HomeMy WebLinkAboutRESOLUTIONS - 06261990 - 90/422v „ THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY) CALIFORNIA Adopted this Resolution on 'June 26, 1990 by the following vote: AYES: Supervisors Powers, Schroder, McPeak, Torlakson and Fanden NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO. 90/422 SUBJECT: Approval of the Parcel Map and Subdivision Agreement for Improvement Warranty for Subdivision MS 118-88, Oakley Area. The Public Works Director having notified this Board that the improvements for Subdivision MS 188-88 have been completed and that such improvements were constructed without the need for a Subdivi- sion Agreement. The Public Works Director having also notified this Board that these improvements have been completed with the exception of minor deficiencies, for which a $500 cash deposit (Auditor's Deposit Permit No. 174657, dated June 12, 1990) was made by James H. Farr and Patricia S. Farr to insure the application of reclamite on the private roadway. The following documents were presented for Board approval this date: The Parcel Map of Subdivision MS 118-88, property located in the Oakley area, said map having been certified by the proper officials. A Subdivision Agreement for Improvement Warranty with James H. Farr and Patricia S. Farr, subdivider, whereby said subdivider agrees to satisfy any valid claims or liens of labor and materials as to the said improvements and subdivision appearing hereafter upon demand by the County as required in said Subdivision Agreement for Improvement Warranty within six months from the date of said agreement. Said documents were accompanied by: I. Security for labor and materials for the six-month lien guarantee period as required by Title 9 of the County Ordinance Code, in the form of a labor and materials payment bond dated May 3, 1990, and issued by American Trust Insurance Company, LTD (Bond No. 90-001-09-1783) with William G. McCullough Company as principal, in the amount of $6,803.50. II. Letter from the County Tax Collector stating that there are no unpaid County taxes heretofore levied on the property included in said map and that the 1989-90 tax lien has been paid in full and the 1990-91 tax lien, which became a lien on the first day of March, 1990, is estimated to be $4,100 III. Security to guarantee the payment of taxes as required by Title 9 of the County Ordinance Code in the form of a letter of credit dated May 1, 1990, issued by John Muir National Bank with James H. Farr and Patricia S. Farr as principal, in the amount of $4, 100 guaranteeing the payment of the estimated tax. NOW THEREFORE BE IT RESOLVED that said subdivision, together with the provisions for its design and improvement, is DETERMINED to be consistent with the County's general and specific plans. RESOLUTION NO.90/422 Approve Parcel Map and Subdivision Agreement for MS 118-88 June 26, 1990 Page Two BE IT FURTHER RESOLVED that said Parcel Map is APPROVED. BE IT FURTHER RESOLVED that said Subdivision Agreement for Improvement Warranty is also APPROVED. BE IT FURTHER RESOLVED that the improvements have been COMPLETED as of June 26, 1990 thereby establishing the six-month terminal period for the filing of liens in case of action under said Subdivision Agreement for Improvement Warranty.
