Adopted this Order on July 24, 1990 by the following vote:

ABSTAIN: None RESOLUTION NO. 90/480
SUBJECT: Exonerating Road Restoration Agreement for LUP 2172-84,
Byron area.
On February 28, 1989, the Board of Supervisors approved the
Road Restoration Agreement with William E. Ralph, developer,
whereby said developer agreed to restore Byron Hot Springs Road and
Holey Road if damaged by the construction of improvements under LUP
2172-84 .
The Public Works Director having reported that he has received
a letter from Frederick M. Etzel of Henn, Etzel and Mellon,
attorneys for the developer, disclosing that the developer has no
intention of commencing the construction of the Wind Electrical
Power Generation Facility permitted under LUP 2172-84, and has
requested a full refund of the $41, 000 cash security as provided by
Section 12 of said agreement. Upon the full refund of the
security, said agreement stipulates that LUP 2172-84 be deemed null
and void.
IT IS BY THE BOARD ORDERED that the Road Restoration
Agreeement for LUP 2172-84 is exonerated.
IT IS FURTHER ORDERED that the Public Works Director is
authorized to refund the $41, 000 cash security (Auditor's Deposit
Permit No. 151872, dated February 2, 1989) plus interest in
accordance with Government Code Section 53079 to William E. Ralph.
