THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA

RESOLUTION no. 90/738
SUBJECT: Amending Subdivision Agreement, Subdivision 7023, Clayton
Area.
The Public Works Director having notified this Board that
Clayton Valley Farms, Incorporated, subdivider of Subdivision 7023,
has requested that the Subdivision Agreement approved by the Board
on September 12, 1989 be amended to allow the acceptance of
substitute corporate surety bond to replace the corporate surety
bond dated August 24, 1989, and issued by Amwest Surety Insurance
Company (Bond No. 1189993) , that accompanied said agreement.
The Public Works Director having presented for Board approval
the following substitute security to guarantee the road and
drainage improvements, which have been redesigned to reduce the
cost of the improvements, as required by Title 9 of the County
Ordinance Code:
Security with Clayton Valley Farms, Incorporated as principal
in the form of a corporate surety bond (Bond No. 123514) dated
October 12, 1990, and issued by American Bonding Company in the
amount of $159, 600 for faithful performance and $81,550 for labor
and materials.
NOW THEREFORE BE IT RESOLVED . that the Subdivision Agreement
approved by the Board on September 12, 1989, is hereby AMENDED to
allow substitution of the above-mentioned corporate surety bond 'in
place of the surety bond issued by Amwest Surety Insurance.
BE IT FURTHER RESOLVED that the corporate surety bond (Bond
No. 1189993) issued by Amwest Surety Insurance Company is .
terminated.
