Robertson and Crockett Properties in the Crockett area. This being the time for hearing on the recommendation of the Contra Costa County Planning Commission on the application filed by Theodora A. Robertson (applicant) and Crockett Properties (owner) to rezone 2.6 acres from Retail Business (R-B) and Multiple Family Residential District (M-12) to Planned Unit District (P-1 ) (2678-RZ) together with application for approval of a Final Development Plan #3029-86 in the Crockett area; and Harvey Bragdon, Director of Community Development, described the property site and advised that a Negative Declaration of Environmental Significance had been posted for this project. He also presented a reivsed Condition #4 of approval relative to Development Plan 3029-86 . The Chairwoman opened the public hearing and the following people appeared to speak: Theodora A. Robertson, 885 Loring Avenue, Crockett, Project Architect, commented on the project preserving the historic character of Crockett and on the changes being mostly interior and not to the architecture; Mr. Hageman, 7 Rolph, Crockett, commented on concerns he felt relative to parking; John Board, P.O. Box 84 , Crockett, commented on the loca- tion of alternative parking; Eugene Lesmeister, 1214 Star Street, Crockett, desired a little more clarity on the parking situation. Theodora Robertson deferred to Mr. William Frank, Real Estate Consultant who spoke in rebuttal. No one else appearing to speak the Chairwoman closed the public hearing. Supervisor Fanden moved approval of the project but with a more definite plan for parking. Mr. Bragdon suggested a meeting with the applicant and concerned parties to work out a solution to the parking concerns. This approval is based upon the exhibits received by the Community Develop- ment Department and listed as follows: A. Exhibit "A" - Preliminary Development Plan for commercial buildings, parking areas, and bed and breakfast inn scale 1"=160' received May 13, 1986. B. Exhibit "B" - Preliminary floor plans and building elevations, received May 13, 1986. C. Conceptual landscape plan, received May 13, 1896. D. Feasibility study of prepared by Centuries Forecasts dated received May 13, 1986. E. Traffic study prepaid by J. H.K. and Associates dated received May 13, 1986. 2. The development can be built in two phases. 3. Sewage disposal serving the properties concerned in this application shall be provided by the Crockett-Valona Sanitary District. The sewers located within the boundaries of the properties concerned shall become an integral part of the Crockett-Valona Sanitary District's sewerage collection system. 4. Water supply serving the properties concerned shall be by the East Bay Municipal Utility District. Such water distribution system, located within the boundaries of the properties concerned in this application, shall become an integral part of the East Bay Municipal Utility District's over- all water distribution system. 5. Comply with the requirements of the Crockett-Carquinez Fire Protection District including provision for water supply and fire hydrants, as deter- mined by the District. 6. Acceptable measures shall be taken for maintenance of landscaping in public areas. 11/10/86 2/19/87 RZIII/2678-RZ.AB CONDITIONS OF APPROVAL FOR DEVELOPMENT PLAN 3029-86 1. This approval is based upon the exhibits received by the Community Develop- ment Department and listed as follows: A. Exhibit "A" - Final Development Plan for site done by Theodora Robertson, received May 13, 1986. B. Exhibit "B" - Floor Plans and Typical Elevation Plans dated received May 13, 1986. C. Traffic Study by J. H. K. and Associates dated received May 13, 1986. D. Feasibility study prepared by Centuries Forecasts dated received May 13, 1986. 2. This approval is subject to adoption of an Ordinance for the rezoning of the subject property under application 2678-RZ. The final number and layout of building and parking area shall reflect the Board's approval . 3. The proposed buildings shall be similar to that shown on submitted plans. Prior to the issuance of a building permit elevations and architectural design of the building and building roof material shall be submitted for final review and approval by the County Zoning Administrator. The roofs and exterior walls of the building shall be free of such objects as air conditioning or utility meter equipment, television aerials, etc. , or they shall be screened from view. The building shall be finished in brick or other materials acceptable to the Zoning Administrator. 