Dear Assembly Member Wood:
The County Health Executives Association of California (CHEAC), representing local
health departments throughout our state, is pleased to SUPPORT AB 388 by Assemb ly
Member Monique Lim ón, which would require the California Department of Public Health
(CDPH) to implement action agenda items of the U.S. Centers for Disease Control and
Prevention (CDC) Healthy Brain Initiative, coordinate a statewide public awareness
campaign, and establish a pilot program to support county initiatives to address
Alzheimer’s disease and related dementia s.
According to the CDC, Alzheimer’s disease and related dementias are the sixth leading
cause of death in the United States , causing over 116,000 deaths in 2016. In California,
650,000 residents age 65 and older were estimated to be living with Alzheimer’s Disease
in 2018; by 2025, the Alzheimer’s Association expects that number to rise to 840,000
Californians age 65 and over. Cognitive decline, ranging from mild cognitive impairment
to dementia, can have significant implications for an individual’s overall health and
wellbeing.
The CDC Healthy Brain Initiative details a comprehensive , multidisciplinary path forward
in promoting cognitive health, addressing cognitive impairment, and meeting needs of
caregivers. The Initiative’s action agenda items provide further guidance on risk
identification and reduction, education and training, policy and partnership development,
and monitoring and evaluation. By strengthening state and local pub lic health capacity,
developing partnerships, and integrating cognitive health into existing public health
efforts, California can make progress in reducing risk for cognitive decline amongst our
residents.

Local health departments support efforts to educate Californians about dementia, improve
early dementia detection and timely diagnosis activities, and strengthen local public
health capacity related to dementia . It is for these reasons that CHEAC supports AB 388.

AB 723 (Wicks and Bonta): Low-Income Housing Incentives: Leased Rental Housing
According to its author, "this bill is an effort to avoid tenant displacement and accelerate the
creation of affordable housing. AB 723 would provide property owners an opportunity to convert
existing buildings to affordable housing and charge sufficiently low rents in return for a lower
overall property tax liability." The Fact Sheet from its author is attached.
Legislative Counsel's Digest:
Existing property tax law, in accordance with authorization provided by the California Constitution, provides a welfare
exemption for property used exclusively for religious, hospital, scientific, or charitable purposes and that is owned or operated
by certain types of nonprofit entities, if certain qualifying criteria are met. Existing property tax law additionally exempts from
taxation on the possessory and fee interest property that is leased for 35 years or more, if the lessor is not otherwise qualified
for the welfare exemption and the property is used exclusively and solely for rental housing and related facilities for
low?income tenants, as provided, and leased and operated by specified entities.
This bill would instead authorize the Counties of Alameda and Contra Costa to provide the lessor
of an eligible property located within its territorial boundaries with a low?income rental housing
incentive. The bill, among other requirements similar to those for the leased property exemption
for rental housing described above, would require that an eligible property be used exclusively for
rental housing that is rented for no more than 30 percent of the income level of persons of low
income to tenants occupying the property at the commencement of the lease and that the lease
commence on or after January 1, 2020, and before January 1, 2025. The bill would require that
the amount of incentive payment be based on the amount of property taxes apportioned to the
county and the city in which the eligible property is located. The bill would require a city to
reimburse a county for a certain amount of the low?income rental housing incentive, thereby
imposing a state?mandated local program.
This bill would make legislative findings and declarations as to the necessity of a special statute
for the Counties of Alameda and Contra Costa.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the
state. Statutory provisions establish procedures for making that reimbursement.

This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the
state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.

The County's former Health Services Department Director, Dr. William Walker, serves on the
Legislation Committee of County Health Executives Association (CHEAC) and on the Executive
Committee of California Association of Public Hospitals and Health Systems (CAPH). Josh
Sullivan, Health Services Administrator, is participating with Dr. Walker in these activities as
well as making Legislative visits to Washington, D.C. (February 27, 2019) and Sacramento
(March 2019).
The priority of those visits has been to update our Congressional and legislative delegations
regarding the scheduled October 1 cuts to the Disproportionate Share Hospital funds, the threats to
340B drug discounts, and the renewal of our Medicaid waiver which expires next year. Dr.
Walker will be providing an update the Legislation Committee on these issues.
Referral Update:
In Texas v. United States,the trial court invalidated the entire Affordable Care Act (ACA), including
the Medi-Cal expansion that has significantly benefited California residents by expanding access
to critically-needed and high quality health and behavioral health care services for the most at-risk
residents. That decision is temporarily on hold while the Court of Appeals considers the case.

MU: The environmental health directors organization is working with the health
officers lobbying organization (HOAC) and the public health directors
organization (CHEAC) to propose some fixes to the AB626 microenterprise
home kitchen. The group is also working with CooksAlliance and AirBnB. Some
of the recommendations have been included and some have not. And AirBnB in
particular want changes that we do not want, for instance they want to be able
to have serving in the front yard. So you could set up your barbeque and cook
and serve.
