Bragdon Cwtt'a Director of Community Development �� 1 DATE: October 6, 1987 - Cx)staWu� SUBJECT: Adoption of Residential Second Unit Ordinance W SPECIFIC REQUEST(S) , OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS Adopt the Residential Second Unit Ordinance in the attached form which includes the following changes from the September 28, 1987 version. BACKGROUND/REASONS FOR RECOMMENDATIONS During its September 29, 1987 meeting, the Board of Supervisors took the following actions on the Residential Second Unit Ordinance: 1. Introduced the Ordinance, waived reading and set .October 6, 1987 for its adoption; - 2. Authorized Zoning Administrator review and approval of on-site parking space configuration subject to no parking in setback areas; 3 . Directed staff to: a. Study the feasibility of allowing amnesty by deferring enforcement on .existing illegal 'second units" for a maximum 12 month period beginning with the Ordinance' s effective date; b. Prepare a public .notice for distribution via letters or a press release informing the community about the ordinance, its effective date, and describing the process for applying to legalize existing second units along with the time period available for accomplishing this; CONTINUED ON ATTACHMENT: YES SIGNATURE: K �A f . Investigate criteria for potential application in exempting certain geographic areas from the Residential. Second Unit Ordinance, consistent with the State law and the required findings therein, and report to the Board of Supervisors - at a future date, or in the alternative; explore with Kensington community representatives the feasibility of developing a local advisory board to ' implement procedures for reviewing second unit applications involving variance requests. For purposes of "consistency and to avoid duplication, Sentence #2 and Finding ( 2) have been changed . to read: . .
