Adopted this Order on September 29 , 1987 by the following vote :
AYES : Supervisors Powers , Fanden, Schroder, Torlakson $ McPeak

ABSENT : None
ABSTAIN : None
SUBJECT: Approve Acquisition of Off-Site Right of Way Agreement
and Acquisition Deposit for Subdivision 6889 , Concord
Area .
The Public Works Director having reported that the drainage
requirements of the Ordinance Code for Subdivision 6889 requires
the developer to acquire two off-tract drainage easements between
the subdivision and Mt . Diablo Creek , and that the developer is
unable to acquire said easements .
The Public Works Director having further reported that on
this date , September 29 , 1987 , this Board approved the final map
of Subdivision 6889 pursuant to Government code Section 66462 . 5
and that Vantage Homes , a limited partnership , developer , has
entered into an "Acquisition of Off-Site Right of Way" Agreement
to ensure payment by the developer of all costs involved in
acquiring a drainage easement across property owned by Conco
Cement .
Said agreement as secured with a cash deposit (Auditor' s
Deposit Permit No . 129575 , dated September 11 , 1987 ) in the
amount of $8 , 000 made by Vantage Homes , a limited partnership .
The Public Works Director having further reported that a
cash deposit has been deposited by Vantage Homes , a limited
partnership in the amount of $7 ,000 (Auditor ' s Deposit Permit No .
129575 , dated September 11 , 1987 ) to cover the acquisition costs
of a second storm drain easement across property owned by the
United States of America (Naval Weapons Station ) and that said
deposit will be refunded with the execution and acceptance of
said easement .
On the recommendation of the Public Works Director IT IS BY
THE BOARD ORDERED that the Chair is AUTHORIZED to execute the
"Acquisition of Off-Site Right of Way" Agreement .

vote :

NOES : None
ABSENT: None
ABSTAIN : None RESOLUTION NO. 87/590
SUBJECT: Approval of the Final Map and Subdivision Agreement for
Subdivision 6889 , Concord Area .
The following documents were presented for Board approval
this date :
The Final Map of Subdivision 6889 , property located in the
Concord area , said map having been certified by the proper
officials .
A Subdivision Agreement with Vantage Homes , a Limited
Partnership , subdivider , whereby said subdivider agrees to
complete all improvements as required in said Subdivision
Agreement within one year from the date of said agreement .
Said documents were accompanied by:
I . Security to guarantee the completion of road and
drainage improvements as required by Title 9 of the
County Ordinance Lode , as follows :
A . Cash deposit ( Auditor ' s Deposit Permit No . 128790 ,
dated August 21 , 1987 ) in the amount of $4 , 035
made by Allied Investments .
B . Additional security in the form of a corporate
surety bond dated August 27 , 1987 , and issued by
Automotive Insurance Co . ( Bond No . AIC 580709)
with Vantage Homes , a Limited Partnership as
principal , in the amount of -$ 399 , 465 . 00 for
faithful performance and $201 ,750 . 00 for labor and
materials .
II . Letter from the County Tax Collector stating that there
are no unpaid County taxes heretofore levied on the
property included in said map and that the 1986-87 tax
1 ien has been paid in full and the 1987-88 tax lien ,
which became a lien on the first day of March , 1987 , is
estimated to be $8 , 300 . 00 .
III . Security to guarantee the payment of taxes as required
by Title 9 of the County Ordinance Code in the form of
a surety bond , No . AIC 580937 , issued by Automotive
Insurance Co .with Vantage Homes as principal , in the
amount of $8 , 300 . 00 guaranteeing the payment of the
estimated tax ;
NOW THEREFORE BE IT RESOLVED that said subdivision , together
with the provisions for its design and improvement , is DETERMINED
to be consistent with the County' s general and specific plans .
BE IT FURTHER RESOLVED that said Final Map is APPROVED and
this Board does not accept or reject on behalf of the public any
of the streets , paths , or easements shown thereon as dedicated to
public use .

BE IT FURTHER RESOLVED that said Subdivision Agreement is
also APPROVED.