4. The site can be developed in the following manner: a. The Valona Square and Sugar Mill buildings, Pezzuto's Restaurant and the 17 unit bed and breakfast inn and the old Valona Emporium and old Imeroni Bakery together with the proposed 38 space parking lot at the northeast corner of Wanda Street and Second Avenue and the 11 space parking lot at the northwest corner of Wanda Street and Second Avenue, the 11 space parking lot behind Valona Square and the use of 36 unit parking facility subject to the review and approval of the Zoning Administrator. Street landscaping, the fountain-plaza and overlook park shall be installed prior to occupancy of the Sugar Mill building. Within 90 days of the occupancy of 75% of the retail area of the Sugar Mill Buildings an acceptable parking impact study together with recom- mended mitigation measures shall be submitted for the review and approval of the Zoning Administrator. As a result of the study additional parking spaces may have to be built along the railroad right of way north of Second Avenue together with a suitable stairway down from the overlook park. The applicant shall apply to set up a permit parking zone on both sides of Ceres Street from First to Second Avenue excluding frontages zoned Retail Business, both the sides of Starr Street from Second to Third Avenue and the frontage on the east side of Second Avenue near Starr Street zoned M-12. The permit parking zone can be expanded to other nearby streets- if conditions warrant. The developer shall pay 1 \ , 2. to erect the required signs. The permit parking zone shall allow for a maximum of one-half hour of parking by non-permitee parkers. The request shall be made before the occupancy of any buildings involved in this permit. 5. Comply with landscaping requirements as follows: A. A landscaping program for all areas shown on the submitted plot plan shall be submitted for review and approval of the Zoning Administrator at least 30 days prior to issuance of building permits. A cost esti- mate shall be submitted with the landscaping program plan. B. California native species shall be used as much as possible. All trees shall be 15 gallon size, all shrubs shall be 5 gallon size. Trees should be of a drought tolerant type. The Second Avenue area shall be landscaped with trees on each side. C. The Public Works Department shall approve the type of street trees to be used. D. A suitable method for street landscaping maintenance shall be developed subject to Zoning Administrator review and approval with advice from the Public Works Department. Such landscaping maintenance shall be accomplished with no public expense. E. Landscaping shall comply with the Contra Costa County policy on water conservation requirements for new developments. F. The property line between any parking area and residences shall be fenced with a brown tinted or brick masonry fence 6 feet high. If the neighboring property owner is agreeable a solid wood, wood and brick or other type of fence could be substituted. G. The Zoning Administrator shall review and approve the plans for the fountain plaza and over-look park. H. Every third space in the center aisle of the 38 space parking lot shall be made a compact space to create space for a landscape tree planter. 6. An archaeological field reconnaissance report shall be prepared and submitted to the Community Development Department. This report shall be prepared by a professional archaeologist who is certified by the Society for California Archaeology (SCA) and/or, the Society of Professional Archaeology (SOPA) . 7. The site lighting shall be of low intensity and shall be deflected to shine only onto the site. Any change in street lighting shall be acceptable to the Public Works Department. UNION W 3. 8. Each building shall have address numbers that are clearly visible day and night to the street in front of the unit. 9. Any changes in the layout of shops or number of businesses in the buildings will require Zoning Administrator review and approval . Any increase in the number of businesses over those approved as shown on the Development Plan will require a new P-1 rezoning request and final Development Plan. 13. Hours of operation for the retail shops can be from 7 A.M. to 6 P.M. Monday to Friday, 9 A.M. to 6 P.M. Saturday and 9:00 A.M. to 5 P.M. Sunday. The complex may be open to 9 P.M. one week day each week at the discretion of the owner. Hours of operation of the Sugar Mill Restaurant-Bakery can be from 6 A.M. to 10 P.M. with food service oriented toward breakfast and lunch and light dinners. Pezzuto's Restaurant and bar can be open from 11 A.M. to 9 P.M. Monday to Sunday. Julie's Cafe can be opened from 6 A.M. to 6 P.M. The Villa Montesana Restaurant can be opened from 6 A.M. to 9 P.M. 14. The design, color and location of any project signs at the front of build- ings shall be reviewed and approved by the Zoning Administrator. A sign program shall be designed for Zoning Administrator review and approval . Signs shall be kept small . 