The Board of Supervisors of Contra Costa County FINDS and DETERMINES that : Government Code Section 66484 and Division 913 , Title 9 , of the Contra Costa County Ordinance Code provide for assessing and collecting fees for bridge and/or major thoroughfare construction within a designated Area of Benefit as a condition of approval of a final subdivision map or as a condition of issuing a building permit; and The Public Works Director and the Director of Community Development have completed a Revised Development Program Report for the West Pittsburg Area of Benefit which was filed with the Clerk of the Board . Notice of the hearing was duly given in accordance with Government Code Sections 54986 , 54992 65091 , 65962 and 66484 ; and The Board hereby DETERMINES that it can be seen with certainty that there is no possiblity that increasing the fees for the West Pittsburg Area of Benefit as recommended by said Revised Development Program Report may have a significant effect on the environment , therefore the project is not subject to the California Environmental Quality Act pursuant to Section 15061 ( b ) ( 3) of Chapter 3 of said Act ' s guidelines . A majority protest does not exist , inasmuch as a written protest has not been filed by the owners of more than one-half of the area of the property to be benefited by the improvements . The Board hereby RESOLVES that : The Board hereby APPROVES and ADOPTS the Revised Development Program Report pertaining to the West Pittsburg Area of Benefit , its boundaries , estimated cost of improvements , cost allocation , ' method of fee apportionment , revised fee and provision that the interest accrued on the fees collected in this Area of Benefit shall continue to accumulate in the same account and shall be used to cover the cost of administration , design and construction of the fee area improvements , and REVISES the Area of Benefit in accordance with the Revised Development Program Report . The Board hereby INTENDS to adopt the following revised fee schedule by ordinance , as recommended in the Revised Development Program Report: Residential Single Family Dwelling Unit , . $1 ,254 ; Residential Multi- Family Dwelling Unit , $1 ,002 ; Commercial , $2 . 01 per square foot gross floor area ; and Industrial , $0 . 88 per square foot gross floor area . The Board DIRECTS the Public Works Department and the Department of Community Development to work with communities in ' the West Pittsburg area and with local and State agencies in periodically reviewing the fee schedule for the Board ' s consideration . West Pittsburg TAC JRB : Iv BO: 29. t9 RESOLUTION NO. 87/594 ORDINANC NO. 87-80 AMENDING ORDINANCE NO. 85-59 to Revise the Fee for the West Pittsburg Area of Benefit The Board of Supervisors of Contra Costa Cou�ty ordains as follows: SECTION I. Summary. This ordinance provides for revising the fees to be collected from developments proposed in the West Pittsburg Area of Benefit to fund road improvements in West Pittsburg. SECTION II. Authority. This ordinance is enacted, in part, pursuant to Government Code Section 0464 and Division 913, Title 91 ofthe Contra Costa County Ordinance Code. SECTION III. Notice and Hearing. This ordinance was adopted pursuant to the procedure set forth in Government Code Sections 54986, 54692, 65091, 65962, and 66484, and Division 913, Title 9, of the Contra Costa County Ordinance Code, and all required notices have been properly given and public hearings held. SECTION IV. Fee Revision. Section IV of Ordinance No. 85-59 is amended to read as follows: The following revised fee is hereby ADOPTED for the West Pittsburg Area of Benefit to fund road improvements, as described in the Revised Development Program Report, and shall be LEVIED and COLLECTED pursuant to the above authorities: Residential Single Family Dwelling Unit $1,254/unit Residential Multi-Family Dwelling Unit $1,002/unit Commercial $2.01/square foot gross floor area Industrial $0.88/square foot gross floor area The revised fee shall be payable as specified in Chapter 913-4 of the Contra Costa County Ordinance Code. SECTION V. Fee Area. The revised fee described in this ordinance shall apply to all property described in Exhibit "A" attached hereto. SECTION VI. Severability. If any fee or provision of this ordinance is held invalid or unenforceable by a court of competent ju isdiction, that holding shall not affect the validity or enforceability of the remaining fees or provisions, and the Board declares that it would have adopted each part of this Ord nance irrespective of the validity of any other part. SECTION VII. Effective Date. This ordinance shall become effective 60 days after passage, and wit in 15 days of passage, shall be published once with the names of the Supervisors voting for and against it in the Antioch Ledger, a newspaper of -general circulation and published in this County. Pursuant to Section 913-6.026 of the Contra Costa County Ordinance Code , the Clerk of the Board shall promptly file a certified copy of this ordinance with the County Recorder. The Board of Supervisors of Contra Costa County FINDS, RESOLVES and ORDERS that: The Public Works Director and the Director of Community Development have submitted Revisions to the Development Program Report for the Crow Canyon Road Extension Area of Benefit, a copy of which is attached hereto �s Exhibit "A", which was filed with the Clerk of the Board on July 22, 1987. Notice of hearing was duly given in accordance with Government Code Sections 54986, 54992 and 65962 ; and This matter was noticed for hearing before this Board on August 4, 1987, but was thereupon continued by order of the Board to August 25, 1987. On August 25, the Board ordered the matter continued to September 15, 1987. On September 15, the Board ordered the matter continued to September 29, 1987. This Board and County Counsel have received and reviewed copies of certain letters from the City of Danville regarding this matter, which letters are referenced in Exhibit "B" attached hereto. This Board hereby DETERMINES that it can be seen with certainty that there is no possibility that increasing the fees for the Crow Canyon Road Extension Area of Benefit as recommended by said Revisions to the Development Program Report may have a significant effect on the environment, therefore