HomeMy WebLinkAboutMINUTES - 10061987 - S.3 ' S.3 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on October 6, 1987 by the following vote: AYES: Supervisors Powers, Fanden, Schroder, Torlakson, McPeak NOES: None ABSENT: None ABSTAIN: None ------------------------------------------------------------------ SUBJECT: Proposed BART/SAMTRANS Agreement for Extension of Service to Colma Supervisor Sunne McPeak presented a recommendation to request County Counsel to analyze legal steps required to detach areas of Contra Costa County from the Bay Area Rapid Transit District (BART) ; and further to analyze the consequences of withholding all or part of the BART property taxes paid by Contra Costa County residents to BART. In her report to the Board (copy attached) , Supervisor McPeak noted the frustration of the residents in Contra Costa County who are paying for BART but are not receiving services. Supervisor Tom Torlakson commented on the attempts of the City-County Coalition for BART Extensions in East County to get a rail system in that area. He advised that the Coalition efforts were not successful. Supervisor Torlakson recommended that a fiscal analysis be made of the impact of any kind of withdrawal from the BART District relative to the assets, revenue stream and potential imposition of surcharges. He suggested that the Transportation Planning staff and the County Administrator assist in this .effort. Supervisor Robert Schroder expressed reservations relative to detaching Contra Costa County from BART. He spoke of the need for more information as to the reasons why BART is pursuing the Colma Agreement. Supervisor Schroder recommended a meeting with the BART Board of Directors and representatives from Alameda County to discuss the impact the BART-Colma Agreement would have on future BART extensions in Contra Costa and Alameda County. Margaret Pryor, President of the BART Board of Directors, spoke briefly on events leading up to the BART-Colma Agreement, and expressed her belief that as a result of the Agreement there would ultimately be funds available to respond to the needs of Contra Costa, Alameda and San Francisco County residents for improved .BART service. ' Nello Bianco, BART Director representing Contra Costa County, expressed his concern relative to the construction of the Colma station prior to the extensions in Contra Costa County. He noted that the extensions in Contra Costa and Alameda County had long been a priority with the BART District, and urged the Board to continue to pursue action necessary to assure completion of the proposed extensions. Louise Aiello, member of the County Planning Commission, TRANSPAC and Chair of the Infrastructure Commitee of the General Plan Congress, urged the Board to meet with the BART Board of Directors to discuss the impact of the BART-Colma Agreement on the residents of Contra Costa County. She further recommended that the County explore the feasibility of a ballot measure to establish a City/County Transportation Agency. 1 Don Christen, Executive Vice President, Contra Costa Taxpayers Association, agreed that discussions with the BART Board were advisable, but stated that in the event an immediate response was not forthcoming, his organization would support whatever legal or legislative action the Board determines necessary. Supervisor Nancy Fanden stressed the importance of assuring that the previous BART policy of extending services to Contra Costa County was carried out, to West County cities as well as East County. She requested that County Counsel explore the possibility of a lawsuit against the BART District on behalf of the residents of the Martinez area and West County. Supervisor Tom Powers expressed concern relative to the possibility that completion of the proposed BART extensions may reduce available funding sources for other important transportation needs in the County. After further discussion by Board members, IT IS ORDERED that the following actions are APPROVED: 1. REQUESTED that a meeting be scheduled as soon as possible with BART Directors and the Contra Costa Transportation Partnership Commission to discuss the impact of the recent BART-Colma Agreement; 2. REQUESTED BART to reconsider their action on the Statement of Principles and reinstate previous BART policy regarding extensions to East and West Contra Costa County; 3 . REQUESTED County Counsel to explore the feasibility of suing BART on behalf of the Martinez area and West County, analyze legal steps required to detach areas of Contra Costa County from the BART District, analyze the consequences of withholding all or part of property taxes paid by County residents for BART, analyze the fiscal impacts of such actions, and review the feasibility of a ballot measure to establish a City/County Transportation Agency; and 4.
