HomeMy WebLinkAboutRESOLUTIONS - 11061990 - 90/725i d at the request of: V Costa County Re.. i! to: Public Yorks Department Records Section THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on November 6, 1990 by the following vote: AYES: Supervisors Powers, Schroder, McPeak, Torlakson and Fanden NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO. 90/725 SUBJECT: Completion of Improvements and approval of Road Improvement Agreement for Las Trampas Road, Subdivision 6419, Alamo area. On July 26, 1988, this Board approved a Subdivision Agreement for Subdivision 6419 with Alamo Ridge Association, developer, whereby said developer agreed to complete all improvements as required in said Subdivision Agreement The Public Works Director has notified this Board that the improvements in Subdivision 6419 have been completed as provided in said agreement, with the exception of a retaining wall adjacent to the Las Trampas Road extension. In order to allow the release of a major portion of the Subdivision Agreement bond for said completed improvements, before the completion of the retaining wall, the following documents were presented for Board Approval: A Road Improvement Agreement with' Alamo Ridge Association, developer, whereby said developer agrees to complete all improvements as required in said Road Improvement Agreement within one year form the date of agreement. The improvements generally consists of completing the retaining wall adjacent to the Las Trampas Road extension. Said document was accompanied by security to gurantee the completion of the road improvements as required by Title 9 of the County Ordinance Code, as follows: A. Cash deposit in the amount of $1,000. The developer has requested that $1,000 of the 6,570 cash deposit (Auditor's Deposit Permit No. 142867, dated July 8, 1988) originally made for the aforesaid Subdivision Agreement approved on July 26, 1988, be assigned as cash security for the new Road Improvement Agreement. B. Additional Security in the form of a corporate surety bond, dated October 15, 1990, and issued by Developers Insurance Company (Bond No. 203034 S) with Alamo Ridge Association as principal, in the amount of 22,885 for faithful performance and $11,442.50 for labor and materials. Now THEREFORE BE IT RESOLVED that the aforementioned Improvements have been COMPLETED as of November 6, 1990 thereby establishing the six-month terminal period for the filing of liens in case of action under the .Road Improvement Agreement: DATE OF AGREEMENT SURETY July 26, 1988 Developers Insurance Company Bond No. 959852 S Completion of Improvements for Subdivision 6419 X November 6, 1990 Page Two BE IT FURTHER RESOLVED that there is no need for a one year warranty period and the Public Works Director is AUTHORIZED to refund the remainder of the cash security for performance in the amount of $5,570 (Auditor's Deposit Permit No. 142867, dated July 8, 1988) plus interest in accordance with Government Code Section 53079, if appropriate, to Alamo Ridge Association pursuant to the requirements of the Ordinance Code. BE IT FURTHER RESOLVED the Road Improvement Agreement for the retaining wall and the assignment of the $1,000 cash deposit to said agreement is APPROVED.
