HomeMy WebLinkAboutMINUTES - 09081987 - T.2 r THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA T.2 Adopted this Order on September 8, 1987 , by the following vote: AYES: Supervisors Fanden, Schroder, Torlakson and McPeak NOES: None ABSENT: Supervisor Powers ABSTAIN: None -------------------------------------------------------------------- -------------------------------------------------------------------- SUBJECT: Rezoning Application 2707-RZ, Development Plan 3006-87 and Subdivision 6881 , Tara Hills/Pinole Area. The Board on August 18 , 1987 continued to this date, for staff responses to concerns raised on August 11 , 1987 and the applicant' s rebuttal, the hearing on the recommendation of the County Planning Commission with respect to rezoning application 2707-RZ filed by Davidson, Kavanagh, and Brezzo Development Company/Bridge Housing Corporation (applicants) and Richmond Unified School District (owners) , Development Plan 3006-87 , and Subdivision 6881 in the Tara Hills/Pinole area; and Supervisor McPeak noted that new information regarding the dedication of one lot and the availability for purchase of others by the Tara Hills Alliance Church had been received from Reverend Gregory. The Board requested a clarification of position from the Tara Hills Alliance Church, the M-17 District and the City of Pinole. Reverend Gregory of the Tara Hills Alliance Church com- mented on the proposals between the developer and the Church regarding the lots and provision of childcare, the needs of the com- munity superseding the needs of the Church, and that the Church could not be a part of leverage and urged that the development stand on its own merits. Paula Christensen, Director of Montara Bay Center, com- mented on the mini-park, the need for an assessment district for the maintainence of a park, the park and recreational plan being deve- loped for the M-17 District, the softball diamond, and park dedica- tion fees, but could not speak for the M-17 District because the M-17 District had not voted for or against the project, commenting they wished to have more information on the assessment district function and have requested this information from County Counsel. Supervisor Fanden commended Ms. Christensen for her work with the M-17 District and commented on the issue of the park dedi- cation fee and the proposed assessment district. Supervisor Torlakson commented on the assessment districts in the East County. Don Bradley, City Manager, City of Pinole, commented on the City of Pinole's position of not being opposed to development of this site, but expressed concerns including the site being developed according to Pinole Single Family Development Standards, the size of the park, the location of the condominiums to parking, the density of the project, and the annexation of this project to the City of Pinole. The Board discussed the park dedication fee, the size of the park and the proposed assessment district. - 1 - w John Brezzo, the applicant, spoke in rebuttal on issues including childcare, the park dedication, the proposal for the dedi- cation of four additional lots for the park, the proposed assessment district, the mitigation of the parking for the cul de sac lots, the fire access and the parking for the condominiums and the loss of open space, annexation to the City of Pinole and a proposed Development Agreement with the City of Pinole, and requested a modi- fication to condition number 26 to conform to the original staff recommendation to the Planning Commission which allows the con- dominium development to be the location of the affordable units. Supervisor Fanden commented that a a requirement for the project would be that the childcare portion of the agreement with the Church continue whether the Childcare Ordinance is adopted or not. The Board discussed the proposed location of the affor- dable units. Jim Kennedy, Community Development Department, responded to concerns expressed by Supervisor Fanden regarding the location of the affordable units. Don Bradley, City of Pinole, commented further on issues including the park dedication fee, the density bonus calculation, and park size. Leona Hermansader, member of M-17 Advisory Committee, com- mented that M-17 was an advisory committee and is finally getting community input. Councilwoman McCarty, City of Pinole, commented on the City of Pinole's position on affordable housing being absolutely favorable. , The public hearing was closed. The Board discussed the matter. Supervisor Fanden requested clarification from the Community Development Department on recommendations. Mary Fleming, Community Development Department, responded to Supervisor Fanden's request with respect to park size, the number of units, childcare, the location of the affordable units, parking for the condominiums, the park dedication fees , the revised conditions. Supervisor Fanden requested input from the other Board members on the park dedication fees. Supervisor Schroder commented on the basis for the park dedication fee credit, the purpose of the park dedication fee and imposing the fee of the city due to annexation. Supervisor Torlakson requested clarification on the size of the park called for in the General Plan. Supervisor Fanden requested staff to meet with the develo- pers and the City of Pinole and present a recommendation to the Board at 2 :30 on the park dedication fee. The developer volunteered that they would not seek any credit against the current $400 park dedication fee for any of the public facilities. Supervisor Fanden recommended changing the size of the affordable units to 800 square feet to allow for 4 additional units 2 - to be placed elsewhere in the subidvision and allow the four lots to be dedicated to the park. The developer responded that this would be moving away from the R-6 standards which they were trying to maintain. Supervisor McPeak requested clarification of the Housing Element with respect to policies in it that would allow for con- sideration of the dedication by developers of land or fees in order to achieve affordability. Jim Kennedy and Victor Westman responded to Supervisor McPeak's concern. The Board concurred to continue for decision until the afternoon calendar. On reconvening, the Board heard a report by Mary Fleming, Community Development Department, on the results of the meeting with the developer, the City of Pinole and interested parties. Ms. Fleming explained that the parties had reached an agreement on a condition that provides two alternatives, indicating that if the site is developed within the next year that parcels 71 through 74 would be eliminated and approximately 200 feet of that frontage would be provided as park area, and after that year, they would be subject to a condition that would require that they dedicate the two lots 48 and 49 , develop the park site and pay the $400 to the County. If they were to annex into the City within a year, they would abide by the first part of the condition, and if they do not go into the city they would abide by the second part of the condition. Supervisor Fanden moved for approval of the project as indicated by the conditions that were outlined by staff earlier and that are on the record and requested that staff come up with the written proposal as indicated and to provide it to the City of Pinole and the community, and for Board review. Supervisor McPeak commented that this area should be annexed to the City of Pinole, but that the revenue for the main- tainence of the park area and revenue from the fees should go in some manner to M-17 and that the County should stand prepared to negotiate on the property tax agreement upon annexation some addi- tional consideration for the City of Pinole being willing to support the need for affordable housing. Supervisor Fanden requested those comments to be included in the conditions as were earlier outlined. Therefore , IT IS BY THE BOARD ORDERED that rezoning appli- cation 2707-RZ, Development Plan 3006-87 and Subdivision 6881 are APPROVED with amended conditions; and the Community Development Director is DIRECTED to prepare final amended conditions for Board of Supervisor's consideration; and Ordinance No. 87-76 giving effect to the rezoning is INTRODUCED, reading waived, and September 22, 1987 is set for adoption of same. 8 hereby certify that this is a true and correct copy o4 an action taken and ente"od,,' on the s 1putes of the Board of Supertr sora ®ra t9�e date sFs06'rnq.
