WHEREAS, pursuant to Education Code Section 35765, upon receipt of proper evidence that an action to reorganize school districts has been approved as provided by law, the Board of Supervisors shall order a change in school "district boundaries as required by the action; and WHEREAS, the Board of Supervisors has received proof that on March 29, 1990 the Contra Costa County Committee on School District Organization adopted Resolution 89/90-1 approving the transfer of school district territory from Antioch Unified School District to Liberty Union High School District and Oakley Union Elementary School district as shown on the legal description attached hereto as Exhibit A and incorporated herein. (Copy of Resolution 89/90-1 attached hereto as Exhibit B. ) NOW, THEREFORE BE IT RESOLVED THAT the boundaries of the Antioch Unified, Oakley Union Elementary and Liberty Union High School districts be changed as reflected in the legal description of the changed district boundaries attached hereto as Exhibit A and incorporated herein. 1 hereby certify that this is a true and correct copy of Orig. EXHIBIT A IN THE COUNTY COMMITTEE ON SCHOOL DISTRICT ORGANIZATION OF CONTRA COSTA COUNTY,STATE OF CALIFORNIA In the Matter of Approving Transfer of School District Territory From Antioch Unified y Resolution No. 89/90-1 School District to Liberty Union ) High School District and Oakley ) Union School District WHEREAS, California Education Code Section 35700 (c) provides that an action to reorganize' one or more districts is initiated upon the filing of the County Superintendent of Schools, of a petition to reorganize one or more school districts signed by a majority of the members of the governing boards of each of the districts that would be affected by the proposed reorganization; and WHEREAS, the governing boards of the Antioch Unified School District , the Liberty Union High School District , and the Oakley Union School District, have agreed that it is in the ,best interest of each respective district and the residents and pupils thereof that the territory described in Exhibit "A" , be transferred from the Antioch Unified School District to the Liberty Union High School District and the Oakley Union School District; and ' WHEREAS, the County Superintendent of Schools has determined that the petition is legally sufficient; and WHEREAS, the County Committee on School District Organization conducted public hearings on March 29 , 1990 , at Liberty High School District in Brentwood and the Antioch Unified School District -Central Office; and WHEREAS, it is the opinion of the County Committee that the petition complies with criteria described in Education Code Sections 35705 .5 . 35705 .7 , and 35753 as;, reported in the description of petition in Exhibit B" attached hereto. NOW, THEREFORE, BE IT RESOLVED, by the Contra Costa County Committee on School District Organization that the petition to transfer school district territory from the Antioch Unified School District to the Liberty Union High School District and the Oakley Union School District be approved. BE IT FURTHER RESOLVED that the County Superintendent of Schools be directed to transmit this resolution, the petition to transfer school district territory and other appropriate materials to the County Board of Supervisors . RIGHTS OF EMPLOYEES The area proposed for transfer is inhabited. in proportion to enrollment '' in each of the three districts affected, the number of students proposed for transfer is not significant regarding overall district staffing patterns. Further, no school faci-, lities are located in the area proposed for transfe'r . The rights of employees in affected districts to continued employment is not impacted by the proposed territory transfer . 1 1 2 . REVENUE LIMIT The revenue limit per unit of average daily attendance of the Antioch Unified School District for the 1989-90 year was 2 ,904 .49 . . The revenue limit of the Oakley Union School District was $2 ,721 .10 . The revenue limit of the Liberty Union High School District was $3 ,378 .58 . Approval of the petition will not affect the base revenue of any district. 3 . DISTRICTS 'GOVERNED BY A CITY CHARTER The Antioch Unified School District , Oakley Union School District and Liberty Union High School District Governing Boards are ,not governed by a City Charter. 4 . NUMBER OF GOVERNING BOARD MEMBERS The Antioch Unified School District, Oakley Union School District and Liberty Union High School 'District Governing Boards are each composed of five members. DESCRIPTION OF TERRITORY IN WHICH ELECTION WILL BE HELD The area affected by the petition is inhabited and comprises less than 5% of the assessed valuation of any of the three districts.; An election is not proposed. 6 . CREATION OF NEW DISTRICTS The petition will not create a new district . 