HomeMy WebLinkAboutRESOLUTIONS - 06261990 - 90/420 (2)r THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on June 26, 1990 by the following vote: AYES: Supervisors Powers, Schroder, McPeak, Torlakson and Fanden NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO.90/420 SUBJECT: Approval of the Final Map and Subdivision Agreement for Improvement Warranty for Subdivision 7006, Crockett Area. The Public Works Director having notified this Board that the improvements for Subdivision 7006 have been completed and that such improvements were constructed without the need for a Subdivision Agreement. The following documents were presented for Board approval this date: The Final Map of Subdivision 7006, property located in the Crockett area, said map having been certified by the proper officials. A Subdivision Agreement for Improvement Warranty with Brasesco-Tommerup, Incorporated, subdivider, whereby said subdivid- er agrees to satisfy any valid claims or liens of labor and materials for said improvements and subdivision appearing hereafter upon demand by the County as required in said Subdivision Agreement for Improvement Warranty within six months from the date of said agreement. Said documents were accompanied by: I. Security for labor and materials for the six-month lien guarantee period as required by Title 9 of the County Ordinance Code, in the form of a letter of credit (No. 1603) dated June 11, 1990, and issued by The Mechanics Bank with Brasesco-Tommerup, Incorporated as principal, in the amount of $25, 100. II. Letter from the County Tax Collector stating that there are no unpaid County taxes heretofore levied on the property included in said map and that the 1989-90 tax lien has been paid in full and the 1990-91 tax lien, which became a lien on the first day of March, 1990, is estimated to be $200. III. Security to gurantee the payment of taxes as required by Title 9 of the county Ordinance Code in the form of a cash deposit (Auditor's Deposit Permit No. 174570 dated June 11, 1990) made by Brasesco-Tommerup, Incorporated, in the amount of $200 guaranteeing the payment of the estimated tax. NOW THEREFORE BE IT RESOLVED that said subdivision, together with the provisions for its design and improvement, is DETERMINED to be consistent with the County's general and specific plans. RESOLUTION NO. 90/420 Approve Final Map and Subdivision Agreement for Subdivision 7006 June 26, 1990 Page Two BE IT FURTHER RESOLVED that said Final Map is APPROVED. BE IT FURTHER RESOLVED that said Subdivision Agreement for Improvement Warranty is also APPROVED. BE IT FURTHER RESOLVED that the improvements have been COMPLETED as of June 26, 1990 thereby establishing the six-month terminal period for the filing of liens in case of action under said Subdivision Agreement for Improvement Warranty. BE IT FURTHER RESOLVED that the aforesaid letter of credit No. 1603) dated June 11, 1990 for the payment of labor and materials be RETAINED for the six-month lien gurantee period until December 26, 1990, at which time the Public Works Director is AUTHORIZED to exonerate the letter of credit if no claims are on file, or to draw against the letter of credit in the amount of any claims on file.
