HomeMy WebLinkAboutRESOLUTIONS - 06261990 - 90/421THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on June 26, 1990 by the following vote: AYES: Supervisors Powers, Schroder, McPeak, Torlakson and Fanden NOES: None ABSENT: None ABSTAIN: None RESOLUTION No.90/421 SUBJECT: Approval of the Final Map and Subdivision Agreement for Subdivision 7064, Oakley Area. The Public Works Director having notified this Board that the improvements for Subdivision 7064 have been completed with the exception of minor deficiencies, for which a $500 cash deposit Auditor's Deposit Permit No. 174524, dated June 8, 1990) was made by Albert D. Seeno to insure the application of reclamite on the private roadway. The following documents were presented for Board approval this date: The Final Map of Subdivision 7064, property located in the Oakley area, said map having been certified by the proper offi- cials. A Subdivision Agreement with Albert D. Seeno, subdivider, whereby said subdivider agrees to warrant the public street improvements and to satisfy any valid claims or liens of labor and materials as to the said improvements and subdivision appearing hereafter upon demand by the County as required in said Subdivision Agreement within six months from the date of said agreement. Said documents were accompanied by: I. Security to warrant the road and drainage improvements as required by Title 9 of the County Ordinance Code, as follows: A. Cash deposit (Auditor's Deposit Permit No. 170428, dated March 16, 1990) in the amount of $1, 000 made by Albert D. Seeno. B. Additional security in the form of a corporate surety bond dated June 1, 1990, and issued by Employers Insurance of Wausau (Bond No. 0651-84- 040569-0) with Albert D. Seeno as principal, in the amount of $16,200 for faithful performance and 16,200 for labor and materials. II. Letter from the County Tax Collector stating that there are no unpaid County taxes heretofore levied on the property included in said map and that the 1989-90 tax lien has been paid in full and the 1990-91 tax lien, which became a lien on the first day of March, 1990, is estimated to be $600. III. Security to guarantee the payment of taxes as required by Title 9 of the County Ordinance Code in the form of a cash deposit (Auditor's Deposit Permit No. 170331 dated March 15, 1990) made by Albert D. Seeno in the amount of 600 guaranteeing the payment of the estimated tax; NOW THEREFORE BE IT RESOLVED that said subdivision, together with the provisions for its design and improvement, is DETERMINED to be consistent with the County's general and specific plans. BE IT FURTHER RESOLVED that said Subdivision Agreement is also APPROVED. BE IT FURTHER RESOLVED that the improvements have been COMPLETED as of June 26, 1990 thereby establishing the six-month terminal period for the filing of liens in case of action under said Subdivision Agreement.
