County Proposed Sprinkler System as an Option SUBJECT; In Residential Developments SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS: 1 . Refer this item to the 1987 Internal Operations Committee. 2 . Include in the referral to the 1987 Internal Operations Committee a request that «the Chief of the Consolidated Fire District, on behalf of the Fire Chiefs Association, report to the 1987 Internal Operations Committee on what - the current sprinkler requirements are in the County as they apply to commercial buildings, including hotels, high-rises, restaurants, and other types of buildings to which the public has access, or which employ large numbers of individuals, and to clarify which buildings these regulations apply to; i.e. , do the existing regulations apply retroactively to older commercial buildings, or do we have hotels, restaurants, and other commercial buildings in the County which are not required to be sprinklered. 3 . Remove this item as a referral to the 1986 Internal Operations Committee. BACKGROUND: As the attached memo from the Director of Community Development indicates, objections raised by the Building Industry Association have precluded completing the series of meetings ordered by the Board of Supervisors on December 16. It is, therefore, necessary to refer this matter over to the 1987 Internal Operations Committee. We have recommended that the referral be expanded to include a report on commercial buildings because of the recent tragic fire in Puerto Rico and a certain amount of confusion as to which buildings in Contra Costa County are required to have sprinkler systems. Bragdon Director of Communit eve ent SUBJECT: Proposed Sprinkler tem as Option in Residential Development ----------------------------------------------------------------- ----------------------------------------------------------------- On December 8 , 1986 , the Board of Supervisors requested the Fire Chiefs of the Moraga and Consolidated Fire Districts to meet with representatives of the Building Industry Association in an effort to reach agreement on the outline of a residential sprinkler system option in residential developments. The Board further requested the Chiefs and BIA to meet with certain county departments to discuss dificulties in implementing the agreement reached by the parties. In addition, the Board requested the Director of Community Development to report on January 12 , 1987 on the components of a workable program to implement the agreed upon options for residential sprinklers in new developments. . Staff contacted the Fire Chiefs to determine whether a meeting had been held with BIA, and if so, whether a meeting with the various departments could be held prior to the Internal Operations Committee Meeting on January 12. Although The Districts and BIA did meet, no meeting was requested with County staff because of concerns expressed by the BIA in a letter which was subsequently sent to the Fire Chiefs. Staff has not yet received a copy of that letter, but anticipate that it will be available for distribution on January 12 . It is our understanding that the BIA concerns center on the market demand for such sprinklers, the perceived liability to the builder, and the additional cost to the new home buyer, in terms of housing affordability. We anticipate that the BIA representatives will be present to air these concerns with the Committee. Inasmuch as the second meeting requested by the Board Order of December 8 was not requested, and given that the Building Industry Association has expressed serious concerns with the proposed process as outlined in the memorandum from County Counsel dated December 4 , 1986 , we are unable to forward a recommendation on a workable program for providing residential sprinkler system options at the present time.