7 . TRUSTEE AREA FOR GOVERNING BOARD MEMBERS The petition will not affect the trustee areas of current or new district Governing Board members . 8 . DIVISION OF PROPERTY OBLIGATIONS AND BONDED INDEBTEDNESS ii No school district property will be exchanged. The territory proposed 'fbr transfer will drop liability for bonded indebted- ness in its former district and assume its proportionate share of bonded indebtedness of the receiving district . There will be an outstanding bonded indebtedness for the Antioch Unified School District on June 30 , 1990 , of $304 ,012 . 50 . There will be an outstanding bonded indebtedness for the Oakley Union School District on June 30, 1990, of $56 ,950 . There will be an outstanding bonded indebtedness for the Liberty Union High School District on June 30 , 1990 , of $10 ,960 , 036 .25 . Due to the small size of the area proposed to be transferred relative to each district, there will be no division of property as a result of this proposal. 9 . GOVERNING BOARD ELECTION An election is not proposed nor will the petition affect any new or future Governing Board election. 10 . FINDINGS a . The County Committee hereby reports that , in the opinion of the Committee, school district organization will not be adversely affected by approving this petition. b. Approval of the petition would be compatible with master plans ?submitted by the County Committee in that granting the petition would adjust boundaries of the Liberty Union High School District. C. That the County Committee is aware of the provisions of Education Code Section 35753 and believes that each of the conditions stated therein would be substantially met if the the petition is approved. d . The County Committee does not believe that the transfer will increase the value of homes and property. Supomtendent CONTRA 'SM COUNTY 77 Santa B&4Wa Road• Pleasant Hill, Calfiiamia 94523 OFFICE of EDU CATION 415)944-3388 REPORT OF THE CONTRA COSTA COUNTY COMMITTEE ON SCHOOL DISTRICT ORGANIZATION CONCERNING PETITION TO TRANSFER TERRITORY FROM THE 'WALNUT CREEK SCHOOL DISTRICT AND ACALANES UNION HIGH SCHOOL DISTRICT TO SAN RAMON VALLEY UNIFIED SCHOOL DISTRICT The County Committee .has received petition from Paula Kelsoe, chief petitioner, to transfer territory. Two public hearings on the petition were held on June 7 , 1989. Pursuant to California Education Code Section 35705.5, the County Committee hereby provides the following description of the petition: 1. RIGHTS OF EMPLOYEES The area proposed for transfer is inhabited. in proportion to enrollment in each of the three districts affected, the number of students proposed for transfer is not significant regarding overall district staffing patterns. Further, no school facilities are located in the area proposed for transfer. The rights; of employees in the affected districts to continued employment is not impacted by the proposed territory transfer. 2. REVENUE LIMIT The revenue limit per unit of average daily attendance of the Walnut Creek School District for the 1988-89 year is 2 ,830 .29 . The revenue limit of the Acalanes Union High School District is $3 ,581.09. The revenue limit of the San RamonValley Unified School District is $2,755 .35 . Approval of the petition will not affect the base revenue of any district. 3 . DISTRICTS GOVERNED BY A CITY CHARTER The Walnut CreeX School District, Acalanes Union High School District and San Ramon Valley Unified School District Governing Boards are not governed by a City Charter. 4 . NUMBER OF GOVERNING BOARD MEMBERS The Walnut Creek School District, Acalanes Union High School Distr;ict .and San Ramon Valley Unified School District Governing Boards are. each composed of five members. DESCRIPTION OF TERRITORY IN WHICH ELECTION WILL BE HELD The area affected by the petition is inhabited and comprises less than 5% of the assessed valuation of any of the three districts. An election is not proposed. 6 . CREATION OF NEW DISTRICTS The petition will not create a new district . 7 . TRUSTEE AREA FOR GOVERNING BOARD MEMBERS The petition will not affect the trustee areas of current or new district Governing Board members. 8. DIVISION OF PROPERTY OBLIGATIONS AND BONDED INDEBTEDNESS No school district property will be exchanged. The territory proposed for transfer will drop liability for bonded indebtedness in its former district and assume its proportionate share of bonded indebtedness of the receiving district. There is no outstanding bonded indebtedness for the Walnut Creek School District on June 30, 1989. The bonded indebtedness of the Acalanes Union High- School District on June 30, 1989 will be $136,500. There will be $1,519,062 .50 outstanding bonded indebtedness for the San Ramon Valley Unified School District. Due to the small size of the area proposed to be transferred relative to each district, there will be no division of property as a result of this proposal . 9 .
