SUBJECT: Hearing on appeal of Gonsalves & Santucci , Inc. from the
decision of the East County Regional Planning Commission
on conditions related to setback requirements of the
application for a two-story mini-storage facility and a
caretaker unit in the Oakley area. (LUP 2050-85)
This being the time set for hearing on the appeal of
Gonsalves & Santucci , Inc. from the decision of the East County
Regional Planning Commission on conditions related to setback
requirments of the application by J.H. Felice (applicant) and
Gonsalves & Santucci , Inc. (owners) for approval of a two-story
mini-storage facility and a caretaker unit located on the south side
of State Highway 4, approximately 80 feet east of the intersection
with Live Oak Avenue in the Oakley area (LUP 2050-85) ;
Harvey Bragdon, Director of Community Development,
described the project and property site and the request for the
variance.
The Chairwoman opened the public hearing. The following
people appeared to speak:
Frank Bellicci , 2552 Stanwell Drive, Concord, appeared for
the owners and commented that a compromise had been worked out with
staff whereby it was possible to achieve community desires, archi-
tecturally treating the wall and having a certain amount of
landscaping;
Mr. Bragdon commented that it appeared to be an acceptable
compromise to the concerns that staff and the Planning Commission
had and he described the compromise;
Supervisor Torlakson commented on the accent color of the
indented panels in the wall;
The Chairwoman asked Mr. Enrico Cinquini , an abuting pro-
perty owner, if the compromise was satisfactory. He commented that
it was.
Supervisor Torlakson moved to CLOSE the public hearing and
GRANT the appeal of Gonsalves & Santucci , Inc. from the decision of
the East County Regional Planning Commission on conditions related
to setback requirement of the application LUP 2050-85 provided the
applicant complied with the additional compromise language added to
the conditions by Community Development and County Counsel, Exhibit
A attached hereto and by reference incorporated herein.

CONDITIONS OF APPROVAL FOR LAND USE PERMIT 2050-85
1. This project is generally approved for a mini-storage construction as shown
on plans dated March 17, 1986 received by the Community Development Depart-
ment. This includes the proposed sign plan dated February 11, 1986
received by the Community Development Department.
2. These plans shall be revised prior to issuance of a building permit in
conformance with Light Industrial Zoning Ordinance, to include 10 foot set-
backs to the east and landscaping cutouts along the west wall .
3. Landscaping along State Highway 4 shall be installed as indicated in plans
accepted dated February 6, 1986. Landscaping plans shall be submitted for
the sideyard areas on the east and west sideyards. These landscaping plans
shall include:
A. The east sideyard shall be similar to that along State Highway 4, but
on a simpler scale.
B. The west sideyard is eliminated.
C. The west wall shall have 10' x 3' indentations every 30 feet provided
with planters approximately 10' x 3' x 2' in size and landscaped suit-
ably.
D. Maintenance of landscaping on all sideyard areas shall remain the
responsibility of the property owner.
E. The landscaping plans shall be subject to the review and approval of
the Zoning Administrator.
4. The exterior wall of the storage units, on the east and west shall be
constructed with a random planking textural detail as is proposed for the
frontage wall . The proposed detail shall be included in the landscape
plans and subject to Zoning Administrator approval .
5. Comply with drainage, road improvement, traffic and utility requirements as
follows:
A. In accordance with Section 82-2.014 of the County Ordinance Code, this
development shall conform to the requirements of Division 914 (Drain-
age) of the Subdivision Ordinance, unless exceptions are specifically
granted.
B. Unless exceptions are specifically granted, comply with the require-
ments of Division 1006 (Road Dedication and Setbacks) of the County
Ordinance Code. This includes the following:
1) Convey to the County, by Offer of Dedication, approximately 8
feet of additional right of way on State Highway 4 as required
for the planned future width of 116 feet.

2) Construct curb, 6.5-foot sidewalk (width measured from curb
face),. necessary longitudinal and transverse drainage,
channelization for a left-turn lane and acceleration/deceleration
tapers and necessary pavement widening on State Highway 4. The
left turn lane shall be subject to the re-evaluation of the
Zoning Administrator if it proves to be feasible. The face of
curb shall be located 10 feet from the widened right of way line.
Credit shall be given against the Oakley Area of Benefit fees for
basic frontage improvements beyond 20 feet from curb face.
3) Install street lights on State Highway 4. The final number and
location of the lights shall be determined by the County Traffic
Engineer. The applicant shall annex this property to County
Service Area LL-100 for maintenance of street lights.
4) Restrict access along State Highway 4, with the exception of the
ingress and egress shown on the July 31, 1986 Site Plan. Exit
from this property will be to the right only.
C. An encroachment permit for construction within the State right of way
shall be obtained from Caltrans through the Public Works Department,
Engineering Services Division.
D. Comply with the requirements of the Bridge/Thoroughfare Fee Ordinance
for the Oakley Area of Benefit as adopted by the Board of Supervisors.
E. Prevent storm drainage, originating on the property and conveyed in a
concentrated manner, .from draining across the sidewalk and driveways.
F. Furnish proof to the Public Works Department, Engineering Services
Division, of the acquisition of all necessary rights of entry, permits
and/or easements for the construction of off-site, temporary or
permanent, road and drainage improvements.
G. Comply with the drainage fee requirements for Drainage Area 29H as
adopted by the Board of Supervisors.
H. Install all new utility distribution services underground.
I . Submit improvement plans prepared by a registered civil engineer to
the Public Works Department, Engineering Services Division, for
review; pay the inspection, plan review and applicable light fees.
These plans shall include any necessary traffic signate and striping
plans for review by the County Traffic Engineer. The improvement
plans shall be submitted to the Public Works Department, Engineering
Services Division, prior to the issuance of any building permit. The
review of improvement plans and payment of all fees shall be completed
prior to the clearance of any building for final inspection by the
Public Works Department. If final inspection is requested prior to
construction of improvements, the applicant shall execute a road
improvement agreement with Contra Costa County and post bonds required
by the agreement to guarantee completion of the work.

J. Submit a scaled sketch of the proposed left-turn lane, accelera-
tion/deceleration tapers, striping and channelization to the Public
Works Department, Engineering Services Division, prior to preparation
of improvement plans.
6. Access roads and hydrants shall be installed and in service prior to
combustible construction.
7. The developer shall provide an illuminated address located on the building
in such a manner as to be plainly visible and legible from the street or
road fronting the property.
8. The developer shall locate trash enclosures such that commercial dumpsters
are not stored or placed within five (5) feet of combustible walls,
openings or combustible roof eave lines.
Comply with the following advisory conditions:
1. Building Inspection Department:
A. Submit grading and drainage plans.
2. Health Services Department - Comply with the requirements of the Health
Services Department:
A. Installation of a septic tank drainfield system may be considered. A
holding tank will not be permitted.
B. Connect to public sewer system when the service becomes available and
discontinue use of septic system.
3. Fire District: Comply with the requirements of the Fire District.