the project is not subject to the California Environmental Quality Act pursuant to Section 15061(b) (3) of Chapter 3 of said Act's guidelines. This Board hereby AUTHORIZES and DIRECTS the County Administrator to respond, on behalf of the County and upon advice of County Counsel, to the letters from the City of Danville regarding this matter, by sending to the City the letter attached hereto as Exhibit "B. " This Board hereby APPROVES and ADOPTS said Revisions to the Development Program Report attached hereto as Exhibit "A, " dated July 22, 1987, including its updated data on approved and estimated costs, development potential, cost allocation, and revised fee schedule. This Board further ADOPTS as its findings in support of this Board's actions herein the statements and determinations set forth in said Revisions to the Development Program Report attached hereto as Exhibit "A" and in said letter attached hereto as Exhibit "B. The Crow Canyon Road Extension Area of Benefit was established by the County lin early 1986 (Resolution 86/36 , adopted January 28, 1986; Ordinance 86-11 , adopted February 4, 1986) for the purpose of reimbursing Blackhawk for 100% of the cost of constructing the two lane road to Camino Tassajara Road and 75% of the cost of the specified signal installations. A Reimbursement Agreement ( Crow Canyon Road Extension) between Blackhawk and the County was adopted by the Board September 16, 1986 ( Resolution 86/560) . Thereafter Blackhawk completed construction of the Crow Canyon Road Extension. Ordinance No. 86-11 established the initial fee schedule to be levied and collected within the Fee Benefit Area and provided that final fees are "subject to annual review of final costs and final approved entitlements in Fee Benefit area by Contra Costa County. " Pursuant to this fee adjustment mechanism, the amount of the fees is not subject to any cap, but rather will i nc rea se or decrease depending upon the updated costs and land use entitlements. Pursuant to Ordinance No. 86-11 and the above referenced resolutions, for those developments requiring a final or parcel map, the fees are to be collected prior to the filing of a final or parcel map and for all other developments the fees are to be collected prior to issuance of a building permit. Effective February 10, 1987 (Resolution 87/70), the County, the Town of Danville and the City of San Ramon entered into a "Joint Exercise of Powers Agreement ( Crow Canyon Road Extension Fee Benef*t Area) " providing for the functional continuation of the Fee Benefit Area established by County within any property located within the boundaries of the Fee Benefit Area that might be subsequently annexed to either city. Some of these properties have already been annexed to Danville. Pending development projects within the Fee Benefit Area have been appropriately conditioned in accordance with the Joint Exercise of Powers Agreement (February 10, 1987) . The Joint Exercise of Powers Agreement (February 10 , 1987) provides that the review and approval of costs incurred by Blackhawk and the adjustment of the Fee Benefit Area fees to reflect final costs and entitlements are to be determined exclusively by the County. It should be noted that the fee adjustment mechanism established in Ordinance 86-11 and continued in the Joint Exercise of Powers Agreement (February 10 , 1987) was not in any way modified or superseded by the provisions of the later "Joint Exercise of Powers Agreement - Tassajara Transportation Improvement Fees" between the County, Danville and San Ramon (Board Order No. 1.097 , April 28, 1987). Pursuant to the annual fee adjustment mechanism discussed above and in order to ensure that Blackhawk is reimbursed for its costs, it is necessary to revise the Fee Benefit Area fee schedule based on updated cost and land use information. This report contains revisions to the Development Program Report for the Crow Canyon Road Extension Area of Benefit, adopted by the Board of Supervisors January 28, 1986 (Resolution 86/36) . Only the sections included in this report have been revised. The remainder of the original report is unchanged and remains fully effective. 2 DEVELOPMENT POTENTIAL The change in estimated development pote tial is shown below. Davis City Manager Town of Danville 510 La Gonda Way Danville, CA 94526 Re: Crow Canyon Road Extension Fee Benefit Area -- Adjustment of Fees for Reimbursement to Blackhawk Corporation Dear Michael: The Board of Superv1 rs and County Counsel have received several letters from you etting forth your thinking regarding the County's powers to just the Crow Canyon Road Extension Benefit Area fees Da ille and San Ramon are to collect for reimbursement to Blackhawk. We see a potential for misunderstan- ding and I, on behalf of the County and with the advice of County Counsel, have been formally directed by the Board (per attached Board Resolution No. 87/510) to prepare this letter in order to assure that the record remains clear. Specifically, it is the County's position that the only proper interpretation of the February 10, 1987 "Joint Exercise of Powers Agreement (Crow Canyon Road Extension Fee Benefit Area)" between the County and the Cities and all other agreements (including the "Joint Exercise of Powers Agreement - Tassajara Area Transportation Improvement Fees," approved April 28, 1987 ) is that the fees to be paid for reimbursement to Blackhawk are to be periodically adjusted by the County based upon approved costs and land use entitlements. The same agreements clearly delegate to the County the power to adjust these fees as required to reimburse Blackhawk, without any cap on the amount of these fees and without any legal requirement to obtain the Cities ' consent thereto. Further, these same agreements require that Danville (and San Ramon) collect and forward to the County all such fees and otherwise notify the County of any density changes approved, planned or contemplated which differ from existing assumptions. Of course, as a matter of comity between local jurisdictions and to promote administrative convenience, County Mr. Michael M. If Danville's legal position differs from the County's, please advise us promptly of the differences and the reasons therefor so that the County may determine an appropriate course of action.
