THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Resolution on November 27, 1990 by the following vote:
AYES: Supervisors Powers, Schroder, McPeak, Torlakson and Fanden
NOES: None
ABSENT: None
ABSTAIN: None RESOLUTION NO. 90/756
SUBJECT: Completion of Improvements, Subdivision MS 50-85, Alamo
Area.
The Public Works Director has notified this Board that the
improvements in Subdivision MS 50-85 have been completed as
provided in the Subdivision Agreement with Robert Hodges, Darcy
Hodges and Shirley M. Hodges heretofore approved by this Board in
conjunction with the filing of the Subdivision Map.
NOW THEREFORE BE IT RESOLVED that the improvements have been
COMPLETED as of November 7, 1990 thereby establishing the six-month
terminal period for the filing of liens in case of action under
said Subdivision Agreement, Dated February 25, 1986;
BE IT FURTHER RESOLVED that the $5700 cash security for labor
and materials (Auditor's Deposit Permit No. 104131, dated February
7 , 1986) deposited by Robert W. Hodges, be RETAINED for the
six-month lien guarantee period until May 7, 1991, at which time
the Public Works Director is AUTHORIZED to refund the cash security
less the amount of any claims on file.
BE IT FURTHER RESOLVED that there is no one year warranty
period required, and the Public Works Director is AUTHORIZED to
refund the $11, 400 cash security for performance (Auditor' s Deposit
Permit No. 104131, dated February 7 , 1986 and Auditor' s Deposit
Permit No. 103283 , dated January 21, 1986) plus interest in
accordance with Government Code Section 53079, if appropriate, to
Robert W. Hodges, pursuant to the requirements of the Ordinance
Code.
I hereby certify that this Is a true and correct copy of
an action taken and entered on the minutes of the
Board of Supervisors on the data shown.