15. Parking and driveway areas shall be paved so as to prevent ponding of water or the creation of dust. Handicapped parking spaces shall be clearly marked. Parking spaces may over hang widened landscaped areas. They may not over hang sidewalks. 16. The applicant shall submit names for any change in the name of Second Avenue for review and approval of the Community Development Department and the fire district. 17. Comply with the requirements of the Crockett-Valona Sanitary District. 18. Comply with the requirements of the Building Inspection Department. EKEDff 4. 19. The roofs of the buildings shall drain to the streets or storm drains. 20. Each building shall be provided with the required number of fire district approves smoke detectors. The smoke detectors shall be mounted on the ceilings near bedrooms and other areas deemed necessary by the fire district. 21. Prior to reoccupancy of any building a report attesting to its ability to withstand earthquake loads shall be submitted for review and approval of the Community Development Department. Such report shall be prepared and submitted by a registered structural engineer. Recommendations of any such report shall be incorporated in the building reported on prior to occupancy. 22. The agreement for use of a parking facility shall run for at least 10 years and be renewable. A copy shall be submitted for the review and approval of the Zoning Administrator. 23. The Zoning Administrator shall review and approve any changes in occupancy of the structures especially if the changes may effect parking require- ments. 24. Comply with the drainage, road improvement and utility requirements as follows: A. In accordance with Section 82-2.014 of the County Ordinance Code, this development shall conform to the requirements of Division 914 (Drain- age) of the Subdivision Ordinance, unless exceptions are specifically granted. B. Unless exceptions are specifically granted, comply with the require- ments of Division 1006 (Road Dedication and Setbacks) of the County Ordinance Code. The following shall also be included: 1) Construct and/or upgrade as necessary, curbs, sidewalks, necessary longitudinal and transverse drainage and pavement along the frontages of Ceres Street, Wanda Street and Second Avenue. Sidewalks shall extend, in width, from the curb to the right of way line. 2) Install signage for reserved parking for residential units. 3) Install a new steel pole system for street lights. 4) Mid-block pedestrian crosswalks will not- be permitted. 5) Exotic road and walkway materials shall be subject to review and approval by the County Public Works Department. URDU A 5. 6) The proposed road name change shall be permitted only if it is in compliance with the County's "Road Name Change Policy" (Resolution No. 78/612) . C. Contribute a drainage fee of $0.35 per square foot of additional impervious surface area created to the County Drainage Deficiency Fee Trust (Fund No. 812100-0800) designated for improvements to Drainage Area 54. D. Contribute $1.60 per square foot of Commercial/Retail building area (a total of $65,840 for this development) to a Road Improvement Fee Trust (Fund No. 819200-0800) designated for Road improvements to Carquinez Scenic Drive, Pomona Street, and Crockett Boulevard, including signalization improvements as building permits are taken out or on a per square foot basis formula that is acceptable to the Zoning Administrator. E. Install all new utility distribution services underground. F. Prevent storm drainage, originating on the property and conveyed in a concentrated manner, from draining across the sidewalks and driveways. G. Furnish proof to the Pub14- Works Department, Engineering Services Division, of the acquisition of all necessary rights of entry, permits and/or easements for the construction of off-site, temporary or permanent, road and drainage improvements. H. Submit improvement plans prepared by a registered civil engineer to the Public works Department, Engineering Services Division, for review; pay the inspection, plan review and applicable lighting fees. These plans shall include any necessary traffic signage and striping plans for review by the County Traffic Engineer. The improvement plans shall be submitted to the Public Works Department, Engineering Services Division, prior to the issuance of any building permit. The review of improvement plans and payment of all fees shall be completed prior to the clearance of any building for final inspection by the Public Works Department. If final inspection is requested prior to construction of improvements, the applicant shall execute a road improvement agreement with Contra Costa County and post bonds required by the agreement to guarantee completion of the work. I .
