply for the fiscal year for which the State Board of Equalization makes the tax rate area changes for this jurisdictional change. The terms of the property tax transfers shall apply in subsequent years unless changed by the mutual agreement of the affected agencies or subsequent jurisdictional changes. This resolution does not change the property tax revenue accruing to other agencies servicing the subject territory or the affected agencies' right to collect taxes for existing bonded indebtedness.
