NOES: None . ABSENT: None . ABSTAIN: None . RESOLUTION NO. ; 87/2 SUBJECT: Speed Zone established on certain waterways in Delta Area The Contra Costa County Board of Supervisors RESOLVES THAT: It has been brought to the Board's attention that during periods of high tides and/or high flow in the waterways. of Contra Costa County's Delta the wind, wave (including passing boat wakes) and tidal action cause damage to the levees, thereby endangering the safety of persons and property by resulting levee failure and island flooding. The Sheriff-Coroner indicates a study by the. State of Californi 'a Department of Boating a nd Waterways concludes a significant levee erosion is caused by the wake of a passing boat. Contra Costa County Ordinance Code SS410-4.001 and 410-4.004 provide that the Board of Supervisors by resolution may designate slow areas which are speed zones in which no vessel may be operated at a speed in excess of five nautical miles per hour. Pursuant to Ord. C. S410-4.004 during the following listed time periods the herein- after designated Delta waterway areas are slow areas: 1. Time Periods a. 0001 hours 12-28-86 to 1200 hours 1-2-87 B. 0001 hours 1-27-87 to 1200 hours 2-1-87 2. Slow Areas a. All waterways within Contra Costa County east of the Antioch Bridge including: San Joaquin River False River Old River Middle Slough Broad Slough New York Slough Sheep Slough Rock Slough Dutch Slough Taylor Slough Piper Slough Sand Mound Slough Big Break Frank' s Tract Fishermans Cut Holland Cut Pursuant to Harbors and Navigation Code S660(c) this is an emergency regulation effective immediately on its adoption and remains in effect during the time periods set forth above which do not exceed 60 days from its adoption. It is necessary that this regulation be immediately effective in order to insure the safety of persons and property during the above specified periods of Delta high tides and high flow by preventing wakes from boats traveling in excess of five nautical miles per hour which can breach weak levees, cause island flooding, increase the erosion of levee crowns (and the possibility of damage to marina property and farm lands) , and damage wildlife habitat areas.
