Resolution of Termination of
Offer of Dedication
S. & H, . Code § 8335)
SUBJECT: Termination of Offer of Dedication of a portion of Medburn Street,
No. V2067D, W. O. 1818, Clyde Area.
The Board of Supervisors of Contra Costa County RESOLVES THAT:
This Termination of an Offer of Dedication of a certain excess right of way not
required for road purposes, is made pursuant to Government Code Section 66477.2(c)
and to Division 9, Part 3, Chapter 4 of the Streets and Highways Code, commencing with
Section 8330.
This termination request is for an Offer of Dedication of a portion of Medburn Street
located in Clyde area. A description of the offered area to be terminated is attached
hereto as Exhibit "A" and incorporated herein by reference.
This termination of an offer of dedication is for a portion of Medburn Street which
has not been used for the purpose for which it was dedicated for five consecutive years
immediately preceding the date of this action. (S. & H. Code Section 8333).
Considering all facts before it, this Board FINDS there is no reasonable probability
that the County will accept the offered roadway, that no public money has been
expended for maintenance of the offered roadway, and that it is in the best interests of
the County and the public that the offered area be privately owned and maintained.
This activity is not subject to California.Environmental Quality Act pursuant to
Section 15061 (b) (3) of Chapter 3 of the C.E.Q.A. Guidelines as it can be seen with
certainty that there is no possibility that the activity may have a significant effect on the
environment.
This Board hereby TERMINATES the hereinabove described offer of dedication and
ABANDONS the right of the County to accept said offer. The Board is not aware of any
existing in place utilities in the subject area.

The Real Property Division is ORDERED to record a certified copy of this
Resolution in the office of the County Recorder.
From and after the date this resolution is recorded, the offer of dedication is
terminated and the County's right to accept offer is abandoned.

A portion of Medburn Street as shown on the "Map of Clyde", filed April 2, 1919 in Book
17 of Maps at page 358, records of Contra Costa County, State of California, described
as follows:
Beginning at a point on the easterly line of Lot 18 as shown on that map titled "Clyde
Commons - Subdivision 6889", filed October 6, 1987 in Book 317 of Maps at page 1,from
which point the northeast corner of said Lot 18 bears north 2°21'52" east 26.79 feet along
the easterly line of said Lot 18; thence from said Point of Beginning along the easterly line
of Lots 18, 17 and 16 north 2021'52" east 184.14 feet to a point on the.southerly line of
that parcel of land described as Parcel 4 in the deed to "Vantage Homes - A Limited
Partnership", recorded August 20, 1987 in Book 13848 of Official Records at page 265;
thence along the southerly line of said Parcel 4 along a non-tangent curve, concave to
the northwest having a radius of 80.00 feet, to which a radial bears north 0049'14" west;
thence along said curve through a central angle of 19°10'18" an arc length of 26.77 feet;
thence north 70000'29" east, 19.19 feet to the easterly line of said Medburn Street (17 M
358); thence along the easterly line of said Medburn Street the following courses; south
19059'31" east 40.00 feet to a point from which a radial line of a non-tangent curve
concave to the southeast having a radius of 50.00 feet bears south 19°59'31"east; thence
along said curve, through a central angle of 67°38'37", an arc distance of 59.03 feet;
thence south 2021'52"west 128.75 feet; thence leaving the easterly line of Medburn Street
17 M 358) north 59°59'00" west 31.57 feet to the Point of Beginning.
Containing an area of 6,633 square feet of land, more or less.
RESERVING THEREFROM: Pursuant to the provisions of Section 8340 of the Streets and
Highways Code, the easement and right at any time, or from time to time, to construct,
enlarge, maintain, operate, replace, remove, and renew those existing and in place
utilities, as of the date of recording this instrument, in, upon, over, and across any
highway or part thereof proposed to be abandoned, including access to protect the
property from all hazards In, upon, and over the area herein before described to be
abandoned.
Bearings and distances are based on the California Coordinate System Zone III (C.C.S.
27).
